Wave the Flag Competition
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
o The Promoter is Network Ten Pty Limited (ACN 052 515 250); and
o The Prize Supplier is Australian Grand Prix Corporation Level 5, 616 St Kilda Road, Melbourne VIC 3004 (ACN 86 947 927 465).
2. Entry is open to Australian residents only who are 18 years of age or over. Employees (and their immediate families) of the Promoter and the Prize Supplier and agencies associated with this promotion are ineligible to enter the promotion.
3. Promotion commences at 14:00 (AEST) on Monday 23/02/2015 and closes at 23:59 pm (AEDT) on Sunday 08/03/2015 (the promotion period).
4. Entrants are required to complete the online entry form on tenplay.com.au with the requested details. Entrants may be required to answer a question in order to be eligible to enter the competition.
5. The competition will be advertised on but not limited to Channel Ten, the program The Project and tenplay.com.au. Online entry is open to Network Ten (tenplay.com.au) website members (existing and new during the promotion period). It is free to become a member however fraudulent memberships/entries will not be accepted and will be deemed invalid. These competition Conditions of Entry apply in conjunction with the Network Ten Online Members rules.
6. The winner will be judged, on Monday 09 March, 2015 commencing 10:00 AEDT at the premises of the Promoter. The most creative answer as determined by the Promoter will be deemed the 'major winner'. Judges/Promoters decision is final and no correspondence will be entered into. If the first selected winner fails to accept the prize within 5 working days the prize will be awarded to the next best entry as determined by the Promoter, until a valid winner is found.
7. Prizes cannot be transferred, exchanged or redeemed for cash. The winner will be notified by phone within 2 days of the judging and in writing.
8. To submit a complete and valid online entry, entrants will be required to provide various personal details including full name, email address, residential address, contact phone number/s, date of birth and gender for the purpose of verifying eligibility. Any contact details entered incorrectly shall invalidate the entry. Online entry is free however internet connection rates apply.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, and PO Box addresses. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
10. Entries must be received by 11:59 pm (AEST) on Sunday 08 March 2015. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
11. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
12. Prize Details:
o Wave the chequered flag to finish the 2015 Formula 1® Rolex Australian Grand Prix (winner only) on 15 March, 2015 valued at $2,000
o Garage tour for two (2) people in the World Champion Mercedes AMG Petronas garage, valued at $1,000
o Two (2) x Pit wall canopy experience during a Formula 1 session, valued at $2,000
o Two (2) x four day Fangio Grandstand seats, valued at $870
o Two (2) return economy airfares to Melbourne from the winner’s nearest capital city for the prize-winner and companion, value at $1,500
o Four (4) nights’ accommodation in a four star hotel for the prize-winner and companion, valued at $1,000 (Thursday 12, Friday 13, Saturday 14, Sunday 15 March, 2015)
o Airport/hotel transfers, valued at $200
Total Prize value: $8,570 (+gst)

13. The Promoter, the Prize Supplier, and their associated agencies reserve the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Prize Supplier determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Prize Supplier or its associated agencies in its absolute discretion.
14. The winner will be required to have a blood alcohol reading of zero to be able to participate in assisting with the official start. The winner will be required to sign a waiver and release prior to taking part in the Wave the Chequered Flag activity (such release is available for viewing by any entrant during the promotional period or prior to entering the competition by calling the Prize Supplier on (03) 9258 7100. If required, the winner agrees to participate in a test to determine whether alcohol is present and understands that they will not participate in the flag waving activity if the alcohol reading is above zero.
15. In the event that the race officials deem that the conditions are not appropriate for the Entrant to assist in the official Wave the Chequered Flag, race officials may exercise their right to refuse the winner the opportunity to participate in the Event official finish and the official finish activity will revert
back solely to the race officials. The winner agrees that the official finish activity is not guaranteed and is subject to race officials’ final approval.
16. The prize must be taken in accordance with these Conditions of Entry.
17. The winner is responsible for making their own way to the Event at the time stipulated by the Prize Supplier or its associated agencies. In the event that the winner does not arrive at the time determined by the Prize Supplier the prize will be forfeited and no compensation will be provided (subject to State Regulations).
