Promotion
1. Information on how to enter this Campaign forms part of these Terms and Conditions.
2. Completion of the Entry Procedure and participation in this Campaign is deemed acceptance of these Terms
and Conditions.
3. This Campaign is being co-ordinated by Channel T on behalf of the Promoter. Any reference to Channel T
includes and is intended to be a reference to the Promoter also.
4. Any questions or comments regarding the Campaign should be directed to the Campaign Email.
Definitions
5. In these Terms and Conditions and the Campaign, the following terms have the meaning set out opposite
them:

Eligibility Criteria persons that are residents of Australia aged 18 years of age or older.
Entrant a person that meets the Eligibility Criteria and completes an Entry into the Campaign
in accordance with these Terms and Conditions
Entry is the result of completing the Entry Procedure in accordance with these Terms and
Conditions and includes all content (which includes without limitation any text,
images or , photos) that is submitted, uploaded, published, created, communicated
or used as part of the Entry Procedure
Entry Procedure Entrants must:
(a) access the landing page at ketchupbiteclub.com.au and answer the
questionnaire;
(b) submit in 25 words or less why you love Ketchup way more than tomato
sauce and include your email address;
AND/OR
(c) Snap a photo of you and your friends enjoying more bite with Heinz
Ketchup. Then share it on Instagram, Twitter or Facebook tagging
#KetchupHasMoreBite. This must be done with your friend’s permission.
(d) Accept these Terms and Conditions and the Heinz & Channel T Privacy
Policies.
Judging Criteria Judges will take into account the quality, originality and creativity of the Entry as well
as the relevance of the Entry to the Campaign in determining the winner(s) of the
Prize
Maximum Number
of Entries Unlimited (note – once an Entrant has been awarded a Prize they may continue to
submit Entries, but will be ineligible for any further Prize)

Winner means a Prize winner selected pursuant to these Terms and Conditions
6. In addition, unless otherwise stated, in these Terms and Conditions and the Campaign:
a) All monetary values are in Australian Dollars;
b) All values and amounts that appear in these Terms and Conditions are inclusive of GST;
c) Any reference to time is a reference to AEST; and
d) Headings are for reference purposes only.
Eligibility
7. Participation in this Campaign is only open to those persons who meet the Eligibility Criteria.
8. Employees (and their immediate families) of the Promoter and Channel T are ineligible to enter. Immediate
families includes: spouse, child (natural or adopted), parent, grandparent, siblings, uncle, aunt, niece, nephew
or cousin (by blood, marriage or relationship).
9. Channel T reserves the right, at any time, to verify the eligibility of an Entrant and to disqualify any Entrant that
does not meet the Eligibility Criteria.
10. Any costs associated with meeting the Eligibility Criteria must be met by that person and not Channel T or the
Promoter.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to
determine the identity of the entrant.
Entry
12. This Campaign is a game of skill and chance plays no part in determining the Winner.
13. To enter, eligible persons must complete the Entry Procedure during the Campaign Period.
14. Entries not completed in accordance with these Terms and Conditions will be rejected and any late,
incomplete, indecipherable or illegible Entries will be deemed invalid. Entries will be deemed accepted at the
time of receipt by Channel T and not at the time of transmission.
15. Entrants are limited to the Maximum Number of Entries. Multiple Entries (where permitted) must be submitted
separately.
16. Each Entry must be relevant to the Campaign as determined by Channel T in their absolute discretion.
Channel T reserves the right to review the Entries during the Campaign Period and remove and reject any
