Muffin Break – Suggest a Flavour – Muffin Lab

Information on how to enter and the prize(s) form part of these terms and conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
The promoter is Muffin Break Pty Ltd ACN 007 192 529 of Unit 215F1, Building 215, the Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021, Australia (the Promoter).
Entry is only open to Australian residents.
Entrants under 18 years old must have parental/guardian approval to enter.
Employees (and their immediate families) of the Promoter, its related entities, and other agencies associated with this promotion are ineligible to enter.
The Promotion commences at 12:01am Australian Eastern Standard Time on 9 February, 2015, and entries close at 11.59pm Australian Eastern Standard Time on 8 August, 2015, (the Promotion Period).
To enter, you must during the Promotion Period visit muffinlab.com.au, click on the link to the online competition entry form and, fully and correctly complete the online entry form by:
a) providing your full name, phone number and current and valid email address; and
b) describing in 25 words or less the suggested flavour for a new limited edition muffin.
The entry must be your own original idea which must not have been previously published in any forum worldwide and does not infringe the intellectual property rights of any third party.
By entering the competition, you provide the Promoter with permission to publish your name on Promoters website (muffinbreak.com.au), and the Muffin Lab website (muffinlab.com.au) and the Muffin Break Facebook page.
Multiple entries are permitted, provided that each entry must be submitted separately and in accordance with these terms and conditions.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter is not responsible for any technical malfunction of any communications network or any lost, late, delayed, ineligible, incomplete or corrupted entries, however this may happen.
Any entry that is illegible, late, invalid or incomplete will not be considered, and the Promoter accepts no responsibility for lost entries.
The Promoter may:
a) disqualify any entry if the Promoter believes has breached any of these conditions, or engaged in any unlawful or other improper misconduct which places the fair and proper conduct of the competition at risk;
b) vet all entries prior to them going live on any website referred to in these terms and conditions and reserves the right to remove any entries at any time in its absolute discretion;
c) if more than one entrant submits the identical flavour for a new limited edition muffin, the Promotor will accept the first eligible entry that was submitted, and may disregard, or not admit for judging, any subsequently submitted entry.
This is a game of skill. Chance plays no part in determining the winners.
There are six (6) prizes in total.
Six (6) monthly prizes (each being a Monthly Prize) of one (1) VISA giftcard with a gross face value of $500.00 (AUD). The total value of all prizes is $3,000.00 (AUD).

All eligible entries will judged by a panel of appropriately qualified members of the marketing and product teams at Muffin Break Pty Ltd ACN 007 192 529 (the Judging Panel), to determine each winner of a Monthly Prize (the Monthly Prize Winner) – judged to be the best from all eligible entries submitted in relevant month of the Promotion Period based on the following criteria:
a) skill;
b) creativity and originality; and
c) practicality and commercial viability.
The decision of the Judging Panel is final and binding and no correspondence will be entered into.
Each prize winner will be notified by telephone and in writing (email) (using the details provided on the entry form) and their name and winning entry may be published by the Promoter in the places referred to in condition 9 of these terms and conditions.
If any prize is unavailable, for whatever reason, the Promoter reserves the right to substitute it for a prize of equal or greater value.
The Promoter will not be liable for any loss or damage whatsoever caused by the taking of any prize except for any liability that cannot be excluded by law.
If for any reason the Promoter is unable to contact a prize winner for the purposes of distributing a prize:
a) that winner will forfeit their prize entirely provided that the Promoter may, in its absolute discretion, award a Monthly Prize to the next best eligible entrant, as judged by the Judging Panel under paragraph c) of this condition, in relevant month of the Promotion Period; or
b) the Promoter will not be liable where a winner forfeits their prize pursuant to this condition.
c) If the Promoter:
(1) is unable to contact a prize winner for the purposes of distributing a prize for a period of ten (10) working days after the date for notifying prize winners referred to in condition 18 above; and
(2) exercises its discretion under paragraph a) of this condition,
the Promotor will, where this condition applies, arrange for the Judging Panel to hold an unclaimed prize draw that complies with this condition within seven (7) days after the expiry of the period of ten (10) working day period referred to in sub-paragraph (1) above.
Prizes are not transferable, exchangeable and are not redeemable for cash.
By entering the competition you:
a) agree that the Promoter has an unrestricted, irrevocable, transferable, right and license to use and modify your entry and ideas provided by it for the purposes of the Promoter’s business without the payment of any fee or compensation; and
b) without limiting the generality of paragraph a) of this condition, acknowledge and agree that the Promoter will use, and allow others to use, the suggested flavour for a new limited edition muffin included in your entry use your idea as the basis of a product that may be put into production and sold in Muffin Break stores for which you will not be entitled to receive any royalty or other financial return other than the prize specified in these terms and conditions.
By entering the competition, you acknowledge that your entry information may be used for future promotional purposes if you have opted-in to receiving promotional information from Muffin Break. This is subject to the Promoter’s privacy policy which applies to all personal information they provide. This policy can be viewed by visiting the Promoters website (muffinbreak.com.au).
