 STANDARD TERMS

1. Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.

WHO CAN ENTER

2. Entry is open to all residents of Australia only. However, directors, management, employees and their immediate families of the Promoter, the Benefitting Party, and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. Entrants under 18 years of age must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.

HOW TO ENTER

4. The competition commences on Monday 9th February, 2015 at 00:01 (AEST) and concludes on Wednesday, 20th May, 2015 at 23:59 (AEDT), inclusive (“The Competition Period”) a. The Competition Period will be divided into three Competition Sections i. Section 1 commences on Monday 9th February, 2015 at 00:01 (AEST) and concludes on Sunday, 8th March, 2015 at 23:59 (AEST), inclusive. ii. Section 2 commences on Monday 9th March, 2015 at 00:01 (AEST) and concludes on Sunday 12th April, 2015 at 23:59 (AEST), inclusive. iii. Section 3 commences on Monday 13th April, 2015 at 00:01 (AEST) and concludes on Wednesday, 20th May, 2015 at 23:59 (AEDT), inclusive. b. Major and Minor Prizes will be divided equally between the three Sections across the Competition Period

5. The competition will be advertised in-store, online, and in press and magazines.

6. a. ONLINE: Visit the website www.taste.com.au during the Competition Period, and enter all details requested within the competition page including but not limited to full name, address, daytime contact number, email address, and the last 6 digits of the barcode of the participating product, and submit; OR

b. SMS: Send a text/SMS message to 19 711 223 (text message costs a maximum of 55c per message and each text message has a maximum of 160 characters) during the Competition Period with full name, address, the last 6 digits of the barcode of the participating product; OR

c. PHONE: Call 1900 966 329 (call costs a maximum of 55c including GST - higher charges from mobiles/payphones may apply) and follow the prompts to key in the last 6 digits of the barcode of the participating product, and provide their full name, address and daytime contact number; OR

d. MAIL: Write their name, address, daytime contact number, the last 6 digits of the barcode of the participating product on the back of an envelope; enclose a copy of the receipt of the purchased participating product and post to: Robert Timms Competition, PO Box 6304, Frenches Forest NSW 2086 to be received during the Promotional Period. Each entry form/coupon must be sent in a separate, stamped, standard sized envelope. Envelopes with multiple entry forms/coupons will be treated as a single entry. Only original entry form/coupon will be accepted, no photocopies allowed.

7. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

8. Only one barcode per entry is permitted. Unrecognised barcodes will not be accepted. One entry per purchase receipt is permitted.

9. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.

10. Entrants must retain all original purchase receipts showing the qualifying purchase, corresponding store name and date and time of purchase to claim any prize. Promoter reserves, in its absolute discretion, the right to request all purchase receipts for every entry made by an entrant. Failure to provide all purchase receipts for each entry when requested may, in the absolute discretion of the promoter, render all an entrant’s entries invalid and forfeit their right to any prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotion period but prior to entry.

11. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including a copy of their receipt as proof of purchase) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the absolute discretion of the Promoter. In the event that a winner cannot provide suitable proof, all of the entrant’s entries will be deemed invalid, and the winner will forfeit the prize in whole and no substitute will be offered.

12. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

13. Any cost associated with entering the Competition is the entrant’s responsibility and is dependent on the telecommunications service provider used.

HOW TO WIN

14. Entrants in the competition may enter once per day by Phone, once per day by SMS and once per day Online (All times AEST/AEDT).

15. The time of entry will in each case be the time the 190 telephone call/SMS message is received by the Salmat Digital Pty Limited database or the Promoter’s database for online entries. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason.

16. Any entry that is made on behalf of an Entrant by a third party will be invalid, if determined by the promoter, acting reasonably, that this was done to circumvent any part of these terms and conditions.

17. MAJOR PRIZE DRAWS: Each valid entrant who has entered the competition over the duration of any Competition Section, will be entered into the Major Prize draw for that specific Competition Section. One (1) valid entrant will be drawn for each Competition Section at random to become the winners of that Competition Section’s Major Prize. Three (3) winners will be drawn in total from the Total Competition Period. Each draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, at 14:00 (AEST) on the dates specified in Table A.

