1. Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Entry is open to residents of Australia. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Whilst entry is open to all residents of Australia, South Australian residents must be 21 years or over to enter. For residents of Australia (except South Australian residents) if the major prize winner is under 18 years of age, the prize will be awarded to their parent/guardian on their behalf.
2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
3. Promotion commences at 0:00 (AEDST) on 28/10/2014 and closes at 11:59pm (AEDST) on 24/12/2014 (“Promotional Period”).
4. To enter, individuals must complete one (1) of the following entry methods during the Promotional Period: a) In Store Entry: Complete the official entry form found in store with all of the required details (including but not limited to their full name, telephone number, postcode and a valid email address), and then place the fully completed entry form in the entry box provided in store; OR b) Online Entry: Log on to shop.australiangeographic.com.au follow the prompts to the Australian Geographic online store, locate the entry form, fill in the entry form including their full name, address, current email address, postcode and daytime telephone number and submit the completed entry form as instructed. (“Eligible Entrant”)
5. The draw made from all eligible entrants will take place at MDSA, Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 on 28/01/2015 at 11.00am (AEDST). The winner will be notified by telephone and in writing within two working days of the draw, using the contact details provided in their entry. Winner’s name will be published in the public notices section of The Australian newspaper on 04/02/2015.
6. The first (1) eligible entry drawn from all eligible entries received will win a trip for two (2) adults and two (2) children to Ningaloo Reef valued at a maximum AU$10,000 depending on date and point of departure. Prize includes: • Four (4) x return economy airfares for 2 adults and 2 children (12 years or under) from the winner’s nearest Australian capital city to Learmonth Airport, WA (flight associated taxes are included); and • Five (5) nights accommodation (2 nights in Coral Bay + 3 nights in Exmouth) for 2 adults and 2 children, including breakfast, in a standard family room in a 4 star property of the Promoter’s choice. • Six (6) day car hire (sedan with premium insurance) to be arranged by a representative of the Promoter. • Two (2) days with researchers of Ningaloo Marine Interactions (lunch included), to snorkel with, the majestic Manta Ray. Includes snorkelling amongst Manta Rays, coral gardens, observing turtles, dolphins, dugongs and more • 2 days taking part in a 'Whale Shark Research Expedition” including swimming with whale sharks on the Ningaloo with “Oceanwise Expeditions”, (lunch included). For the Ningaloo Marine Interactions activity and the Whale Shark Research Expedition children under the age of 15 must be accompanied at all times by a parent or other legally responsible adult. There is no minimum age but whether children can swim with wildlife depends on their ability and the conditions at the time. The operator reserves the right to refuse a child swimming if he / she deems it to be unsafe. Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The prize must be redeemed in full and as a package by 28/07/2015. Redemption of prize is subject to booking and availability at time of booking and black out periods may apply. Prize is a single event holiday and cannot be separated into different holiday vacations. Availability cannot be guaranteed during Christmas, Australian school holiday and special event periods. In the event the winner is from SA, TAS, WA or NT, the prize will also include return economy airfares to the winner’s closest exiting airport to Sydney, Brisbane or Melbourne. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
7. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
8. It is the responsibility of the winner and their travel companions to ensure they have all required travel documentation as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.
9. The four (4) flights must be utilised at the same time, for the same travel dates, to the same destination.
10. The winner may extend their stay on the trip at the winner’s expense.
11. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
12. Frequent flyer points will not form part of the prize.
13. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier’s requirements
14. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
15. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s.
16. As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
17. Entrants acknowledge that elements of the Prize include dangerous activities which may result in injury or death, and participate at their and their and their travel companion/s own risk. Entrants: (a) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the Prize; (b) must not be under the influence of any drugs or alcohol; and (c) must wear all safety and other equipment required. No compensation will be payable if a Winner or their travel companion/s is unable to participate in the Prize or any element of the Prize as stated for whatever reason.
18. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
19. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion. The Promoter will not guarantee encounters with Manta Rays, Whale Sharks or other wildlife. Entrants acknowledge that animal behaviour is unpredictable and weather and other conditions may cause cancellation of trips or an absence of animals on any particular day.
20. If necessary, an unclaimed prize draw will be held on 12/05/2015 at the same time and place as the original draw in order to distribute any unclaimed prize. Any winner from this draw will be notified by telephone and in writing within two working days of the draw and their name will be published in The Australian newspaper on 19/05/2015.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