which are offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Campaign.
17. Channel T reserves the right, at any time, to verify compliance with the Entry Procedure, and to disqualify any
Entrant that tampers, interferes or manipulates the Entry Procedure. The use of any automated entry software
or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that entrant invalid.
18. Errors and omissions may be accepted at Channel T's discretion however failure by Channel T to enforce any
of their rights at any stage does not constitute a waiver of those rights.
19. Any costs associated with applying, entering or participating in the Campaign (including internet access and
download charges) will be at the cost of the Entrant.20. If an Entrant would like to remove their Entry from consideration for a Prize, they must request removal via
email to the Campaign Email which request will be attended to within 14 days of a request being made. Once
removed, that Entry will no longer be eligible for a Prize
Consents and warranties on entry
21. Entrants agree to their Entry being used by the Promoter and Channel T in the future and grant them a nonexclusive,
royalty-free, perpetual, worldwide, irrevocable and sub-licensable transferable licence to use,
reproduce, modify, adapt, publish and display the Entry for any purpose in any media without compensation,
restriction on use, attribution or liability. Entrants warrant that they have full authority to grant these rights and
will not assert any moral rights in respect of the Entry.
22. Entrants warrant and agree that:
a) They will not submit, produce, upload or share any content that is fraudulent, or may be in breach of
any intellectual property, privacy or other rights;
b) No rights in the Entry have been previously granted to any person, corporation or entity;
c) They will obtain full prior consent from any person who has jointly created or has any rights in the
Entry or who appears (or who's property appears) in the content forming part of the Entry;
d) They will comply with all applicable laws and regulations including without limitation those governing
copyright, content, defamation, privacy, publicity and the access of use of others' computer or
communication systems.
23. Without limiting the above, the Entrant indemnifies the Promoter and Channel T against all loss, damages and
costs incurred by the Promoter and or Channel T as a result of any breach of the above warranties.
24. Entrants understand, acknowledge and agree that their Entry (or parts thereof) and their first name, social
media user name or handle may be posted on the Promoter's and Channel T's website or other social media
sites (including without limitation the social media network Facebook – www.facebook.com.au) and available
for public viewing.
25. Unless expressly permitted by these Terms and Conditions, participation in this Campaign does not entitle
any person or Entrant to use any of the Promoter's or Channel T's intellectual property rights (including any
trade mark or content) for any purpose.
Judging Minor Prizes
26. At the end of every Period, Channel T and the Promoter will judge all valid Entries received during the
preceding two weeks taking into account the Judging Criteria to nominate a minor prize winner.
27. For Period 1 [12:00AM on 26 January 2015 - 11:59PM on 8 February 2015] judging will take place at 12:00pm
AEDT on Monday 9th February 2015 at Suite 1A, 90 York Street, South Melbourne, VIC, 3205, Australia.
28. The winner for Period 1 will be announced on Heinz Australia’s Facebook Page at
https://www.facebook.com/HeinzAustralia on Wednesday 11th February 2015.
29. For Period 2 [12:00AM on 9 February 2015 - 11:59PM on 22 February 2015] judging will take place at
12:00pm AEDT on Monday 23rd February 2015 at Suite 1A, 90 York Street, South Melbourne, VIC, 3205,
Australia.
30. The winner for Period 2 will be announced on Heinz Australia’s Facebook Page at.

