Terms and Conditions:1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.The Promoter is Goodman Fielder Consumer Foods Pty Ltd (ABN 35 000 024 546) of T2, 39 Delhi Road, North Ryde, NSW 2113 (“Promoter”).
3.Entry is only open to Australian residents (“Eligible Entrants”). Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
4.Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5.The Promotion commences at 8:00am AEDST on 28/01/2015 and closes at 7:59pm AEDST on 26/02/2015 (“Promotional Period”).
6.To enter the Promotion and be eligible to win, Eligible Entrants must, during the Promotional Period:
(a) purchase any loaf of Wonder White bread or Wonder Wholemeal, any pack of Wonder Wraps or any MeadowLea product from any participating retailer (“Qualifying Purchase”). For the purposes of this promotion, a participating retailer is any retailer displaying material advertising this promotion during the Promotional Period; and
(b) visit
www.wonderwhite.com.au, follow the prompts to the Promotion entry page, input the requested details including product barcode, their full name, valid email address, full Australian street address and telephone number and submit the fully completed entry form,
(“Eligible Entry”).
7.Eligible Entrants must retain their original purchase receipt(s) for all Eligible Entries as proof of purchase. Failure to produce the proof of purchase for all Eligible Entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s Eligible Entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
8.The Promoter reserves the right, at any time, to verify the validity of Eligible Entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
9.Eligible Entries will be deemed to be accepted at the time of receipt by the Promoter.
10.Incomplete, incorrect or indecipherable Eligible Entries will be deemed invalid.
11.Multiple Eligible Entries are permitted, subject to the following: (a) only one (1) Eligible Entry permitted per Qualifying Purchase; and (b) each Eligible Entry must be submitted separately and in accordance with entry requirements set out in clause 6.
12.If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
13.Each day between 8:00am AEDST and 7:59pm AEDST, commencing 30/01/2015 until the end of the Promotional Period, there will be one (1) electronic draw conducted each hour from the Eligible Entries for a total of 336 draws (“Hourly Draws”). Each Hourly Draw will be conducted on the hour immediately following the applicable draw time with the first Hourly Draw occurring at 9:00am AEDST on 30/01/2015 (for Eligible Entries received between 8:00am AEDST on 28/01/2015 and 8:59am AEDST on 30/01/2015) and the last Hourly Draw occurring at 8:00pm AEDST on 26/02/2015 (for the Eligible Entries received up to and between 7:00pm AEDST and 7:59pm AEDST on 26/02/2015). In the case of Eligible Entries submitted outside the hours of 8:00am AEDST and 7:59pm AEDST each day throughout the Promotional Period, those Eligible Entries will be entered into the next available Hourly Draw during the Promotional Period (e.g. Eligible Entries received between 8:00pm AEDST on 30/01/2015 and 7:59am AEDST on 31/01/2015 will be combined with the Eligible Entries received from 8:00am AEDST to 7:59am AEDST on 31/01/2015 and entered into the draw occurring at 9:00am AEDST on 31/01/2015).
14.The Hourly Draws will be conducted by electronic means by a representative of the Promoter. All Hourly Draws will take place at Prime Focus, Suite 403, 62 Beach Street, Port Melbourne, VIC 3207 (“Draw Location”). Non-winning Eligible Entries in each Hourly Draw will be entered into the next subsequent Hourly Draws. In the case that no Eligible Entries are received or a prize is not won in a particular Hourly Draw, the prize for that Hourly Draw will be entered into the next subsequent Hourly Draw. The winner in each Hourly Draw will be notified in writing within two (2) business days of the relevant Hourly Draw.
15.The Promoter’s decision is final and no correspondence will be entered into.
16.The first valid Eligible Entry drawn in each Hourly Draw will each win a prize (“Winner”). The prize is a Samsung Galaxy Tab 3 Lite 7.0 8GB (Wi-Fi) valued at AU$179 each (RRP) inc. GST (“Prize”).
17.The Winners will be responsible for all data charges associated with use of the Prize.
18.If a Winner of any Prize is under the age of 18 years, the Prize will be awarded to the Winner's nominated parent or guardian on the W’s behalf.
19.If any Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
20.Total Prize pool value is $60,144. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
21.If the Promoter is unable to contact a Winner to claim fulfilment of a Prize, despite its reasonable efforts, by 11:59pm AEST on 26/05/2015 a draw for any unclaimed Prizes may take place at 2:00pm AEDST on 27/05/2015 at the Draw Location, subject to any directions from a regulatory authority (“Unclaimed Prize Draw”). Winners, if any, will be notified in writing within two (2) business days of the Unclaimed Prize Draw.
22.If the original winner of one of the Prizes is a resident of Western Australia, the Promoter will hold the unclaimed Prize until 1 year after the date of the applicable Hourly Draw and, in the event it has not been claimed by that date, the Promoter will seek directions from the Western Australia Department of Racing, Gaming and Liquor.
23.Each Winner will be contacted by a representative of the Promoter on the day of the applicable Hourly Draw by telephone on the number specified on the entry form. Winners will be required to submit their original proof of purchase to the Promoter. Once validated by the Promoter, the Promoter will send the Winner an email to confirm that they are eligible to receive a Prize (“Confirmation Email”). Prizes will be delivered by registered post within twenty-eight (28) days of the applicable Hourly Draw date to each applicable Winner at the Australian address specified on the entry form as part of the Eligible Entry.
24.Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26.Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all Eligible Entries submitted by that Eligible Entrant invalid.
27.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Eligible Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or Eligible Entrant; or (f) use a Prize.
29.The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities.