18. The winner must comply with the Conditions of Sale and Conditions of Entry to the Event (copies of which are displayed at entrances to the Event or available at www.grandprix.com.au). The winner acknowledges and agrees that those elements of the prize relating to the Event will be subject to any additional conditions or directions imposed by the Prize Supplier, the Event promoter, rights holder and race officials, including regarding participation in elements of the prize, attendance times and attending briefings for participation in elements of the prize and the signing of the release and waiver of liability form referred to above, in such form as may be required by the Prize Supplier in its absolute discretion.
19. The prizes must be taken as offered and cannot be varied. The prize is not transferable, exchangeable or redeemable for cash. The prize must be taken (Thursday 12, Friday 13, Saturday 14 and Sunday 15 March, 2015) at a time determined by the Prize Supplier. No extension or variation of these dates will be permitted.
20. If for any reason a prize becomes unavailable due to circumstances outside of the Promoter or the Prize Supplier’s reasonable control, the Promoter and/or Prize Supplier reserves the right to award a similar substitute prize of equal value, subject to State or Territory legislation.
21. Entrants must only enter in their own name. The Promoter and/or Prize Supplier reserves the right to request the winners to produce appropriate photo identification or other documentation (to the Promoter or Prize Supplier’s satisfaction) in order to confirm their identity, age, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion before issuing a prize. If the documentation required by the Promoter and/or Prize Supplier is not received by the Promoter and/or Prize Supplier (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
22. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.
23. If the winner (for whatever reason) is unable to attend the event on the specified dates or if the prize remains unclaimed within 72 hours of the competition closing date the judges reserve the right to select the next best entry judged from all valid entries received.
24. Except for any liability that cannot be excluded by law, the Promoter, the Prize Supplier and their associated agencies and companies (including its
officers, employees and agents) exclude all liability (including negligence), for any personal injury or death which is suffered or sustained; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s/Prize Supplier’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or the Prize Supplier; (d) any variation in prize value to that stated in these Conditions of entry; (e) any tax liability incurred by a winner or entrant; or (f) the use of or participation in the prize. Entrants expressly acknowledge that the Prize Supplier, and not the Promoter is supplying and administering the provision of the prize to the winner.
25. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, reserves the right to cancel, terminate, modify or suspend the promotion.
26. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter or the Prize Supplier which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
27. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for (i) tampering with the entry process (ii) submitting an entry which is not in accordance with these Conditions of Entry and/or (iii) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
28. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
29. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, or any other technical failures including any damage to entrant's or any other person's computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
Entrants consent to the Promoter and the Prize Supplier using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winner agrees to participate in all reasonable promoted
activities in relation to the Promotion as requested by the Promoter and its agents.
30. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you, (the entrant) are taken to consent to Network Ten Pty Limited’s privacy policy which contains information, amongst other things, abot how you may access personal information that is held by Network Ten Pty Limited about you and seek correction of such information. Our APP Privacy Policy also containers information about how you may complain about a breach of the APPs, or registered code that is binding on our organisation and how Network Ten Pty Limited will deal with such complaints. 31. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained via the website tenplay.com.au/privacy. Entrant’s information may be shared with the Prize Supplier and travel suppliers for the purpose of contacting the winner and fulfilling the prize. The Prize Supplier’s Privacy Policy may be obtained via grandprix.com.au/privacy-policy.
32. WARNING – MOTOR RACING, THE EVENT AND ACTIVITIES ASSOCIATED WITH THE EVENT (INCLUDING WITHOUT LIMITATION, SUPPORT EVENTS) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN. THERE IS A POSSIBILITY OF AN ACCIDENT CAUSING INJURY, DEATH OR PROPERTY DAMAGE OR ECONOMIC LOSS.
