Conditions
1. Information on how to enter the Cash Kick promotion (Promotion) and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to residents of Australia. Employees and their immediate families of the Promoter, its agencies and venues/outlets associated with this promotion are ineligible to enter.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all the conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the conditions of this Promotion (Eligible Entrants).
3. Promotion commences at 00:01 (AEST) on 04/08/2014 and entries close at 23:59 (AEST) on 28/09/2014 (Promotion Period).
HOW TO ENTER
4. To enter the Promotion, Eligible Entrants must:
a)
purchase any specially marked promotional pack (Eligible Product) from any participating store located in Australia(Participating Outlets) during the Promotion Period (Qualifying Purchase);
AND
b) log on to the website
www.CashKick.com.au and fully complete the online entry form by providing their first name, surname, address, telephone number, year of birth, email address, the last four (4) digits of the barcode number printed on the Eligible Product purchased (Barcode), and any additional information as required by the Promoter.
Entrants must retain their original barcode from the Eligible Product purchased in their Qualifying Purchase (Proof of Purchase) which corresponds to each entry they submit in the Promotion.
5. Individuals can submit multiple entries subject to:
a)
a limit of three (3) entries per person per day; and
b) a limit of one (1) entry per Qualifying Purchase.
6. Incorrect Barcodes will not be accepted. Errors and omissions may be accepted at the Promoter’s absolute discretion.
7. Entrants are responsible for the costs associated with accessing the website via an internet service provider. There is no additional cost to participate in the Promotion via the internet other than the cost to access the internet site via an internet service provider.
8. Any entry that is lodged, or reasonably suspected by the Promoter to have been lodged, by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will be invalid. Once an entry has been deemed invalid in accordance with this clause, all other entries submitted by the entrant whose entry has been deemed invalid in accordance with this clause will also be deemed invalid.
HOW WINNERS ARE DETERMINED
9. To determine Daily Prize winners, there will be a prize draw each day of the Promotion commencing 12:00 noon (AEST) on 05/08/2014 with the final daily prize draw occurring at 12 noon (AEST) on 29/09/2014 (Daily Prize Draws). There will be 56 Daily Prize Draws in total.
Entries will only be eligible to win the Daily Prize in the next occurring Daily Prize Draw. Entries will not be included in subsequent Daily Prize Draws. For example, if an Eligible Entrant submits an entry on day one (1) of the Promotion, their entry will only be entered into the corresponding Daily Prize Draw containing all entries submitted in day one (1) of the Promotion (note the draw itself will be conducted on the following day, being day two (2) of the Promotional Period).
The first Eligible Entrant with an eligible entry drawn in each Daily Prize Draw will receive a Daily Prize as detailed in clause 10.
All prize draws will take place at Prime Focus, 403/62 Beach Street, Port Melbourne, Victoria 3207 (Draw Location).
PRIZES
10.
There are 56 Daily Prizes to be won. Each Daily Prize is a cash prize randomly valued from $250 to $2000 and awarded by way of direct bank deposit to the winner’s nominated Australian bank account (Daily Prize). Daily Prizes add up to a total value of $50,000.
NOTIFICATION OF WINNERS
11. Winners will be notified by telephone and in writing within 2 business days of each Daily Prize Draw and the name and postcode of winners of Daily Prizes valued greater than $250 will be advertised at
www.CashKick.com.au from 23/10/2014.
12. If requested by the Promoter, Eligible Entrants must produce, within the time requested by the Promoter at its absolute discretion:
a) appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize (if drawn) and compliance with these conditions; and
b) their Proof of Purchase that corresponds to all entries they have submitted in the Promotion.
Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion.
13. Daily Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
UNCLAIMED PRIZE DRAW
14. If necessary, an unclaimed prize draw will be held at 12 noon (AEDT) on 13/01/2015 at the Draw Location (Unclaimed Prize Draw), to distribute any unclaimed prize or any prize awarded for an entry that has been deemed invalid pursuant to these conditions (Unclaimed Prize), subject to any directions given by any of the relevant State or Territory gaming authorities. All valid non-winning entries received during the Promotion Period (other than those relating to an entrant who is not entitled to a prize under these conditions) will be eligible to win any Unclaimed Prize. Unclaimed Prizes (if any) will be ordered from highest value to lowest value, Eligible Entries drawn in the Unclaimed Prize Draw will be noted in order drawn and the first entrant drawn will win the highest value Unclaimed Prize, the second entrant the second highest value Unclaimed Prize, and so on, until all Unclaimed Prizes are allocated.
15. Winners of Unclaimed Prizes (if any) will be notified by telephone within 2 business days of the Unclaimed Prize Draw, and in writing, and in the case of winners of Unclaimed Prizes valued greater than $250 (if any), advertised at
www.CashKick.com.au from 09/02/2015.
GENERAL CONDITIONS
16. The value of the total prize pool available to be won in the Promotion is $50,000.
17. There is a limit of two (2) Daily Prizes per person except in South Australia.
18. All entries are deemed to be received by the Promoter at the time of receipt into the Promoter’s database and not at the time of transmission by the entrant. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
19. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Promotion including the prizes and these conditions, subject to approval of the relevant State and Territory gaming authorities.
20. If a prize is won by a person under the age of 18, the prize will be awarded to the winner’s parent or guardian on behalf of the winner.
21. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
22. Prizes are not transferable. The Promoter’s decision is final and binding - no correspondence will be entered into.
23. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
24. The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
25. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
PERSONAL INFORMATION
26. Immediately upon submission by an entrant, their entry/entries become the sole property of the Promoter.
27. Entrants acknowledge and agree that all information entrants provide, including any personal information, may be used by the Promoter for the purpose of administering this Promotion and contacting the winners.
28. Should an entrant's personal information change during the Promotion Period, it is the entrant's responsibility to notify the Promoter by using the ‘Contact Us’ form on
www.CashKick.com.au29. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.
OPTING-IN TO HEAR FROM THE PROMOTER
30. Should an entrant consent to receiving future information from the Promoter, via placing a tick in the ‘opt in’ box featured on the online entry form, information provided by the entrant may be entered into a database and used by the Promoter, the Promoter's related entities and agencies engaged by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to them.