18. The three (3) Major Winners will each win a holiday package for two (2) to the Maldives, including:

i. Two (2) return Singapore Airlines, economy flights to the Maldives

ii. One (1) night’s twin-share accommodation at the 5-star Crowne Plaza Changi Airport hotel; including daily buffet breakfast, for the winner and their companion

iii. Six (6) nights’ twin-share accommodation at the 5-star Centara Grand Island Resort and Spa in a Deluxe Water Villa, including daily buffet breakfast, for the winner and their companion

iv. Seaplane transfer for the winner and their companion, from Centara Grand Island Resort and Spa, to Maldives Airport

v. Meet and greet at Male Maldives Airport and assistance with domestic transfers Major Prize Value up to $13,000 each (including GST)

19. A total of three (3) Major Prizes are available with a Total Major Prize pool value is up to $39,000 (including GST)

20. The winners will be notified within 2 days of the draw. The winners will be notified of their prize in writing. Winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper and http://www.news.com.au/competition/winners on the dates specified in Clause 16, Table A.

21. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

22. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

23. An entrant can only win one Major Prize. If drawn as a winner of more than one Major Prize during the Competition Period, the first Major Prize won will be awarded and the remaining prize/s will be awarded during the unclaimed prize draw.

24. MINOR PRIZE DRAWS: Fifty (50) Minor Prize winners will be drawn from each Competition Section’s total entries. Each Minor Winner will receive a The House of Robert Timms Coffee Appreciation Pack, valued at $100.00 RRP each (including GST). Each draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, at 14:00 (AEST/AEDT) on the dates specified in Table A.

25. A total of one-hundred and fifty (150) Minor Prizes are available with a Total Minor Prize pool value is up to $15,000 (including GST)

26. Total Competition Prize Pool is up to $54,000 (including GST) 27. The minor winners will be notified within 2 days of the draw and will be notified of their prize in writing.

28. Prizes cannot be transferred and cannot be redeemed for cash.

29. FOR ALL HOLIDAY PRIZES: The winners and their companions are responsible for all other expenses including; spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance, and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

30. The winners and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth). If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only – if applicable. If the winner resides within the same state of their prize destination then the flight component of the prize will not be included and the winner and their travelling companion will responsible for making their way to and from their destination.

31. If any winner is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.

32. Major Prizes are subject to booking and flight availability and cannot be taken during Australian school holidays, public holidays or other peak periods. Holidays must be booked and taken prior to Monday 31st August 2016.

33. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

34. A credit card imprint or Once accommodation vouchers are issued they are non-changeable. 35. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.

36. The Promoter and all associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

37. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in any offered activity should they be chosen as winners. The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties are not to be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of any aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize. 38. FOR DESTINATIONS WITH TRAVEL WARNINGS: The winners acknowledge that some regions are politically unsettled, and guerrilla warfare/activity may exist in the areas in which they will be travelling. The winners are required to be physically fit. These prizes are not suitable for anyone who suffers from a respiratory disorder, circulatory ailment, or physical disability that limits mobility. By entering the competition, the winner and their guest acknowledge they are able to bring with them with the required clothing for this tour at no expense to The Promoter or the other organisers.

39. Unless expressly stated in these terms and conditions all other expenses including travel to and from the departure point become the responsibility of the winner.

40. If any prize within this Competition is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

41. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

42. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

43. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed & filmed throughout the duration of the prize.

44. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

45. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

46. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

47. UNCLAIMED PRIZE DRAW: Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on the date specified in Table A at 14:00 (AEDT). The winners will be notified within 2 days of the draw. The winners will be notified of their prize in writing. Winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper and http://www.news.com.au/competition/winners on the date specified in Table A.

48. Programming and other quality control errors will not invalidate an otherwise valid prize claim.

49. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

50. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

51. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.

52. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

53. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

NO LIABILITY

54. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

55. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

56. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

57. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

58. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

59. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.

60. STANDARD OPT-IN: All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

PRIVACY CONSENT

61. News Limited, as the Promoter of this competition, collects information about competition entrants, including for example their name and contact details which they provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes. We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. Further information about how we handle personal information, how you can access your personal information and our contact details can be found in our Privacy Policy http://www.news.com.au/help/privacypolicy.

62. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

63. Salmat Digital Pty Limited, on behalf of the Promoter are collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital Pty Limited for this purpose. If you are not willing for this to occur you cannot participate in the promotion.

64. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

66. The Benefitting Party is Fresh Food Services Pty Ltd (ABN 82 081 286 053) of 160 Burwood Road, Concord NSW 2137.
