CONDITIONS OF ENTRY
1. Information on how to enter and about prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.
 
2. Entry is only open to residents of Australia who are aged 18 years or over. Employees and their immediate families of the Promoter, Participating Outlets and their agencies associated with this promotion are ineligible to enter.
 
3. The promotion will only be conducted in selected outlets ("Participating Outlets") nationally between 12:01am AEST on 18 July 2014 and 11:59pm AEST on 31 August 2014 ("Promotion Period"). Participating outlet include: Sports Bar and Rock Lily at The Star, Atrium Bar, The PA Bar and J-Bar at  Jupiter’s Hotel and Casino and LiveWire, The Kitty, Keno and Ryan’s on the Park at Treasury Casino and Hotel.
 
4. To be eligible to enter the promotion, consumers must purchase any Johnnie Walker Spirit from a Participating Outlet during the Promotion Period to receive a scratch card, while scratch card lasts.
 
5. To enter, consumers must during the Promotion Period send SMS to 0448 323 553 comprising in the following order with a space between each item: the unique code from the scratch card, their first and last name, postcode and age. Sample SMS entry: 6582396259133 Joe Smith 2000 25.
 
6. SMS entries are charged based on entrant's individual phone plan, but will not exceed 55cents. Entrants should check with their individual provider. Entries via SMS will only be accepted from mobile phones. SMS entries via the Internet are ineligible. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. Service Provider is Traction Digital Pty Ltd.
 
7. The Promoter reserves the right, at any time during or after the closing date of the promotion to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
8. Multiple entries permitted, subject to the following: (a) limit of one entry per person per day; (b) limit one entry per specified purchase requirement; (c) the same unique code cannot be entered more than once; (d) unrecognized unique codes will be deemed invalid; and (e) each entry must be submitted separately and in accordance with the entry requirements.
 
9. Entrants must retain scratch card used to enter for each entry made as a proof of purchase. Failure to produce the scratch card(s) for all entries upon request may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
 
10. No responsibility accepted for late or misdirected entries. Incomplete or indecipherable entries will be deemed invalid. Entries are deemed to be received at the time of receipt in the Johnnie Walker ‘Win a Trip for 2 to the race weekend in Singapore’ Promotion database and NOT at the time of transmission by the entrant.
 
11. The draws will be conducted at Traction Digital Pty Ltd located at Level 1, Building 1, 85 O’Riordan Street Alexandria NSW 2015 at 9:00 AM AEST on 1st September 2014. The prize winners will be notified by phone and in writing within 2 business days of the draw. The prize winners will be published at www.diageopromotions.com.au on 4th September 2014 for a minimum of 28 days, and if any winner is from SA in The Australian on 4th September 2014
 
12. Entries will be divided into 3 draws according to the Participating Outlet where the entrant made the qualifying purchase. The first valid entry drawn in each draw will receive the major prize of a Trip for 2 adults to the race weekend in Singapore valued at up to $10,116 , containing the following:
• Return economy airfares from the winner's nearest capital city to Singapore;
• 3 day experience at the Singapore Airlines Singapore Grand Prix 2014;
• 4 nights’ accommodation in a hotel with a minimum of 4 stars, as determined by the Promoter (Thursday 18th – Monday 22nd September 2014;
• $500 Spending Money;
• Return airport and Hotel to airport transfers; and
• 3 Day double pass tickets.
Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.  Prize must be taken on 18 September 2014 to coincide with the race weekend and is subject to booking and flight availability.
 
13. The Promoter’s decision is final and no correspondence will be entered into.
 
14. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
 
15. Total prize pool value is up to $30,348. The Promoter accepts no responsibility for any variation in the prize value. Prize, including any unused portion, is not transferable or exchangeable and cannot be taken as cash, unless stipulated otherwise. Prize cannot be transferred to any other person, unless agreed to by the Promoter.
 
16. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted invalid.
 
17. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
18. If for any reason this competition is not capable of running as planned including (but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, war, terrorism or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion subject to state regulations.
 
19. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
 
20. Major prizes must be claimed by 12 pm AEST on 8th September 2014. A draw for any unclaimed prizes will take place at the same place as the original draw at 12.01pm AEST on 9th September 2014, subject to any written directions form a regulatory authority. The unclaimed prize winners will be notified by phone and in writing within 2 working days of the draw. The unclaimed prize draw winners, if any, will be published on www.diageopromotions.com.au on 11th September 2014, and if any winner is from SA in The Australian on 11th September 2014.
 
21. The prize must be taken as stated. If for any reason a prizewinner cannot take a prize or any part of a prize in accordance to these terms and conditions, including at the time specified by the Promoter, the prize will be forfeited and will not be redeemable for cash.
 
22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
 
23. It is a condition of accepting the prize that the major prize winner and their nominated companion to take the prize will, upon request by the Promoter, be required to sign a legal release and indemnity in a form to be determined by the Promoter. The prizewinner and their guest (where applicable) must each be 18 years or age or older and will, upon request by the Promoter, be required to provide identification satisfactory to the Promoter to verify same.
 
24. The Promoter and event organizers expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize, or if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
 
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia where it is illegal to do so (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Singapore Racing Weekend is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize or attending the event.
 
27. Diageo encourages consumers to enjoy drinking its products responsibly. Legal aged consumers are advised to visit www.drinkwise.org.au to get the facts on standard drinks and responsible drinking.
 
28. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://diageopromotions.com.au/privacy#cookies.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out of marketing, access, update or correct their PI, how entrants entrant can contact and may complain about a breach of the Australian Privacy Principles. All entries become the property of the Promoter.  Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia, and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles.  By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