Upon entering the Competition, each Entrant agrees to provide this release to Australian Grand Prix Corporation (ABN86 947 927 465) (“AGPC”) and the Associated Entities* (defined below):
AGPC and the Associated Entities are not liable to me or to any person with me for (regardless of how or when the liability is caused, or by whom it is caused and regardless of whether such liability or claims are for negligence (excluding gross negligence), breach of contract, breach of statutory duty or any other liability or claim recognised at law):
a) my death, injury to me or the injury or death of anybody else with me;
b) damage to, destruction of, theft of or unauthorised delivery up of any of my property or equipment, whether authorised or not; or
c) damage to, destruction of, theft of or delivery up of any of my clothing or other personal items;
And, in respect of all of the subject matter of each of (a), (b) and (c), I release AGPC and the other the Associated Entities from any liability or claim, which I do or might, or which anybody with me does or might have or in the future might or would have against AGPC or the other the Associated Entities.
* Associated Entities means the Promoter, the Crown in right of the State of Victoria, the Minister administering the Act, the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Federation Internationale de l’Automobile (FIA), Formula One Marketing Limited, Formula One Hospitality and Event Services Limited (UK), Formula One Management Limited (FOM), Formula One World Championship Ltd (FOWC), Formula One Asset Management Limited, Formula One Licensing B.V., Confederation of Australian Motor Sport Ltd, Parks Victoria, State Sport
Centres Trust, APP Corporation Pty Ltd and all other persons involved in the conduct, promotion and organisation of the Event including officials, marshals, rescue and medical staff, competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies and their respective personnel).
33. AGPC and the Associated Entities do not make any warranty that the promotion, the Event, or any services connected with the Event will be provided with due care and skill or that any materials or equipment provided in connection with the services will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied by law it is excluded to the full extent permitted by law.

winner’s entry will become invalid. The prizes will only be awarded following
any winner validation and verification that the Promoter requires in its sole
discretion.
22. Should an entrant’s contact details change during the promotional period, it
is the entrant’s responsibility to notify the Promoter.
23. If the winner (for whatever reason) is unable to attend the event on the
specified dates or if the prize remains unclaimed within 72 hours of the
competition closing date the judges reserve the right to select the next best
entry judged from all valid entries received.
24. Except for any liability that cannot be excluded by law, the Promoter, the
Prize Supplier and their associated agencies and companies (including its officers, employees and agents) exclude all liability (including negligence),
for any personal injury or death which is suffered or sustained; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the Promotion, including, but not
limited to, where arising out of the following: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s/Prize Supplier’s
control); (b) any theft, unauthorised access or third party interference; (c) any
entry or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoter) due to any reason beyond
the reasonable control of the Promoter or the Prize Supplier; (d) any variation
in prize value to that stated in these Conditions of entry; (e) any tax liability
incurred by a winner or entrant; or (f) the use of or participation in the prize.
Entrants expressly acknowledge that the Prize Supplier, and not the Promoter
is supplying and administering the provision of the prize to the winner.
25. In the event of war, terrorism, state of emergency or disaster (including natural
disaster) or any other circumstance beyond the reasonable control of the
Promoter, subject to any applicable laws or written directions made under
applicable State or Territory legislation, reserves the right to cancel, terminate,
modify or suspend the promotion.
26. If for any reason this promotion is not capable of running as planned because
of infection by computer virus, bugs, tampering, unauthorised intervention,
technical failures or any other causes beyond the reasonable control of the
Promoter or the Prize Supplier which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this promotion, the Promoter
reserves the right in its sole discretion to cancel, terminate, modify or suspend
the promotion, subject to any written directions under State or Territory
legislation.
27. The Promoter reserves the right to verify the validity of entries and reserves the
right to disqualify any entrant for (i) tampering with the entry process (ii)
submitting an entry which is not in accordance with these Conditions of Entry
and/or (iii) if the entrant is engaged in any unlawful or other improper
misconduct calculated to jeopardise the fair and proper conduct of the
promotion. The Promoter’s legal rights to recover damages or other
compensation from such an offender are reserved.
28. The Promoter will not be responsible for any incorrect, inaccurate or
incomplete information communicated in the course of, or in connection
with, this promotion if the deficiency is occasioned by any cause outside the
reasonable control of the Promoter.
29. The Promoter is not responsible for any problems or technical malfunction of
any telephone or network or lines, servers or providers, computer equipment,
software, or any other technical failures including any damage to entrant's or
any other person's computer related to, or resulting from, participation in this
promotion or the downloading of any materials related to this promotion.
