Participation
The promoter is Wesfarmers Kleenheat Gas Pty Ltd ABN 40 008 679 543 of Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 (“Kleenheat Gas” or “we”).
Instructions on how to enter and other details contained within promotional, electronic and print materials form part of the terms and conditions. By participating in this competition entrants shall be deemed to agree to abide by these terms and conditions. These terms and conditions prevail to the extent of any inconsistency with the terms and conditions set out in any such materials.
To be eligible to enter (“Eligible Entrant”), you must:
be an Australian resident;
be 18 years of age or over; and
Not be an employee (or an immediate family member of an employee) of Kleenheat Gas, its agencies or any organisation associated with the promotion. For the purposes of the promotion, “immediate family member” includes spouse, de facto spouse, parent, and natural, adopted or step child or sibling, whether or not they live in the same household as the employee.
You do not have to be a current Kleenheat customer to participate in the competition, but if you are not already a Kleenheat customer, you must become an LPG customer of Kleenheat Gas either directly or via dealer or sub contractor in order to redeem a prize.
We may (in our absolute discretion):
verify entrant’s identity, age and the validity of entry;
disqualify entrants who submit an entry that is not in accordance with these terms or who tampers with the entry process;
disqualify entrants who enter using multiple aliases;
accept or reject entries that contain errors or omissions; and
deem incomplete, plagiarised, defamatory or indecipherable entries invalid.
The competition commences at 09:00am (AEST) on 09/11/14 and concludes at Midnight (AEST) on 28/02/2015 (“Entry Period”).
Entering
To enter the competition, an Eligible Entrant must:
Logon to the URL of the promotional website:
www.kleenheat.com.au and complete the online Entry Form at any time within the Entry Period, with your full name, address, contact number and email address.
Specify via a check box whether you are a current LPG customer of Kleenheat either directly or via dealer or sub-contractor
Specify via a drop-down menu or free text field your local cause, charity or community group of choice to nominate the organisation or group to go into the draw to win a cash prize (see item 14).
Entries must be received during the Entry Period to be eligible.
When you have filled in your details you will receive an email from Kleenheat Gas advising your entry is valid. Your entry is not valid until you have received this email.
Entry is limited to one entry per person, per valid email address. Any subsequent entry from a person after the first valid entry is received will be invalid. Multiple entries from a single residential address are allowed. Multiple entries are not allowed.
Upon receipt, entries become the property of Kleenheat Gas.
Prizes
There will be a total of sixteen (16) prizes, which include:
Eight (
individual fortnightly prizes over 16 weeks with each winner drawn from all entries collected on or before each day during the Competition Period. Each winner’s prize consists of:
12 months’ supply of 45kg LPG vapour cylinders; or and
$1000 visa card
Please note:
The Prize also includes a 12 month no rental (no facility fee) deferral for 45kg LPG vapour cylinder/s. An installation/connection fee may apply to LPG customers with dwellings not already on LPG and this cost is not included in the Minor Prize. • Prizes only extend to supply of LPG for ordinary household or domestic use at the Prize winner’s residential address, and excludes commercial or industrial applications or resupply to other persons or premises.
Individual Prize winners must become a Kleenheat LPG customer or be an existing customer to redeem the prize.
Eight (
Cause, Charity or Community Group Prizes with the winners voted on from a shortlist of all entries collected at the conclusion of the Competition Period. Each Cause, Charity or Community Group Prize consists of:
a $5000 donation that must be used exclusively for the benefit of the nominated Cause, Charity or Community Group.
Please note:
Each Cause, Charity or Community Group will be deemed eligible when nominated by a valid entrant via a drop-down menu or free text field as part of the Individual Prize entry. Cause, Charity or Community Group must be a registered not-for-profit group, organisation or charity and excludes commercial enterprises or individuals.
All valid Cause, Charity or Community Group entries will be used to shortlist the top five in each geographical region segmented between WA South West, WA Wheatbelt, WA North West, and Northern Territory. Shortlisting will be at the discretion of Kleenheat Gas based on the largest number of entries nominating each Cause, Charity or Community Groups, and based on a criteria of geographic relevance of the Cause, Charity or Community Groups to the region in which it has been nominated and the proven reach and impact of past support or benefit to the local community and/ or the potential reach and impact of support or benefit to the local community that the prize could facilitate. Kleenheat LPG dealers will vote to award two prizes of $5,000 to two of the five shortlisted Cause, Charity or Community Group entries based on the highest count of votes.
The total maximum prize pool is $46,000 (inclusive of GST), comprising eight (
Prizes with a maximum value of $2,000 (inclusive of GST) in aggregate., and eight (
donations to specified Cause, Charity or Community Group to maximum value of $5000 (inclusive of GST) each.
Prizes must be taken as offered and are not transferable or exchangeable and the gas component cannot be taken as cash. If a prize is not available, we may (in our absolute discretion) substitute the prize for another item of equal or higher value as determined by us (in our absolute discretion).
If, for any reason, the winner is not able to participate in or accept any part of a prize or the winner does not take the prize at the time stipulated by the promoter, the prize will be forfeited.
It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize.

The Individual Prize competition is based on a game of chance. The winners will be randomly selected from the pool of eligible entries which comply with these terms.
