Terms & Conditions

1. How to Enter: entry to Riley St Garage’s Sunbeam Promotion (Promotion) is open to all Australian residents aged 18 years and over and is subject to these Terms & Conditions (T+Cs). To enter the Promotion, entrants must sign up to the Promoter’s database via the Competition Page on www.rileystgarage.com.au during the Promotional Period. Entrants will be required to provide details (first name, last name, valid email address, postcode) in their entry. Current members of the Promoter’s database will have to enter via the Competition Page on www.rileystgarage.com.au during the Promotional Period to be eligible to win. By signing up to the Promoter’s database, entrants are agreeing to receive further information from the Promoter via email.

2. Acceptance of these T+Cs: these T+Cs together with all other information and instructions provided prior to entering the Promotion, form part of the rules of entering the Promotion and participation in the Promotion is deemed acceptance of these T+Cs.

3. Eligible Entrants: no purchase is necessary to enter or participate in the Promotion. Entry is open to Australian residents aged 18 years and over with a valid email address. Persons and their immediate families in the following categories are not eligible to enter the Promotion: (a) Promoter’s employees; (b) Promoter’s contractors; (c) staff associated with companies donating prizes in this Promotion.

4. Duration of Promotion: the Promotion runs from 09:00hrs AEDT Wednesday 25th February 2015 until 17:00hrs AEDT Friday 22nd April 2015 (Promotional Period).

5. Entry via Internet: entry to the Promotion is via the internet only and any associated with accessing the Promoter’s website or the entrant’s email account are the responsibility of the entrant. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Promoter is not responsible for any technical malfunctions of computer online or wireless systems, servers or providers, computer equipment, software or other problems resulting from participation or sending or receiving any communication or materials associated with this Promotion.

6. Number of Permitted Entries: one (1) entry is permitted per person. All entries must be submitted in accordance with these T+Cs.

7. Selection of Winners: at the conclusion of the Promotional Period Promoter two (2) winners will be selected at random. The selection will take place in the Promoter’s head office. Selection of Promoter is final and no correspondence will be entered into.

8. Prize Details: there will be two (2) winners selected for the Promotion. Each winner will be entitled to receive the prize applicable to their entry: Prize 1. Sunbeam prize pack consisting of a Sunbeam Café Series Planetary Mixmaster and Sunbeam Blender, valued at AUD$988.00 Prize 2. Dinner for four (4) at Riley St Garage to the value of AUD$400.00

9. Costs Associated with Use of Prize: the winner is responsible for organising and paying any costs associated with the use of the prize (if any).

10. Delivery of Prizes to Winner: delivery of the prize will be arranged by Promoter (by posting to a street address nominated by the winner). Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

11. Prize Value: the maximum total prize pool value for the Promotion is AUD$1388.00 (One Thousand, Three Hundred and Eighty Eight Australian Dollars). If any of the prizes are not claimed by winners prior to 17:00hrs AEST Thursday 30th April 2015 the prize will be forfeited and will not be awarded to an alternate entrant. Promoter takes no responsibility for any variation in the prize value between the date of publication and the date the prize is received.

12. Prizes Not Transferrable: the prize, or part of the prize, is not transferable or exchangeable and cannot be taken as cash.

13. Use of Prize: if for any reason the winner does not redeem a prize, or part of a prize, at the time stipulated by Promoter, then the prize, or part of the prize, will be forfeited.

14. Prize Unavailable: if a prize becomes unavailable, the Promoter reserves the right to substitute a different prize item of equal or greater value in the Promoter’s absolute discretion.

15. Winner Notification: the winner will be notified by email according to the details provided in their entry.

16. Validity of Entries: The Promoter reserves the right at any time to verify the validity of entires and entrants (including an entrant’s identity, age and place of residence) and to disqualify and entrant who submits and entry that is not in accordance with these T+Cs or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. The Promoter’s failure to process any of the Promoter’s rights at any stage does not constitute a waiver of those rights.

17. Late Entries + Time of Receipt: The Promoter accepts no responsibility for late, incomplete, indecipherable, lost, or misdirected entries all of which are deemed invalid. All entries are deemed to be received at the time of the Promoter’s receipt of entrant’s database sign up, not at the time submission or transmission by the entrant.

18. Unforeseen Events: if for any reason this Promotion is not capable of running as planned due to any reason beyond the Promoter’s control, the Promoter reserves the right to the fullest extent permitted by law to (a) disqualify any entrant who tampers with the process, and (b) cancel, terminate, modify or suspend the Promotion subject to any written directions from a regulatory authority.

19. Personal Information: The Promoter collects personal information to conduct the Promotion and may, for this purpose, disclose such information to third parties (including but not limited to agents, contractors, service providers, offer suppliers and as required to Australian regulatory authorities). Participation in the Promotion is conditional upon each entrant providing their personal information. Unless an entrant advises otherwise, the Promoter may use the information for promotional, marketing, publicity, research and profiling purposes, including contacting the entrant by email. Entrants can opt out of receiving correspondence from the Promoter by electing the unsubscribe option included in all correspondence the Promoter sends out. All entries become the sole property of the Promoter upon submission to the Promotion.

20. Promoter’s Liability: nothing in these T+Cs limits, excludes or modifies or purports to limit or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot be excluded by law including the Non-Excludable Guarantees, Promoter (including Promoter’s officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or loss or damage including loss of opportunity; whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the Promoter’s reasonable control; (d) any variation in prize value to that stated in these T+Cs; (e) any tax liability incurred by a winner or entrant; (f) participation in the Promotion; (g) if any prize event is cancelled or delayed for any reason beyond the control of the Promoter; and/or (h) redemption of the prize including attendance at a prize event.