Entrants consent to the Promoter and the Prize Supplier using the entrant's
name, likeness, image and/or voice in the event they are a winner (including
photograph, film and/or recording of the same) in any media for an unlimited
period of time without remuneration or compensation for the purpose of
promoting, publicising or marketing this promotion (including any outcome),
and promoting any products manufactured, distributed and/or supplied by
the Promoter. The winner agrees to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its
agents.
30. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy
Act 1988 (Cth) and by entering the Competition, you, (the entrant) are taken
to consent to Network Ten Pty Limited’s privacy policy which contains
information, amongst other things, abot how you may access personal
information that is held by Network Ten Pty Limited about you and seek

Network Ten Pty Limited’s APP Privacy Policy in full. Our APP Privacy Policy also
containers information about how you may complain about a breach of the
APPs, or registered code that is binding on our organisation and how Network
Ten Pty Limited will deal with such complaints. We may disclose your personal
information to related entities and third party service providers outside
Australia.
31. All personal information will be stored at the office of the Promoter. A copy of
the Promoter’s Privacy Policy in relation to the treatment of personal
information collected may be obtained via the website
tenplay.com.au/privacy. Entrant’s information may be shared with the Prize
Supplier and travel suppliers for the purpose of contacting the winner and
fulfilling the prize. The Prize Supplier’s Privacy Policy may be obtained via
grandprix.com.au/privacy-policy.
32. WARNING – MOTOR RACING, THE EVENT AND ACTIVITIES ASSOCIATED WITH THE
EVENT (INCLUDING WITHOUT LIMITATION, SUPPORT EVENTS) ARE DANGEROUS
AND ACCIDENTS CAN HAPPEN. THERE IS A POSSIBILITY OF AN ACCIDENT
CAUSING INJURY, DEATH OR PROPERTY DAMAGE OR ECONOMIC LOSS.
Upon entering the Competition, each Entrant agrees to provide this release
to Australian Grand Prix Corporation (ABN86 947 927 465) (“AGPC”) and the
Associated Entities* (defined below):
AGPC and the Associated Entities are not liable to me or to any person
with me for (regardless of how or when the liability is caused, or by whom
it is caused and regardless of whether such liability or claims are for
negligence (excluding gross negligence), breach of contract, breach of
statutory duty or any other liability or claim recognised at law):
a) my death, injury to me or the injury or death of anybody else with me;
b) damage to, destruction of, theft of or unauthorised delivery up of any
of my property or equipment, whether authorised or not; or
c) damage to, destruction of, theft of or delivery up of any of my clothing
or other personal items;
And, in respect of all of the subject matter of each of (a), (b) and (c), I
release AGPC and the other the Associated Entities from any liability or
claim, which I do or might, or which anybody with me does or might have
or in the future might or would have against AGPC or the other the
Associated Entities.
* Associated Entities means the Promoter, the Crown in right of the State
of Victoria, the Minister administering the Act, the Minister administering
the Crown Land (Reserves) Act 1978 (Vic), Federation Internationale de
l’Automobile (FIA), Formula One Marketing Limited, Formula One
Hospitality and Event Services Limited (UK), Formula One Management
Limited (FOM), Formula One World Championship Ltd (FOWC), Formula
One Asset Management Limited, Formula One Licensing B.V.,
Confederation of Australian Motor Sport Ltd, Parks Victoria, State Sport Centres Trust, APP Corporation Pty Ltd and all other persons involved in the
conduct, promotion and organisation of the Event including officials,
marshals, rescue and medical staff, competitors and drivers (such parties
to include where relevant all directors, officers, employees, agents,
contractors and affiliated companies and their respective personnel).
33. AGPC and the Associated Entities do not make any warranty that the
promotion, the Event, or any services connected with the Event will be
provided with due care and skill or that any materials or equipment provided
in connection with the services will be fit for the purposes for which they are
supplied. Entrants acknowledge that, to the extent that any warranty is
implied by law it is excluded to the full extent permitted by law.
