"The HotelClub Big Giveaway" Terms and Conditions
(the "Competition")

These terms and conditions ("Terms and Conditions") govern the relationship between you, the entrant ("you", "yours") and the promoter, HotelClub Pty Ltd ("HotelClub", "Promoter", "we", "our", "us") ABN 85 092 445 442 whose principal place of business is at Level 10, 201 Elizabeth Street Sydney NSW 2000, Australia.

The permit numbers for this Competition are NSW Permit No. LTPS/15/01487, ACT Permit No. TP15/04952 & SA Licence No. T15/355.

Eligibility

The Competition is open to entrants who are permanent residents of Australia and are 18 years of age or over ('eligible entrant').
The following are not eligible to enter the Competition: (i) employees and independent contractors of the Promoter and/or its related party entities (i.e. parent companies and subsidiaries); (ii) immediate family members of such employees or independent contractors. In these Terms and Conditions, "immediate family members" includes mother, father, brothers, sisters, sons, daughters or spouse.
How to Enter

This Competition is a game of chance.
To enter the Competition, an eligible entrant must, within the Competition Period, log on to www.thehotelclubgiveaway.com.au, complete the entry form and submit their entry.
An entry must not be late, incomplete, incomprehensible, unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, capable of encouraging conduct that would be considered a criminal offence, capable of violating any law and/or capable of giving rise to civil liability.
There is/is no limit on how many times each entrant can enter the Competition. The Promoter reserves the right to, at any time, verify an entry or entrant and disqualify an entrant if the Promoter, in its reasonable opinion, believes the entrant has submitted an entry that is not in accordance with these Terms and Conditions.
Competition Period

The Competition commences on 23rd March 2015 at 12:01am AEDT and closes 31st December 2015 at 11:59pm AEDT (the "Competition Period") and only entries received by or on behalf of the Promoter during the Competition Period will be accepted into the Competition.
Winners Selection

There will be three (3) draws. The draws from all eligible entrants will take place at 2:00pm AEST/AEDT at MDSA, 5/15 Grosvenor Street, Neutral Bay, NSW 2089.
a. All entries received from 23/03/15 to 23/06/15 will be entered in Draw 1 on 29/06/2015;
b. All entries received from 24/06/15 to 30/09/15 will be entered in Draw 2 on 06/10/15;
c. All entries received from 01/10/15 to 31/12/15 will be entered in Draw 3 on 08/01/2016
The winners will be notified in writing by email within 2 working days of the draw and his/her name will be published on the HotelClub Facebook page, www.thehotelclubgiveaway.com.au for a period of 28 days and in The Australian newspaper on 06/07/15 for Draw 1; 13/10/15 for Draw 2 & 15/01/16 for Draw 3.
The winners will be required to accept their Prize by phone or email within 3 months of the applicable draw, otherwise the winner/s will forfeit any and all claim to the Prize awarded but not accepted. Details of how to book the Prize will be given at this time.
The winners have until 31/07/2016 to take their Prize subject to booking availabilities of all Prize elements.
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these competition conditions, forfeiting or not claiming a prize. For any prize that remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw/s 3 months after the date of the original draw with any final unclaimed prize draw taking place on 12/04/2016 subject to state regulations and any winner of the unclaimed Prize draw will be notified in writing via email and telephone of their Prize and their name(s) will be published on www.thehotelclubgiveaway.com.au for a period of 28 days and announced in The Australian newspaper on 19/04/2016.
The Promoter reserves the right to cancel this Competition at any stage, if deemed necessary in its reasonable opinion, or if circumstances arise out of its control, subject to approval by relevant state authorities.
Prizes

The first eligible entry drawn in each draw will receive the winner's choice of one of the following prize options.
Option 1 - Food Lovers Experience to the maximum value of AUD $5,000