Individual Prize winners will be notified via phone or email, and the winner’s details will be published on the website by 2:00PM (AEST) on the date of selection. All reasonable steps to notify the winner will be taken by Kleenheat Gas. In order to redeem the prize, winners must respond with verification of their details by 12:00PM (AEST) 14 days from the day of notification to claim his or her prize (“Notification Period”).
Details of all Individual Prize winners will be published in The Australian within 10 business days from the end of the Entry Period.
Twenty (20) Cause, Charity or Community Groups will be shortlisted at 12:00pm (AEST) on 02/03/15 from all valid entries received between 00:01am (AEST) on 16/02/15 and 11:59pm (AEST) on 28/02/2015. Shortlisted entries that cannot be verified through a person of contact to represent the Cause, Charity or Community Group will be deemed ineligible. After shortlisting, all Kleenheat LPG dealers will have the opportunity to vote to award the top two (2) Cause, Charity or Community Groups in each geographical region over a period of two weeks, with award two prizes of $5,000 to two of the five shortlisted Cause, Charity or Community Group entries at 12:00pm (AEST) on 16/03/15 based on the highest count of votes in each geographical region segmented between WA South West, WA Wheatbelt, WA North West, and Northern Territory. A Kleenheat Gas hosted event will then be scheduled with each Cause, Charity or Community Group winner to present the prize amount.
Details of each Cause, Charity or Community Group winner will be published The Australian within 10 business days from the date of selection.
Cause, Charity or Community Group winners will be notified through a person of contact to represent the Cause, Charity or Community Group via phone or email, and the winner’s details will be published on the website by 2:00PM (AEST) on the date of selection. All reasonable steps to notify the winner will be taken by Kleenheat Gas. In order to redeem the prize, winners must respond with verification of their details by 12:00PM (AEST) 14 days from the day of notification to claim his or her prize (“Notification Period”).
Alternative winner
In the event of a prize winner failing to or being unable to satisfy these terms and conditions (including the requirement that the prize winner become a Kleenheat customer) or forfeiting or not claiming the prize within the Notification Period, an unclaimed prize draw will be conducted at Wesfarmers Kleenheat Gas, Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 at 4pm (AEST) 1 May 2015. In this eventuality the alternative winner will be notified via phone or email within 2 business days of the unclaimed prize draw taking place, and the winner’s details will be published on the website.
In the event of a dispute regarding these terms and conditions, the decision of the General Manager of Kleenheat Gas will be final and binding and no correspondence will be entered into. All entries remain the property of Kleenheat Gas.
Changing the competition
If any act, omission, event or circumstance occurs which is beyond the reasonable control of Kleenheat Gas and which prevents it from complying with these terms and conditions, Kleenheat Gas will not be liable for any failure to perform or delay in performing its obligations and Kleenheat Gas reserves the right (subject to compliance with regulatory requirements) to cancel, terminate or modify or suspend this promotion.
Liability
We (and our officers, employees and agents) are not liable for any loss, expense, damage or liability suffered or incurred by you in connection with the competition, including:
any late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected entries;
any technical difficulties or equipment malfunction;
any theft, unauthorised access or interference by another person;
any entry or prize claim that is late, lost, altered, damaged or misdirected;
any variation in prize value to that stated in these terms;
any tax liability incurred by you;
use of, or taking of, a prize; or
participation in the competition.
Privacy
The Entrants' personal information will be collected by or on behalf of Kleenheat Gas to enable it to administer the Competition and publicise the Prize winner. The personal information of the Prize winners may be provided to others assisting in the conduct of the Competition, including but not limited to the Competition administrator and to regulatory authorities. Kleenheat Gas will disclose the Prize winner's first initial, surname, suburb and State/Territory of residence online, and will publish these details at
www.kleenheat.com.au at the conclusion of the Competition. An Entrant also agrees that the Promoter may, in the event the Entrant is the winner, publish or cause to be published the entrant's name and postcode in any media, as required under the relevant State or Territory lottery legislation.
In participating in the competition, all winners consent to Kleenheat Gas using their (and their companions) name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times and agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use for the purpose of promoting this Competition and Kleenheat Gas.
In participating in this competition, all Entrants consent to receiving marketing materials with the primary purpose of collecting information about the Entrant's gas needs to contact the Entrant at a later date (by any permitted means including telephone, email, mail or SMS) to market its products and services. All personal information is handled in accordance with the Promoter's Privacy Policy which can be found at
www.kleenheat.com.au/privacy and it applies to all personal information collected by Kleenheat. In this policy we explain how and why we collect your personal information, how we use it and what controls you have over our use of it. At any time, should entrants wish to gain access to their personal information, be removed from this database or stop receiving direct marketing material from Kleenheat Gas by unsubscribing on any communications you receive to opt out from all future email communications, or by contacting Kleenheat Gas on 13 21 80. gain access to your personal information in our possession;
correct personal information in our possession; or
make a complaint about Kleenheat Gas’ handling of your personal information, is contained in that Privacy Policy. Should you wish to be removed from Kleenheat Gas’ direct marketing database, or stop receiving direct marketing material from Kleenheat Gas, you can contact Kleenheat Gas on 13 21 80 or (in the case of email or SMS communications) unsubscribe using the method set out in the relevant message.
