Chawaii in Hawaii Competition

HOW TO ENTER
1. To be eligible to enter, individuals must go to the promotional campaign microsite located
at www.chawaiihawaii.com.au and follow the prompts as directed. Entrants must input all
the requested details including uploading of the most creative photo of your new Chawaii
flips and submit the fully completed entry form during the promotional period. The weekly
winners will be judged based on the total number of public ‘Likes’ captured on the
campaign microsite during the promotional period. Each weekly winner will then be
entered into the final round where their submission will be judged purely on literary and
creativity merit by the promoters appointed panel of judges. This promotion is a Game of
Skill and chance plays no part in determining the winner.

2. The judge’s decision is final and no correspondence will be entered into. Information on
how to enter and all prize details form part of these Terms and Conditions. We
recommend that you read these Terms and Conditions in full. Entry in this promotion is
deemed acceptance of these Terms and Conditions.

CONDITIONS OF ENTRY

3. Competition commences at 10.00am AEDST on 01/12/14 and closes 11.59pm AEDST
on 26/01/15. The winners will be published at www.facebook.com/crocsaus and
www.chawaiihawaii.com.au. Winners consent to the publication of their names and
photographs at www.facebook.com/crocsaus and www.chawaiihawaii.com.au.

4. Each prize winner will also be notified via email by the Promoter or an agent of the
Promoter within two (2) working days of the relevant draw (Communication).

5. Entry is strictly limited to one (1) competition entry per person, per Entry Period, during
the Promotional Period, however entrants cannot reuse a photo that has been used in a
previous Entry Period. Entrants are not permitted to represent themselves as multiple
users or represent a fictitious person. The Promoter can disqualify any entrant with more
than one email account who submits more than one entry per Entry Period. The Promoter
reserves the right in its sole discretion to establish and validate the identity of any entrant.

6. Information on how to enter and all prize details form part of these Terms and Conditions.
Entry into this competition is deemed to be an acceptance of these Terms & Conditions
and the Promoter's Privacy Policy.

7. The Promoter reserves the right at any time to disqualify any entrant who tampers with
the entry process, and to disqualify any votes that arise in connection with any tampering.
The use of any automated entry software or any other mechanical or electronic means
that allows an entrant to automatically enter or submit, produce or distribute materials repeatedly is prohibited and will render all entries for that entrant, or any votes submitted by that entrant, invalid.

ELIGIBILITY
8. Entry is open to permanent residents of Australia, aged 13 years or older only. Entrants
under 18 years of age must have parental/guardian consent to enter and further, the
parent/guardian of the entrant must read and consent to these Terms and Conditions.
Parents/guardians may be required by the Promoter to enter into a further agreement as
evidence of consent to the minor entering this promotion. Entrants under the age of 18
must supply their parent/legal guardians email address at the point of registration.

9. Employees of the Promoter and their associated agencies and companies and their
immediate families are ineligible to enter. Immediate family means any of the following:
spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption),
parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother,
sister, step-brother, step-sister or first cousin.

10. Each Eligible Entrant will be entered only into the corresponding weekly judging Entry
Period for which they entered.

COMPETITION ENTRY
11. This competition is a game of skill and chance plays no part in determining the winner.
The photo deemed to be the most creative based on the highest public ‘likes’ on the
promotional campaign microsite each week will be judged the winner and their entry will
go into the Grand prize judging. The Grand prize will be selected on the basis of creativity
& originality by a panel of five judges with the most creative as determined by the judges,
being awarded the Grand prize winner. The judge’s and Promoters decision is final and
no correspondence will be entered into.

12. There are three (3) Grand prizes and eight (Cool Weekly prizes. The three Grand prizes
includes;
a ‘Win a holiday to Hawaii’ valued at $8,000.00 AUD,
a ‘The Hamilton Island prize’ valued at $2,800.00 AUD and
a RedBalloon voucher valued at $500.00 AUD.
Total Grand Prize pool is $11,300.00 AUD.
Each weekly Prize consists of one (1) $250 Red Balloon voucher and a year supply of Crocs (four (4) pairs of Croc shoes) valued at $250.) Total Weekly Prize Pool is $4,000.00AUD. Refer to Clause 17, 18 for prize details
‘entry periods and prize draws’ information. Total Promotional Prize pool is $15,300.00
AUD.

13. All entries must be in original form to the entrant and the entrant must have obtained
consent from all persons appearing in the photograph and including parents / guardians
of entrants under the age of 18 years) including rights of use of property to enter this
competition.

