CONDITIONS OF ENTRY
1. Information on prize and how to enter form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
2. The Promoter is Australian Postal Corporation (ABN 28 864 970 579) trading as “Australia Post” at 111 Bourke St, Melbourne VIC 3000, 13 76 78 (the “Promoter”).
3. The promotion commences at 9am AEDST on Thursday 22 January 2015 and entries need to be received by 5pm AEST on Sunday 10 May 2015 (“Promotional Period”). No responsibility accepted for lost, late, illegible or misdirected entries.
4. Entry is only open to residents of Australia aged 18 years or over who fulfil the entry requirements.
5. Employees, directors, management, licensees and contractors of the Promoter, its related companies and agencies associated with the promotion, the immediate families of the above listed persons, and the retailers of and suppliers to the Promoter are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de- facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
6. To enter the promotion, entrants must complete the following steps during the Promotional Period:

Incomplete or indecipherable entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the number of Eligible Products purchased in excess of one (1) in that transaction); and (b) each entry must be submitted separately and in accordance with entry requirements.
9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase as Australia Post, that an Eligible Product was purchased, and that the purchase was made during the Promotional Period but prior to entry.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. The draw will take place on Monday 18 May 2015 at 11am AEST at Anisimoff Legal, Level 5, 492 St Kilda Rd, Melbourne, VIC 3004. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
13. The winner will be notified by email within two (2) business days of the draw, and their name will be published online at

14. The first valid entry randomly drawn will win a 9 day trip for two (2) people to Turkey for a private guided tour of Istanbul and the Gallipoli battlefields and cemeteries, valued at up to AU$20,000 depending on date and point of departure. The prize includes:
return economy class flights for two (2) people from the winner’s nearest Australian capital city to Istanbul, Turkey (valued up to AU$7,000);
AU$3,000 spending money for the winner, awarded via an electronic funds transfer into an account in the winner’s name (i.e. Winner must provide BSB and account number at the time of winner notification for the Promoter to organise award of the prize);
travel insurance for two (2) people, up to the value of AU$500 each; and
a 9 day, 8 night private guided tour of Istanbul and Gallipoli, operated by Battlefield Tours Pty Ltd (valued at AU$8,000). The tour includes the following components for two (2) people: 3 nights twin-share accommodation in a minimum four-star hotel in Istanbul (exact hotel to be determined by the Promoter in its absolute discretion); 5 nights twin-share accommodation in a minimum three-star hotel in Gallipoli (exact hotel to be determined by the Promoter in its absolute discretion); breakfast daily (exact menu to be determined by the Promoter in its absolute discretion); 4 lunches and 7 dinners (exact menu to be determined by the Promoter in its absolute discretion); and all entrance fees and transfers while in Turkey (as part of the guided tour).
CONDITIONS OF ENTRY
15. The prize must be claimed within three months of the draw, and the trip taken within 12 months of the prize being claimed. The winner may select their travel dates subject to reasonable notice, price and availability of flights, accommodation and tour at time of booking.
16. The winner is responsible for all visa and passport arrangements and the Promoter accepts no responsibility for the winner not being able to travel if these are not in order. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
17. The winner and his/her of their companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or companion, the winner forfeits that travel insurance element of the prize. 18. All travel arrangements will be conducted via Garwood & Turner Travel Associates. Any alterations (upgrades, extensions, hotel changes etc.) to the trip itinerary are at the winner’s expense. All additional costs outside the prize inclusions are at the winner’s expense (i.e., additional spending money, additional nights accommodation, meals other than those included as part of the tour, taxes (excluding airline and airport taxes), additional insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs).
19. If the winner behaves in a manner deemed disrespectful, inappropriate or contrary to the law in either Australia or Turkey between being notified as the winner and the conclusion of the trip awarded as the prize, the winner will forfeit their right to the prize and be liable to repay any incurred costs to the Promoter.
20. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
21. The Promoter may conduct a further draw as necessary, if the prize remains unclaimed three months after the draw. If necessary, an unclaimed prize draw will be conducted on Tuesday 8 September at 11am AEST at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email within two (2) business days of the draw, and their name will be published online at auspost.com.au/gallipoli from Wednesday 9 September 2015.
22. The Promoter's decision is final and no correspondence will be entered into.
23. The prize, or any unused portion of the prize, is not transferable or exchangeable and is not redeemable for cash.
24. If for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
25. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in the prize.
28. As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event the winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
29. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, the promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone, network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or referral’s or any other person’s computer related to or resulting from participation in or down-loading any material in this promotion.
30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
33. Entry into the promotion shall be deemed acceptance of these Conditions of Entry and is deemed approval to use the winners’ name(s) and photograph(s) for publicity purposes. The Promoter may at its discretion refuse to award any prize to any entrant who fails to comply with these Conditions of Entry.
34. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).
35. The Promoter collects entrants’ personal information so that they can enter and the Promoter can administer this promotion. Without this information, the Promoter is unable to process an entrant’s entry. The Promoter may disclose entrants’ personal information to third parties in order to administer this promotion, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).
36. Entrants’ personal information will not be used for any secondary purposes, unless the entrant expressly subscribes above to receive emails with information about Australia Post products, services, offers or discounts.
