TERMS & CONDITIONS By entering this competition you are agreeing to the following terms and conditions of entry: The Promoter is Castel Electronics Pty Ltd (ABN 88 074 561 087), 48a Radford Road Reservoir Victoria 3073. Ph: 03 9495 2899. 1. STANDARD TERMS 1.1 Information on how to enter this competition forms part of the terms and conditions of entry. Entry into the competition shall be deemed acceptance of these terms and conditions of entry. 2. WHO CAN ENTER 2.1 The competition is open to residents of Australia who are aged 18 years and over (here in after defined as an “eligible person”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are not eligible to enter. 3. HOW TO ENTER 3.1 The competition commences on 28 November 2014 and concludes on 28 February 2015 (“competition period”). 3.2 To enter the competition, an eligible person must: (a) complete this form and tell us in 25 words or less why you chose to purchase a Midea Air Conditioner? and (b) attach a COPY of the proof of purchase which lists one or more set/s of the eligible Midea Air Conditioner/s* and (c) post both the completed competition form and attached COPY of the proof of purchase (of eligible Midea Air Conditioner/s) to: Castel Electronics Pty Ltd, c/o UTE-OPIA Competition, PO Box 432, Reservoir, VIC 3073 to be received by last mail on 13 March 2015, OR email completed competition form and COPY of the proof of purchase to
mideapromotion@castel.com.au to be received no later than 11:59 AEST 13 March 2015. *ELIGIBLE MIDEA AIR CONDITIONERS REFER ONLY TO ANY NEW PURCHASE OF THE FOLLOWING: Midea Split System Air Conditioner (a set comprises one outdoor unit & one matching indoor unit) Midea Ducted System Air Conditioner or Midea Cassette System Air Conditioner (a set comprises one outdoor unit & one matching indoor unit) Midea Multi Head System Air Conditioner (a set comprises one outdoor unit & two or more matching indoor units) NOTE: Window Box and Portable Air Conditioning units are excluded from this competition. Midea Air Conditioners purchased as factory seconds or purchased from auctions are not eligible for this completion. 3.3 All entrants must enter all details required on this form. This competition is a game of skill and the entry with the most well received answer amongst all valid entries received will be selected by the Promoter as the winner of this competition. 3.4 Eligible participants can submit any number of entries provided each new entry form is completed for each eligible Midea Air Conditioner purchased with the supporting COPY of the proof of purchase attached to each entry submitted. Only one prize will be awarded to the winner. 3.5 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries. 3.6 Incomprehensible and/or incomplete entries will be deemed invalid. 3.7 All entrants are responsible for his or her own costs of entry to the competition. 4. HOW TO WIN 4.1 Each entrant who has entered the competition in full compliance with the terms and conditions of this competition, including having registered all details in accordance with clauses 2 and 3 above will be entered into the competition. The selection of the winning entry will take place at the Promoter’s premises, Castel Electronics Pty Ltd, 48a Radford Road Reservoir Victoria 3073 on 20 March 2015. 4.2 One (1) prize winner will be chosen from amongst all valid entries received for the Prize of a Holden VF SV6 Ute and a Sea-Doo Spark Jet Ski. 4.3 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding any aspects of the competition, including the selection of the winner. 4.4 Any entries not fully in compliance with these terms and conditions will not be considered valid and will not be included in this competition. 4.5 The Promoter reserves the right to request the winner to provide proof of identity, proof of residence at the nominated prize delivery address and/or proof of entry validity in order to claim the Prize. The proof of identity, residence and validity of entry considered acceptable for verification is at the sole discretion of the Promoter. In the event that the selected winner cannot provide suitable proof, the winner will forfeit the Prize in whole. 4.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions, or who has engaged in conduct in entering the competition which is fraudulent, misleading or deceptive. The Promoter reserves the right to disqualify the winner if the Promoter becomes aware that the winner’s entry, is of a type described in this clause 4. 4.7 The prize winner will be notified via telephone and email by 25 March 2015 and his or her details will be published on
www.mideaair.com.au 4.8 In the event of an unclaimed prize after one (1) month of selection of the winner by the Promoter, any reselection of a new winner that may be required will take place at Castel Electronics Pty Ltd, 48a Radford Road Reservoir Victoria on 22 April 2015. The new winner will be notified via email and telephone and his or her details will be published on