A food lovers experience in Melbourne. The prize is for two persons including return economy airfares (including associated taxes), 3 nights twinshare accommodation in a 5-star hotel (Crown Towers Hotel Melbourne), airport transfers and restaurant vouchers. Prize includes;

The prize is for two persons including return economy airfares (including associated taxes) from the winner's nearest Australian capital city to the destination of their choice, accommodation in a deluxe room, airport transfers and a Westfield shopping voucher to a maximum value up to AUD $5,000. Prize includes;

Option 3 - Deluxe Show Lovers Experience to the maximum value of AUD $5,000

A show lovers experience in Sydney. The prize is for two persons including return economy airfares (including associated taxes), 3 nights' accommodation in 5-star hotel (The Langham Hotel Sydney), airport transfers, restaurant vouchers and tickets to a Sydney Opera House event of the winner's choice. Prize includes;

Return economy airfares from the winner's nearest Australian capital city to Sydney
2 x Opera House premium tickets
Good Food restaurant vouchers to the value of AUD $500

Option 4 - A luxury holiday to a destination of the winner's choice to the maximum value of AUD $5,000

The prize is for two persons, including return economy airfares (including associated taxes) from the winner's nearest Australian capital city to the destination of their choice, accommodation in a deluxe room, transfers and breakfast to a maximum value up to AUD $5,000.

The prize is made up of a HotelClub Credit valued at AUD $2,300 and a Qantas Gift Voucher valued at AUD $2,500, and airport transfer vouchers valued at AUD $200.

For HotelClub credit fulfilment, the winners will need to register at www.hotelclub.com/account/registration using the email address they used to enter the competition. HotelClub will then credit the value of the prize in member rewards (1 member reward = $1 USD). Fulfilment will take place within 10 business days of registration on the HotelClub website. Member rewards can be used on any eligible hotel on the HotelClub website. They must be redeemed, and will expire, within 365 days of crediting.

The total maximum retail value of prizes in each draw (1, 2 and 3) is AUD$5,000

The total maximum retail value of all the prizes is AUD$15,000

Travel is on confirmed space and is subject to seat availability at time of booking for airfares. Black out dates may apply and are subject to confirmation with the relevant airline or hotel. All flights and hotel stays are subject to availability
The winners and their chosen guest MUST travel together and share the same itinerary.
If a winner is a resident of the prize destination they will forfeit the airfare portion of the prize and no compensation will be paid or given in lieu.
It is the responsibility of the winners to arrange and confirm reservation dates for the accommodation component of their prize with the relevant hotel upon receipt of their prize voucher.
Luggage check-in and extra options (i.e. speedy boarding, etc) will be the cost and responsibility of the winners;
All other expenses including but not limited to ground transportation to and from the departing and arrivals airport, additional ground transport, all other transfers, meals and beverages, gratuities, applicable taxes, hotel service charges, airport taxes, surcharges, travel and medical insurance, additional spending money, personal expenses, souvenirs, upgrades, incidentals and expenses not expressly specified herein are the sole responsibility of the winners and their chosen guest. The winners may be required to present their credit card at time of accommodation check in.
The winners must inform the Promoter at least thirty (30) days (prior to their preferred departure date to arrange airfares. Normal terms and conditions of carriage apply, no stop-over is permitted and there is a maximum stay of 3 months, subject to visa restrictions. Airfare tickets are also not applicable on code share services with other operators and the prize winners are subject to further charges should this not be adhered too.
It is the responsibility of each winner to provide correct names of all persons travelling for the booking arrangements as the Promoter reserves the right to charge the winners AUD100 per guest and per change in addition to any airfare tax or surcharges that may increase related at the time of booking for any corrections that are required to any of the traveling documents due to misinformation provided by the prize winners or any change in itinerary made by a winner and/or their guest.
Travel documentation in the form of Gift Certificates, Vouchers & Air tickets provided to the winners and their chosen guest is to be presented to reservationists for redemption. Failure to present the correct documentation by the winners and/or their chosen guest means that redemption will be at the discretion of the provider and the winners and/or their chosen guest may forfeit or be charged extra costs for their prize.
If the winners fail to notify the Promoter or tour operator of a change at least 48 hours prior to departure or no-show will forfeit their prize.
No responsibility is assumed by the Promoter for any cancelled, delayed, suspended or rescheduled events once any tickets have been issued in relation to the prize for any reason whatsoever beyond its control.
The winners and their chosen guest will be responsible for ensuring travel insurance and travel papers, including passports (with more than six months until expiry at the time of travel) and visa and ,where necessary, for obtaining appropriate vaccinations and inoculations are in good order and are valid prior or and for the duration of the trip. The Promoter highly recommends that travelers take out adequate travel insurance.
The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Prize winners (and their companion/s) to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event.
The Prize winners (and their companion/s) are advised to consult their healthcare professional regarding recommended immunisations and/or health checks prior to travelling and to check for travel warnings and any perceived hazards with appropriate authorities, including www.dfat.gov.au.
The Prize, or any part thereof, must be accepted as awarded and is non-negotiable, non-transferable to another person and non-convertible to cash or credit. It is not possible to earn or redeem frequent flyer rewards on the Prize. The Prize cannot be used in conjunction with any other special offer. All aspects of the Prize must be taken together as a package.
The winners acknowledge that their Prize may be subject to the terms and conditions of the operators of the relevant accommodation, air and leisure services. The winners must acquaint themselves with these terms and conditions prior to taking the Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prize, or for the breach of those terms and conditions by any person.
General