14. The Promoter accepts no responsibility for any late, lost or misdirected entries or for any
problems or technical malfunction of any telephone network or lines, computer online
systems, servers, or providers, computer equipment, software, technical problems or
traffic congestions on the Internet or at any website, or any combination thereof, including
but not limited to, any injury or damage to participants or any other person’s computer
related to or resulting from participation in or downloading any materials in this
competition.

15. Any costs associated with accessing the Crocs Australia Pty Ltd promotional mircrosite
on www.chawaiihawaii.com.au and the Promoters website at www.crocs.com.au is the
entrant’s responsibility and is dependent on the Internet service provider used.

16. All entries are deemed to be received at the time of receipt into the promotional database
and not at the time of transmission by the entrant.

17. The Promoter and the Entrants acknowledge that there are certain guarantees,
warranties, terms and conditions imposed by law relating to the supply of goods and
services which the law expressly provides may not be excluded, restricted or modified or
may only be modified to a certain extent (Statutory Obligations). Except as required
under the Statutory Obligations, or as otherwise permitted by law, the Promoter will not
be liable for (1) any loss or damage whatsoever which is suffered (including but not
limited to indirect or consequential loss) or for personal injury which is suffered or
sustained, as a result of taking a prize or in the misuse of the prize; (2) any incorrect or
inaccurate information, whether caused by Entrants, printing errors or by any of the
equipment or programming associated with or utilised in the competition; (3)
unauthorised human intervention in any part of the entry process or the competition; or
(4) technical or human error which may occur in the administration of the competition or
the processing of entries. If for any reason an entrant’s entry is confirmed to have been
erroneously deleted, lost, or otherwise destroyed or corrupted, the Entrant’s sole remedy
is another entry in the competition. No more than the stated number of prizes will be
awarded. Where the Statutory Obligations apply, liability of the Promoter for a breach of
the Statutory Obligation in respect of the goods or services not ordinarily acquired for
personal, domestic or household use or consumption is limited, at its option, to the repair
or replacement of the goods or re-supply of services.

19. Prize details;
A. First prize, as judged by the panel of judges, is a trip to Hawaii. Prize includes
either a family holiday for two (2) adults and two (2) children or a 5-star holiday
for two (2) adults or (1) adult and (1) child. Both trip options are for six (6) days
and five (5) nights and valued each at $8,000.00 AUD. Hawaiian Airlines will
supply either 2 x or 4 x return flights Economy Airfares, depending on which prize
option is chosen. If the winner chooses the 5-star holiday for (2) adults or (1)
adult and (1) child, the prize may be redeemed for 2 x tickets as a ‘Super
Holiday’ with 5 Star Hotel Accommodation. Neighbour island options can be
discussed with the Promoter. Flights are based on the closest capital city to the
winner. The winners will need to have flights booked and ticketed prior to 30th
June, 2015, with travel to completed by 31st October, 2015. Black out periods
applies and Travel is NOT permitted during the period of 28 Mar 2015 – 19 Apr
2015 and are subject to change, notification will be provided. Tickets will be nontransferrable/non-exchangeable/non-replaceable/non-upgradeable
and cannot be taken as cash. Accommodation to be determined by Promoter. Adding
additional family members (s) is an additional expense to the winner who bears
the sole responsibility for additional costs. If the winner, as declared by the
judges, is under the age of 18 years, the travel companion must be aged 18
years or over.

B. Second prize as judged by the panel of judges is a Trip to Hamilton Island, prize
includes Return Economy flights and accommodation for two (2) people for 4
days and 3 nights valued at $2,800.00 AUD. Flights are based on the closest
capital city to the winner. Accommodation and airline carrier to be determined by
Promoter through consultation with Flight Centre. Holiday must be redeemed
before June 30th 2015. If the winner as declared by the judges is under the age of
18 years, the travel companion must be aged 18 years or over. Black out dates
may apply and travel dates are subject to the Promoter’s decision. The promoter
will advise the winner of all exclusion dates prior to booking.

C. Third prize as judged by the panel of judges is a $500 RedBalloon voucher.

D. Weekly prize details: 1 (one) x $250.00 AUD RedBalloon voucher and one year’s
supply of Crocs valued at $250AUD. The year’s supply of Crocs equates to four (4) pairs of Crocs shoes, one (1) pair of shoes per quarter of 2015 (the style and
model to be decided by Crocs).

