Participation

    Information on how to enter the 6 Cars in 6 Weeks Competition (“Competition”) and details of the Competition and Prizes form part of these Terms and Conditions. Participation in the Competition is deemed acceptance of these Terms and Conditions.
    The Competition is open to (i) Australian residents, (ii) aged 18 years or older and (iii) with subscriptions of Norton 360 Multi-Device (any version), Norton 360 Everywhere (any version), Norton 360 (any version), Norton Internet Security (2006 version or later), or Norton Antivirus (2006 version or later) that has been purchased from a participating Australian retailer or the Australian Norton Online Store (buy.norton.com). Employees of the Promoter and their immediate families, resellers of Symantec/Norton products including agencies or anyone connected with the administration of the Competition, and current subscribers of Not For Resale Norton products are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    Competition entry opens August 11, 2014 and closes September 21, 2014 (“Entry Period”).
    To be eligible to enter and win, entrants must have an active, valid Norton product subscription and by “active”, such subscription shall have a minimum of one (1) day remaining at the time of a Draw Date (as indicated in the table in Section 9 below). To enter, eligible entrants must then, during the Entry Period, visit the au.norton.com/car website and follow the instructions to submit their entry via the Symantec Online Redemption Centre. Entries will be accepted until 11:59pm AEST on September 21, 2014.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant identity and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
    Limit of one (1) entry per current valid product subscription permitted. A valid entry requires the entrant to submit his/her product activation key to the Promoter.
    Multiple claims cannot be made for a single active product subscription.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Draw

    There will be six (6) draws conducted for this Competition (one (1) draw for each week). Entries open at 12:00am AEST and close at 11:59pm AEST for each draw on the Draw Dates specified in the table below. All draws will take place at 3:00pm AEST at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway Erina, NSW 2250 on the Draw Dates specified in the table below. Un-drawn entries in each weekly draw will be entered into any subsequent weekly draws. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The Promoter will use all reasonable efforts to notify, by phone and email, each winner within two (2) business days of the relevant Draw Date. Winners’ names will be published online at www.facebook.com/NortonAU two (2) business days after a Draw Date and winners’ names will also be published in The Australian on October 6, 2014.

    Any Prize unclaimed by the relevant Final Prize Claim Date stated in the table in Section 9 will be forfeited. A draw for any unclaimed Prizes may take place on 23/12/2014 at the same time and place as the original draw, subject to any directions from a regulatory authority. The Promoter will use all reasonable efforts to notify, by phone and email, the winners within two (2) business days of the draw for the unclaimed Prizes. Winners’ names will also be published online at www.facebook.com/NortonAU on December 23, 2014 and in The Australian on January 12, 2015.
    The Promoter’s decision is final and no correspondence will be entered into.

Prize

    The first valid entry drawn in each weekly draw will win a Nissan Altima ST (5 door) with a 2.5L petrol engine and Xtronic CVT automatic transmission (“Prize”). The Prize will be awarded in the winner’s choice of either ‘Ebony’ (black) or ‘White Diamond’ (white) (subject to availability). Changes to colour, specification or premium options are not available. Total Prize value is up to AU$33,215.00 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, petrol and all other ancillary costs are the responsibility of the winner. Prizes will be delivered via the nearest participating Nissan dealership nominated by the Promoter in its absolute discretion. The winner must collect the Prize from the nominated dealership and any costs will be at the winner’s expense. The Promoter is not liable for any costs and expenses associated with the collection of any Prize.
    If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the Prize is awarded. It is a condition of accepting the Prize that the winner (or a representative of the winner) sign a legal release, if any, in a form to be determined by the Promoter in its discretion.
    Each winner will have their product activation key checked by the Promoter. If the product activation key has expired and they do not have a current activation key for one of the Norton products stated in Section 2, the Prize will be forfeited and a new winner will be selected from the list of reserves.
    Prizes must be taken “as is” and are not transferable, upgradeable, divisible or exchangeable and not redeemable for cash.
    Total Prize pool is valued at up to $199,290.00.
    If any Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute the Prize with a prize of equal value and/or substantially similar specifications, subject to directions from any regulatory authority.
    The Promoter shall not be liable for any costs associated with the Prize after delivery.

General

    Any cost associated with accessing the Competition website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and with or without notice, to: (a) disqualify any or all entrant(s); or (b) modify, suspend, terminate or cancel the Competition, as appropriate, subject to any directions of any regulatory authority.
    Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth.), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
    Except for any liability that cannot by law be excluded including the Non-Excludable Guarantees,, the Promoter, its affiliates and suppliers (including any of their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) or lack of a network connection; (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a Prize. In addition, the Promoter, its affiliates and suppliers (including any of their respective officers, employees and agents) are not responsible for and excludes all liability any lost, late, misdirected, damaged, incomplete or illegible entries nor for typographical or other errors in communications.
    The Promoter collects personal information ("PI") in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.symantec.com/en/au/about/profile/policies/privacy.jsp. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter and its affiliates may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The PI provided to the Promoter will be transferred to the Symantec group of companies and its authorised suppliers in different parts of the world, including the U.S. Some jurisdictions may have less protective data protection laws than Australia. Promoter has taken steps so that the collected information, if transferred overseas, receives an adequate level of protection. An entrant is deemed ineligible unless he/she agree to his/her PI being processed within the Symantec group or its authorised suppliers. All entries become the property of the Promoter.
    Symantec, Norton, the Checkmark Logo, and Norton 360 are all trademarks or registered trademarks of Symantec Corporation or its affiliates in the U.S. and other countries. Other logos, brands and products are the trademarks of their respective holder(s).
    These Terms and Conditions are governed by the laws of Australia. Entrants irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Australia.