By participating in the Competition, you agree (i) to be bound by these Terms and Conditions (which may be amended or varied at any time by us with or without notice) and by our decisions which are final in all matters relating to these Terms and Conditions, the Competition, the draw(s) and/or the results and no correspondence or discussion shall be entered into, and (ii) that Promoter may register you for the HotelClub Member Rewards program and send you email confirmation of this. All entries in the Promotion become the property of the Promoter and will not be returned.
We accept no responsibility for any incorrect or inaccurate information and assume no liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, line failure, theft or destruction or unauthorized access to entries and/or the entries being lost or deleted whether or not arising during operation or transmission as the result of server functions, virus, bugs or other causes outside its control (to the fullest extent permitted by law).
To the full extent permitted by law, HotelClub will not be liable for any loss, damage, claim, cost, expense or personal injury suffered by any person (including, without limitation, that caused by any person's negligence) in connection with this Competition or the Prize including an indirect, economic or consequential loss or loss of profits, any loss arising from the negligence of the Promoter and the agencies and companies that are associated with the Promoter or the competition and any liability for personal injury or death.
The winners are advised to seek independent advice on the tax implications, if any, which may arise prior to their acceptance of the Prize.
Any questions, comments or complaints in relation to the Promotion should be directed to the Promoter.
These Terms and Conditions will be governed by and construed in accordance with the laws of Australia and any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts.
Privacy

Entrants' personal information will be collected by Promoter to enable it to conduct the Competition and publicise the winner. Entrants' personal information may be disclosed to marketing and communications agencies, prize suppliers and prize deliverers in order to conduct this Promotion and fulfil the Prize. In addition, where the entrant gives their consent, their personal information will be entered into a database. The Promoter and other third parties associated with this Competition may use that personal information for marketing and promotional purposes including, without limitation, sending that entrant marketing information relating to future promotions. By opting-in, entrants consent to and confirm that they will allow their details to be used for this purpose. If an entrant no longer consents to their details being used in this way, or wish to update, modify or delete details held by the Promoter, they should contact the Promoter directly using the details found at http://www.hotelclub.com/info/page?id=PrivacyPolicy.. Entrants who consent to the use of the personal information by third parties agree that the storage and use of the personal information by those third parties will be subject to their privacy policies. Entrants agree that the Promoter will not be responsible for any misuse of their personal information by such third parties, and should contact the third party directly.
