HOYTS KIOSK – DIVERGENT COMPETITON TERMS AND CONDITIONS
1. Information on how to enter and prize details form part of these Conditions of Entry. Entry into the HOYTS KIOSK DIVERGENT COMPETITION is deemed to be acceptance of these Conditions of Entry.
2. The Competition commences on August 27, 2014. Entries close at 11.59pm September 17, 2014 (Competition Period). All entries must be received during the Competition Period.
3. Entry is only open to residents of Australia who are over 18 years of age and are HOYTS Kiosk Pty Ltd® users. Employees and family members of the Promoter, agencies or companies associated with the Competition, are ineligible to enter.
4. There is one major prize and ten runner-up prizes to be won during the competition period. The prizes contain:
1 x Major Prize:
• Samsung 55” full HD quad core 3D Smart LCD LED TV, 139cm / 55 Inch LED LCD Screen 1920 x 1080 Resolution, 3D Built-In, Voice control (RRP $1696.00)
• Divergent merchandise pack including Drawstring bag, Aluminum bottle, LED key chain, Faux leather wristband, Cap, Stickers & decals, Official Illustrated Movie Companion (RRP $69.95)
• Divergent DVD (RRP $34.95)

5. Prize value is correct at time of print. Prizes are not transferable, not exchangeable and are not valid with any other offer.
6. All prices stated are in Australian dollars. All references to times and dates are to times and dates in Sydney, NSW Australia.
HOW TO ENTER
7. To enter the Competition, an Eligible Entrant must e-mail their transaction number of their valid rental to;
kioskcomps@HOYTS.com.au the answer to this question in 25 words or less: ‘What faction would you choose to belong to and why?’. Transaction numbers can be found in the subject heading of your e-invoice received from HOYTS Kiosk.
8. Eligible Entrants must have provided HOYTS Kiosk Pty Ltd® a valid e-mail address at the time of kiosk transaction in order to be eligible to receive the prize and must have rented Divergent on DVD or Blu-Ray at full price in the one transaction and not in conjunction with any other offer within the competition period.
9. Eligible Entrants can enter multiple times throughout the entire competition period.
HOW WINNERS WILL BE DETERMINED
10. This is a game of skill and chance plays no part in determining the winner.
11. A panel of judges will judge the creativeness of entries in answering the provided question.
12. The judges will determine the most creative entry and that entry will win a Samsung 55” full HD quad core 3D Smart TV and Divergent Merchandise pack. The next 10 most creative entries will each receive a Divergent DVD and voucher for 10 Free Hoyts Kiosk rentals.
13. The judges have absolute discretion in their determinations and their decisions are final. No correspondence will be entered into.
14. The winner will be selected from combined entries and will be notified by 5pm Wednesday September 24, 2014.
15. In the event that any entrant does not claim his or her Prize within 10 days of written notice being given, the judges may reallocate the Prize to the next most creative entry received within the competition period in which the unclaimed prizes pertains to, that has not yet received a Prize.
16. If for any reason the Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prizes and these Conditions of Entry, subject to the approval (if required by law) of any relevant government authority.
17. The Promoter and the agencies and companies associated with the Competition will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of entering the Competition or receiving, accepting or using any prize except for any liability which cannot be excluded by law.
18. The Promoter assumes no responsibility for:
a. Lost, late, stolen, damaged or misdirected e-mail.
b. Any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise
c. Any theft, destruction or unauthorized access to, or alteration of such communications as listed in points a & b above
d. Any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion
e. Any incorrect or incomplete information that may be communicated in the course of the administering this Promotion.
f. The Promoter and the agencies and companies associated with the Competition accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought & is at the cost of the Prize Winner.
19. All entrants must be 18 years or over.
20. All claims and entries become the property of HOYTS Kiosk Pty Ltd. Each entrant agrees to do all things requested by HOYTS Kiosk Pty Ltd. ensure that the intellectual property rights in and to his or her entries become the property of the HOYTS Kiosk Pty Ltd.
21. HOYTS Kiosk Pty Ltd. may use the information an entrant provides for the purpose of conducting the Competition and in any media for further promotional, marketing and publicity purposes unless otherwise advised by the entrant.
22. HOYTS Kiosk Pty Ltd. may disclose entrants’ personal information to its contractors and agents who assist it in conducting the Competition, communicating with entrants and conducting promotional, marketing and publicity activities HOYTS Kiosk Pty Ltd. is bound by the National Privacy Principles in the Privacy Act 1988.
