Scenic Home Food & Design competition

1. Instructions on how to enter and prize form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

2. Entry is open to residents of Australia aged 18 years and over who are available to take the prize from 18 October 2016 to 2 November 2016, flights return from Australia, if selected as the winner. Employees (and their immediate families) of the Promoter and associated agencies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The competition commences on Friday 10 April 2015 at 12:01am AEDST and closes at 11:59pm AEST on Saturday 30 May 2015 ("Competition Period).

4. To enter, individuals must go towww.homefooddesignweekend.com.au, follow the prompts to the competition page, fill in the entry form with all of the requested details (including their full name, address, daytime telephone number and a valid email address), provide an original and creative answer to the competition question "Tell us in 25 words or less which European dish are you most keen to try on The Australian Women's Weekly Jewels of Europe Culinary River Cruise and why" and submit the fully completed entry form  as instructed so it is received during the Competition Period.

5. Only one (1) entry per person will be permitted.

6. Incomplete, incomprehensible and indecipherable entries will be deemed invalid and will not be included in the judging.

7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardies fair and proper conduct of thecompetition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

9. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on the originality, literary merit and creative merit of the answer to the competition question provided. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter's premises at 54 Park Street, Sydney NSW and will begin on Tuesday 2 June 2015. The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.

10. The winner will be notified by phone and in writing using the contact details given in their entry.

11. The judges' decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

12. The best valid entry, as determined by the judges will win a 15 Day Jewels of Europe Culinary River Cruise for two (2) people, valued at up to AU$25,570 depending on point of departure.  Prize includes:

    two (2) return economy class airfares flying on an airline of Scenic Tours' choice, from the winner's closest city of  Sydney, Melbourne, Brisbane, Adelaide or Perth to Budapest, Hungary on 18 October 2016 and returning from Amsterdam, Netherlands on 2 November 2016; and
     a 15 Day/14 Night Jewels of Europe Culinary River Cruise with Scenic Tours in a category BA balcony cabin for two (2) people, departing from Budapest, Hungary on 19/10/2016 and finishing in  Amsterdam, Netherlands on 01/11/2016. The cruise includes onboard main meals (with the exception of those restaurants which have an additional cover charge), onboard daytime activities (with the exception of those activities and facilities which have an additional cover charge), and all overseas port charges and taxes.

Spending money, additional meals, additional accommodation, taxes (excluding airline, airport and port taxes), insurance, passports, visas, vaccinations, transport to and from departure point, laundry, telephone calls, upgrades, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.  Prize must be taken from 18 October 2016 to 2 November 2016 and is subject to booking and flight availability. Prize must be booked within 3 months of winner notification.

13. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in.

14. The total prize pool is valued at up to AU$25,570. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

15. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

16. Prize is subject to the standard terms and conditions of individual prize and service providers.

17. In the event that for any reason whatsoever the winner does not take the prize (or part of the prize) at/by the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited by the winner and cash will not be awarded in lieu of the prize.

18. In the event that the prize (or part of a prize) is unavailable, the Promoter reserves the right to substitute the prize (or part of the prize) in its discretion with an alternative prize (or part of the prize) to the same and equal recommended retail value and/or specification.

19. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

20. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the competition.

21. If an entry is selected as the winning entry, validation of the entrant's circumstances/ the validity of their entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the Terms and Conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation required by the Promoter and/or prize supplier.

22. Entrants agree that they are fully responsible for any materials they submit via the competition including but not limited to answers to the competition question ("Content"). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:

 (a)     they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

(b)     their Content shall not contain viruses or cause injury or harm to any person or entity;

(c)     they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;

(d)     the Content is the original literary work of the entrant that does not infringe the rights of any third party;

(e)     they consent to any use of the Content which may otherwise infringe the Content creator's/creators' moral rights pursuant to theCopyright Act 1968(Cth) and warrant that they have the full authority to grant these rights; and

(f)      they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

23. As a condition of entering this competition, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