31. For Period 3 [12:00AM on 23 February 2015 - 11:59PM on 8 March 2015] judging will take place at 12:00pm

34. The winner for Period 4 will be announced on Heinz Australia’s Facebook Page at.

35. For Period 5 [12:00AM on 23 March 2015 and 11:59PM on 05 April 2015] judging will take place at 12:00pm

36. The winner for Period 5 will be announced on Heinz Australia’s Facebook Page at.

37. All decisions of Channel T and the Promoter are final and no correspondence will be entered into.
Judging Major Prize
38. At the end of the Campaign Period, Channel T and the Promoter will judge all valid Entries received during the
duration of the competition [26th January 2015 – 5th April 2015], taking into account the Judging Criteria to
nominate the major prize winner.
39. The Major Prize Winner will be announced on Heinz Australia’s Facebook Page at.

40. All decisions of Channel T and the Promoter are final and no correspondence will be entered into.Prizes
41. The first best Entry (that is Entry selected at the end of the competition, with the best chances to fit the judging
criterions) will win one (1) Major Prize and be a Major Winner.
The five (5) best Entries (that is Entries selected during the fortnightly Periods, with the best chances to fit the
judging criterions) will each win one (1) Minor Prize and be a Minor Winner.
42. The Major Winner wins a Major Prize, as described in the Major Prize definition.
The Minor Winners win a Minor Prize, as described in the Minor Prize definition.
43. Winners will be notified by email or direct message (Facebook, Twitter or Instagram) within 48 hours of a
determination being made, and must provide the Promoter with the following details within 7 calendar days of
being notified:
• Full name
• Full address
• Full email address (if not already provided)
44. The total Prize Pool Value for this Campaign is specified in clause 5.
45. Channel T will use its reasonable endeavours to deliver the Major Prize and Minor Prize via Australia Post to
the Winner’s nominated mailing address within 28 days of being selected pursuant to the above clauses. The
Promoter takes no responsibility for any prizes being damaged in transit, or for any delay in the delivery of any
prizes or for the prizes becoming lost or stolen after they have been delivered to, collected by, and/or released
to the winners.
46. If Channel T is unable to contact a Winner, or the Winner does not claim their Prize within three (3) months of
being notified they are a Winner, then that Winner will forfeit their Prize and no cash or other prize will be
awarded in lieu. The Promoter may, at its absolute discretion, award a forfeited Prize to the next-best Entry as
determined by the expert panel appointed by the Promoter. The winner of any forfeited Prize will be notified by
email or direct message (Facebook, Twitter, Instagram) within 48 hours of a determination being made.
47. It is an Entrant’s responsibility to notify Channel T if their personal details change during the Campaign Period.
If a Winner fails to provide a valid or complete address for delivery of the Prize, or delivery has not been
successful to an address provided (after reasonable attempts by Channel T) the Prize shall be forfeited by the
Winner.
48. Prizes, or any unused portion of a prize, are not transferrable or exchangeable and cannot be taken as cash.
If any Prize is unavailable, the Promoter may at its discretion substitute the Prize with a prize of equal value.
49. If a Prize includes a voucher, the voucher is only valid until the expiry date specified on the voucher or by the
provider, and is subject to the terms and conditions imposed by the provider. The Promoter and Channel T will
not be liable for any voucher that is lost, stolen, damaged or tampered with after it is awarded.
50. As a condition of accepting a Prize, a Winner may be requested to sign legal documentation as and in the
form required by the Promoter or Channel T including a release and indemnity form.
Limitation of Liability
51. To the extent permitted by law, the Promoter and Channel T (and their respective officers, contractors,
employees, agents and representatives) will not be liable for any personal injury, loss (including loss of
opportunity), damage (including, but not limited to, direct, indirect or consequential loss), cost, expense or
claim arising from or in relation to:
a) the Campaign;
b) any Entry or the Entry Procedure;
c) any variation in the value of a Prize;
d) any theft, unauthorised access or third party interference;
e) any tax liability incurred as a result of being awarded a Prize;
f) any Prize that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable
control of the Promoter; or
g) the taking and/or use of the Prize.
Variation to Campaign
52. Channel T may in its absolute discretion, but subject to State and Territory laws, modify, suspend, cancel,
recommence or extend this Campaign as appropriate if:
a) for any reason, this Campaign is not capable of running as planned due to any reason beyond the
reasonable control of the Promoter, including but not limited to technical, hardware or software
failures or interferences, or changes to third party sites or platforms, which affect the administration,
operation, security, fairness, integrity or proper conduct of the Campaign;
b) the level of interest or participation in the Campaign is insufficient or there has been some delay in
commencing the Campaign; or
c) the Entry Procedure, determination of Winners or delivery of Prizes is prevented hindered or affected
by any external agent or event beyond the reasonable control of Channel T.Personal Information
53. All Entries become the property of the Promoter.
54. The information that each Entrant provides will only be used in connection with, or relating to, the
administration of this Campaign and support of the Promoter’s social network pages (including without
limitation, any marketing communications you opt-in to receive from the Promoter) and in accordance with
these Terms and Conditions. Entry is conditional on providing this information.
55. Personal information that may be collected in association with this Campaign is dealt with in accordance with
the Promoter’s Privacy Policy http://www.heinz.com.au/Privacy and Channel T’s Privacy Policy
http://www.vibevillage.com.au/other/Privacypolicy.aspx. Each Privacy Policy also contains information about
how entrants may opt out, access, update or correct their personal information, how entrants may complain
about a breach of the Australian Privacy Principles and how those complaints will be dealt with. The Promoter
and Channel T will not disclose an entrant’s personal information to any entity outside of Australia.
General
56. If any term or condition of these Terms and Conditions or the application thereof to any person or any
circumstance shall be or become illegal, invalid or unenforceable, the same shall be read down, if such
reading down is possible, and if found to be impossible, shall be severed and the remaining terms,
agreements and conditions shall not be affected.
57. These Terms and Conditions are to be interpreted in accordance with the laws of the State of Victoria and all
parties submit to the non-exclusive jurisdiction of the Courts of that State.
58. This promotion is in no way sponsored, endorsed, or administered by or associated with Facebook and/or
Twitter and/or Instagram (each, a Social Media Provider). Each entrant acknowledges that the information that
they are providing is provided to the Promoter and not to any Social Media Provider. The information that any
entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions,
comments or complaints about this promotion must be directed to the Promoter and not any Social Media
Provider. No Social Media Provider will be liable for any loss or damage or personal injury which is suffered or
sustained by an entrant as a result of participating in the promotion (including the taking or use of any prizes),
with the exception of any liability which cannot be excluded by law.
