TERMS AND CONDITIONS:Definitions within these Terms & Conditions of Entry and this Promotion:
Cardmeans a TLC Rewards™ Card issued by the Promoter as part of the TLC Rewards™ Program.
Cardholdermeans a person who holds a TLC Rewards™ Card, and who is Registered according to the TLC Rewards™ Program database.
Eligible Purchasemeans a purchase by a Cardholder at a Participating Store of an amount which is the Qualifying Amount or greater. “Smoking / Tobacco” product purchases are excluded from entry by law.
Participating Storemeans a participating The Lucky Charm store referred to as TLC Newsagency, Newsagent or Express store.
Prize Winnermeans the winner of the Promotion and the Prize as determined in accordance with clause 9.
Prizemeans a Holiday prize for two adults to Las Vegas up to the retail value of $10,000 (AUD).
Promotionmeans the TLC Rewards™ Major Prize Draw promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the TLC Rewards™ Program.

Promotional Periodmeans 00:01 1 December 2014 WST to 23:59 30 March 2015 WST
Qualifying Amountmeans the total purchase amount is AUD 1.00 or greater.
Registeredmeans that all mandatory Cardholder information has been correctly completed in the legal name of the Cardholder, according to the TLC Rewards™ database and which is deemed final and conclusive.
Information on how to enter the Promotion and a description of the Prize forms part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves the right to disqualify any Cardholder from the Promotion if any entry does not comply with these Terms & Conditions of Entry or as otherwise set out in these Terms & Conditions of Entry.
The Promotion is open to Cardholders and available at all Participating Stores. Provided the Cardholder makes an Eligible Purchase, entry into the Promotion is otherwise free. Directors, management and employees of the Promoter and its franchisee stores and its agencies directly associated with this Promotion are ineligible to enter.
These Terms & Conditions of Entry will be displayed at tlcrewards.com.au at the commencement of the Promotion.
Entries for this Promotion close 23:59 30 March 2015 WST.
To enter the Promotion, a Cardholder must swipe his or her Card at the register of a Participating Store immediately before making an Eligible Purchase.
One entry will be recorded for each swipe and Eligible Purchase immediately after the Eligible Purchase. The Promoter’s records are final and conclusive.
There is no limit to the number of entries a Cardholder is allowed.
The Prize Winner will be determined by an automated random draw of all valid entries. The draw will take place at 8.00am WST 30 March 2015 at The Lucky Charm Pty Ltd, Unit 3, 691 Marshall Road, Malaga, WA, 6090. The first valid entry randomly drawn from all entries collected during the Promotional Period will be the Prize Winner.
Within 2 days of the draw, the Prize Winner will be contacted by email and telephone and will have his or her first name initial, surname and state published on the TLC Rewards™ website.
The Promoter may conduct such further draws as are necessary if the Prize is unclaimed.
The maximum total prize value will not exceed $10,000 (including GST). The prize means 2 adult economy flights to Las Vegas from any Australian Capital city, 5 nights’ accommodation at a 4 star hotel and airport transfers from Las Vegas airport return. Holliday prize does not include airport departure fees and government taxes unless otherwise stated.
Unless otherwise stated, insurance is not provided as part of any holiday prize but is highly recommended. It will be each prize winner’s and (if applicable) their travelling companion’s responsibility to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property) which may be required or prudent to be taken. All insurance, spending money and other expenses, unless otherwise stated, are costs for the prize winner and are not provided as part of any holiday prize. Unless stated otherwise, holiday prizes consist of flights and accommodation only.
The prize winner and any travelling companions must have and maintain valid passports endorsed with all relevant visas and with expiry dates no less than six (6) months following the proposed dates of travel or such other duration as may be required by any relevant regulation. These passports, and their holders, must not be subject to any restrictions on their rights to travel to and from the applicable country or countries. Passport control and in-country authorities may reserve the right to refuse entry to prize winners and/or their travelling companions. We shall not be responsible for ensuring your ability to travel to your holiday destination nor for any additional costs incurred should you be refused entry.
Unless otherwise stated, all holiday prizes must be taken within six (6) months of the closing date of the relevant Competition or the prize will lapse. Holiday prizes are also usually subject to terms and conditions required by the provider, which will apply to the prize winner.
The prize winner and their travelling companions (if applicable) must comply with and are responsible for obtaining any inoculation and health regulations required by any holiday prize destination country.
The Prize is not transferable, exchangeable or redeemable for cash. The Prize value is in Australian dollars and is the recommended retail value as provided by the Prize Supplier and are correct at time of printing. The Promoter and/or the Prize Sponsor accept no responsibility for any variation in the value of the prize. To the extent permitted by law, the Promoter and/or the Prize Sponsor makes no representations or warranties as to the quality, suitability, or merchantability of the prize.
We will not be liable or responsible for any loss or damage suffered by any prize winner or their travelling companion (if applicable) should any prize winner or their travelling companion (if applicable) not redeem a holiday prize as a result of any Government travel warning or advisory applicable to the destination country and/or countries or for any other failure on their part to travel. In particular, we shall have no obligation to substitute any alternative prize, cash equivalent or other compensation where a prize winner and/or their travelling companion (if applicable) fail to redeem a holiday prize for any reason.
Prize winners and their travelling companions must comply with the terms and limitations of airlines, other transport providers, and the venues involved in the provision of any holiday prize, including any insurance policy relating to the holiday. In particular, entrants must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements.
The departure date of the prize holiday must be on or prior to 30 March 2015.
The Promoter and/or the Prize Supplier accepts no responsibility for any tax implications that may arise from winning the Prize. Independent financial advice should be sought..
The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of the Terms & Conditions of Entry or the Terms & Conditions of the TLC Rewards™ Program or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.
The Promoter and its agencies and companies associated with this Promotion and/or the Prize Supplier will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to the Promotion or the awarding or taking of the prize except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the Prize and these Terms & Conditions of Entry (subject to any applicable law).
If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms & Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
The Promoter may use any personal information that a Cardholder has provided to it as part of the TLC Rewards™ Program for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements, the Promoter will only publish the Prize Winner’s surname, initial and state. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Unless the Cardholder has opted-out of communication, the Promoter may use personal information a Cardholder has provided to send the Cardholder information about The Lucky Charm’s products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) the Promoter engages for that purpose.