www.mideaair.com.au by 24 April 2015. 5. PRIZE VALIDITY AND REDEMPTION 5.1 One (1) prize winner will be selected on the date the competition closes and will receive the following two (2) items as the Prize: a Holden VF SV6 Ute (winner is entitled to select the vehicle colour within the range available/tinted windows included) This includes registration, CTP, stamp duty and dealer delivery charges. The winner will take delivery of the vehicle from the Promoter’s chosen dealership in the (closest) capital city of his or her residence, as stated in their entry details. The all in value of this prize shall be no more than AUD $40,000 AND a Sea-Doo Spark Jet Ski (winner is entitled to select the Jet Ski colour within the range available) This includes trailer, life jackets and registration. The winner will take delivery of the Jet Ski from the Promoter’s chosen dealership in the (closest) capital city of his or her residence, as stated in their entry details. The all in value of this prize shall be no more than AUD $10,000 Vehicle colours shown are for promotional purposes only. The winner will choose from range available when competition concludes. 5.2 Collection of the above items is subject to availability, but is anticipated to be within 8 weeks of the date the winner chooses his or her preferred colour. 5.3 All ancillary costs or accessories not expressly included are the responsibility of the winner. The Prize also excludes comprehensive insurance, operational costs, fuel, personal costs and any other ancillary or incidental costs related to the Prize or anything else not specifically mentioned, which is the responsibility of the winner. All costs associated with travel to and from the dealerships is at the winner’s own cost. 5.4 If the winner is, through any legal incapacity or otherwise, unable to register the Prize in his or her name, then he or she may assign the vehicle or jet ski to another person with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and his or her assignee. 5.5 The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the Prize within 6 months from the date of notification as winner then the Prize will be forfeited by the winner and no cash will be awarded in lieu of the Prize. Any unused portion of the Prize is not-transferrable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. 5.6 The Promoter accepts no responsibility for any variations in the value of the Prize as quoted in these terms and conditions. In the event that the prize components as listed cannot be offered at the time of fulfillment at the fault of the Promoter, a replacement prize will be offered of equivalent value (at the discretion of the Promoter). 5.7 In participating in the competition, the winner agrees to participate and co-operate as required in all editorial activities relating to the promotion of Midea Air Condioners, including but not limited to being interviewed and photographed. The winner grants the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media and the winner will not be entitled to any fee for such use. 5.8 The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clauses 2.1) and has complied fully with these terms and conditions. 6. NO LIABILITY 6.1 If for any reason, this competition is not capable of running as planned, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to modify or suspend the competition subject to any written directions given under the Victorian State Legislation. 6.2 The prize winner is advised that Tax implications may arise from the prize winning and the prize winner should seek independent financial advice prior to the acceptance of the Prize. 6.3 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Prize except for any liability which cannot be excluded by law. 6.4 The Promoter and their associated agencies, and companies associated with this competition will take no responsibility for the Prize damaged or lost in transit. The Promoter will not be responsible for any delay in delivery, or failure of safe delivery of the Prize. 6.5 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved. 7. PRIVACY CONSENT 7.1 To provide you with this competition, the Promoter needs to collect personal information about you. If you do not provide the information requested, the Promoter may not be able to provide you with the entry into the competition. 7.2 Each entrant agrees that subject to the Privacy Act, the Promoter or its agents may do the following: a) transfer personal information confidentially to the Promoter or other organisations that provide services in relation to this competition; b) disclose personal information to State and Territory lottery departments; c) publish the winner’s name as required under applicable law; and/or d) use the prize winner’s personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the prize winner otherwise notifies the Promoter at the time of accepting the Prize. 7.3 Entry details remain the property of the Promoter, and their related entities of collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner). 8.