20. If the winner is under 18 years of age, the prize will be awarded to their parent or legal
guardian

21. Any arrangements, ancillary costs and expenses incurred, in taking and/or using the
Grand Prizes (including without limitation in relation to the Grand Prizes, airport transfers
and other transport, meals, additional accommodation, visas, spending money, travel
insurance and taxes) are the responsibility of the Prize winner. All entrants acknowledge
that tax and other financial implications may arise from the Prize and agree to seek
advice prior to acceptance of their Prize (if necessary).

22. All cost incurred outside of the flights and accommodation (Including without limitation in
relation to the Grand Prizes, food, minibar, activities) are the responsibility of the prize
winner.

23. Grand Prize winners will be notified via email on 11:59am (AEDST) on February 6, 2015.
Judging will take place between 9:00am (AEDST) on 27th January 2015 – to 4.59pm
(AEDST) on 4th February 2015

24. The Grand Prize and Weekly prize winners name will be posted on the Crocs microsite
www.chawaiihawaii.com.au and associate websites including:
http://www.crocsaustralia.com.au. The winner will also be posted on Crocs social media
site: https://www.facebook.com/crocsaus

25. Each weekly prize winner will be notified via email within two (2) working days after the
entry period closed and judging. Each weekly winner will be published on the competition
microsite www.chawaiihawaii.com.au Once communication has been established with the
winner the Promoter will arrange to have the weekly prize delivered to the winner’s
nominated address within 28 days from the prize draw and will be shipped free of charge
to any Australian address via registered post or a mutually agreed time and date between
by Winner and the Promoter.. The prize will not be sent to a PO Box. The Promoter and
its associated agencies and companies will not be liable for any damage in transit to the
prize.

26. In the event that for any reason whatsoever the Prize winner does not take the prize then
that prize will be forfeited by the prize winner. Once communication has been established
with the winner by the promoter, all prizes must be claimed within 28 calendar days
otherwise the winner forfeits the prize. If the prize is unclaimed or forfeited, the prize will
be awarded to the next eligible winner.

27. Prizes are not transferable or exchangeable and cannot be taken as cash. The
Promoter’s decision is final and no correspondence will be entered into. Prize must be
taken on the designated date and any part of the prize not taken on the designated date
is forfeited. Prize value includes GST where applicable.

28. Prize Winners are advised that tax implications may arise from their prize winnings and
they should seek independent financial advice prior to the acceptance of the prize.

29. The RRP value of the prizes are a guide only. They were correct at the time of printing
and includes GST where applicable. The Promoter accepts no responsibility for any
variation in prize value. Should the items become unavailable or superseded, the
Promoter reserves the right to substitute a prize of a similar replacement type and equal
or greater value, subject to the approval of the gaming authorities, where relevant. The
Promoter encourages responsible drinking. Legal aged consumers should be advised to
consider the safe drinking levels recommended in the National Health and Medical
Research Council Australian Alcohol Guidelines that are; males: up to 6 standard drinks on any one day, no more than 3 days a week and females: up to 4 standard drinks on

30. Entry to any licensed premise is subject to the licensee’s liquor serving policy and license
obligations.

PRIVACY
31. Protecting your personal information - Crocs Australia Pty Ltd (the Promoter) may use
winners’ names and photographs for publicity purposes. By participating in this
competition, the Promoter may collect your name, address, phone number and email
address. The Promoter will use this information to administer your participation in the
competition. Further, the personal information contained on entries may be entered into a
database and the Promoter and its related companies may use this information for
research, promotional and marketing purposes, including via email, which you expressly
consent to. An opportunity to opt-out of receiving additional promotional material from the
Promoter and its related companies can be exercised by using the unsubscribe function
in any email you receive from us. Information contained on the entries will be used
exclusively by the Promoter and its related companies and not provided to any other
party. Please contact the Promoter at the address provided below if you do not wish your
information to be used by the Promoter for future promotional and marketing purposes. A
request to access, correct or update any personal information should also be directed to
the Promoter. By entering this competition, you consent to comply with Crocs Australia

32. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice
in the event they are a winner (incl. photograph, film and/or recording of the same) in any
media for an unlimited period of time without remuneration for the purpose of promoting
this competition (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter.

OTHER
33. The Promoter reserves the right to request winners to provide proof of age, identity and
residency at the nominated prize delivery address. Identification considered suitable for
verification is at the discretion of the Promoter

34. This competition is in no way sponsored, endorsed or administered by, or associated
with, Facebook, Instagram, Myer or RedBalloon. Entrants understand that they are
providing their information to the Promoter and not to Facebook, Instagram, Myer or
