WEST END MAZDA – TERMS AND CONDITIONS

1. Promotion. These terms and conditions relate to the 2GB “WEST END MAZDA” promotion (“Promotion”). Information on how to enter and the Prizes forms part of these terms and conditions.

2. Promoter.  The Promoter is Harbour Radio Pty Ltd of Level 1, Building C, 33-35 Saunders Street, Pyrmont, NSW, 2009 (the “Promoter”).

3. Subject to Terms and Conditions.  Any entry that does not comply with these terms and conditions is invalid. By entering into or otherwise participating in the Promotion, you say that you agree to these terms and conditions.  Subject to the approval required by any relevant gaming or lotteries authority, the Promoter may at any time and in its absolute discretion alter, amend, add to, waive or enforce these terms and conditions with present, future or antecedent effect as it sees fit.

4. Eligibility. Entry is open to residents of New South Wales only. Employees of the Promoter or its associated companies, employees of any agencies associated with this Promotion and the immediate families of any such employees are not eligible to enter.  Entrants must be over 18 and hold a current and valid NSW Drivers License.

5. Promotional Period. The Promotion commences on Monday February 2 2015 at 00:01 AEDT and concludes on Friday February 13, 2015, at 6:00pm AEST (“Promotional Period”).  Subject to the approval required by any relevant gaming or lotteries authority, and notwithstanding any other condition of these specific competition rules, the Promoter reserves the right to withdraw the Promotion at any time and for any reason whatsoever.

6. Entry.  From Monday February 2 until Friday February 13, listeners can fill in the entry form provided at West End Mazda, Blacktown and put it in the barrel. Entries close at 3:00pm sharp on Friday February 13, 2015.

One name will be chosen at random from the female barrel, live on air in Ben Fordham’s program between 5pm – 6pm on Friday 13th February 2015, as he broadcasts live from West End Mazda, Blacktown. If the female name drawn out of the barrel is not present at West End Mazda, Blacktown, there will be a 4 minute waiting period before a redraw of another name from the barrel of an entrant who is present. That person then has up to 60 seconds to choose either car 1 or car 2.

Once the first female winner has made their choice of car 1 or car 2, a name from the male barrel will be chosen at random from the barrel. If the name drawn out of the barrel is not present at West End Mazda, Blacktown, there will be a 4 minute waiting period before a redraw of another male name from the barrel of an entrant who is present.  That person will win the remaining prize.

7. Restrictions on Entry.  Only one entry is permitted per person, and only one Prize can be won per household.  Use of a false name (ie. the name by which the entrant is not usually known) or address is not permitted.  Entrants using false information will be disqualified.  The Promoter may disqualify any entrant who tampers with the entry process.  Members of the same household or family may enter, but no household or family can win a prize more than once in a 3 week period in a promotion held by the Promoter.

8. Promoter may Disqualify Entrants.  The Promoter may verify the validity of entries, including but not limited to whether an entry is in accordance with these terms and conditions, and may disqualify any entrant in its absolute discretion.

9. Receipt of Entries.  Entries are deemed to have been received at the time of receipt by the Promoter. The Promoter is not responsible for failure to receive any entry for any cause beyond its control. The Promoter will not be held responsible for any inability or difficulty in entering the Promotion caused by the unavailability of, or other fault on, the Website.

10. Prizes.  The total retail prize is valued at $35,980 and consists of a two Mazda2 cars - a Mazda2 Neo Manual hatch red and includes registration and on road costs.  The stock number is 51928 and the retail value is $16,990. The second car is Mazda2 Neo Auto hatch smoky rose and includes registration and on road costs. The stock number is 52200 and the retail value is $18,990.

The prize is not transferable and cannot be exchanged for or any other prize. Prize values are correct at the time of printing but no responsibility is accepted for any variation in the value of any Prizes.  If a Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other liability or responsibility for any loss incurred by the winners or any other party if a Prize is unavailable for any reason.

11. Judging.  Two winners will be randomly selected for the major prize from the two barrels between 5:00pm and 6:00pm on Friday February 13, 2015. The two winners will be drawn separately in the selected time frame.  The draw will take place on Friday February 13, 2015 at West End Mazda, Blacktown. All decisions made by the Promoter are final and no correspondence will be entered into.

12. Announcement of Winners.  The major prize winner will be announced on Sydney Live with Ben Fordham program on 2GB 873 between 5:00pm and 6:00pm on Friday February 13, 2015, at West End Mazda, Blacktown.  The winner’s name may also appear on the Website.  The Promoter reserves the right to request winners to provide proof of identity and proof of employment at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter or its agent.  Should the Promoter not be able to contact the winner within 5 business days, it may, in its absolute discretion, decide to award the Prize to the next best entrant.

13. Restriction on Liability.  The Promoter is not liable for any loss or damage, including indirect or consequential loss or damage, or personal injury suffered or sustained in connection with the Prize (including during the course of accepting or using the Prize), except for any liability that cannot be excluded by law.  All entrants release the Promoter and its related bodies corporate from, and indemnify the Promoter and its related bodies corporate against, all liability, cost, loss or expense arising out of accepting the Prize or participation in the Promotion, including but not limited to loss of income and personal injury.

14. Warranties.  The winner should look to the manufacturer of the Prize for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth)) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

15.  Publicity.  Entrants agree to the use of their image and name for publicity regarding the Promotion and acknowledge that it is a condition of taking the Prize that all winners agree to publicity regarding the Promotion, including the use of their names and images without additional compensation. The Promoter may require, in its absolute discretion, any Prize winner not to, without the prior written consent of the Promoter (which may be withheld in its absolute discretion), participate in any other media activities or promotions, the purpose of which, or which involve, discussing, commenting on, or expressing a view in relation to the Promotion.

16. Rights to Entries.  All entries become the property of the Promoter. Entrants acknowledge and agree that the Promoter has the right to all materials generated in connection with the Promotion and can use the material in any medium and in any manner it sees fit. By entering the Promotion, entrants assign to the Promoter all copyright to any content forming part of their entry.

17. Privacy.  Subject to clause 16 above and these terms and conditions, all personal information will be collected, held, used and disclosed in accordance with the Promoter’s privacy policy, which can be viewed at www.2gb.com/privacy-policy.

18. Confidential Information.  Prize winners agree to keep confidential any knowledge of the Promoter and its business and personnel received by them as a result of the Promotion.  In any promotional activities associated with the Promotion or the Prize, the winner must refrain from expressing in public a negative or disparaging view of the Promoter or its operations and related bodies corporate.
