“LINDT LINDOR WIN A TRIP TO SWITZERLAND TO MEET ROGER FEDERER” PROMOTION
TERMS AND CONDITIONS
1. These terms and conditions of entry (Terms and Conditions), including information on how to enter and prize details apply to participation in the “Lindt Lindor Win A Trip To Switzerland To Meet Roger Federer” Promotion (Promotion). Participation in the Promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents aged 18 years and over who are available to travel to Switzerland for 10 nights during July - December 2015 (exact travel dates TBC by the Promoter, in accordance with paragraph 23 of these Terms and Conditions).

3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences 9.00am Australian Eastern Standard Time (AEST) on 27/04/15 and ends at 11.59pm AEST on 17/5/15 (Promotional Period).

5. To enter, eligible entrants must complete the following two (2) steps during the Promotional Period:

a) purchase one (1) Lindt Lindor Sea Salt Caramel product (611439 Sea Salt Caramel 154g Gift Box, or 611438 Sea Salt Caramel 130g Bag) from Woolworths stores nationally; and

b) visit www.lindt.com (Website), follow the prompts to the Promotion entry page, complete all of the requested details including their full name, date of birth, full residential address, valid email address, telephone number, and respond to the following question: "In 25 words or less tell us why is Sea Salt Caramel the perfect match for Lindor?" (Competition Question), and submit the fully completed entry form. Entrants can access the Website via a computer or via a compatible mobile phone or tablet.

6. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per one (1) Lindt Lindor Sea Salt Caramel product purchased during the Promotional Period; and (b) each entry must be submitted separately and in accordance with these Terms and Conditions.

7. Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. Incomplete, incorrect or indecipherable entries will be deemed invalid.

10. The Promoter accepts no responsibility for late, lost or misdirected entries, or entries not received for any reason. Entries will be deemed to be received at the time of receipt by the Promoter.

11. The Promoter is not responsible for technical difficulties with the Website or entry mechanism and does not warrant that the Website or entry mechanism will be available at all times.

12. Entrants can only enter the Promotion in their own name. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. Judging of all valid, eligible entries submitted during the Promotional Period will take place on 21/05/2015 at 2pm AEST at Level 7, 299 Elizabeth Street, Sydney, NSW 2000 (Judging).

14. All eligible entries will be assessed in the Judging process.

15. The best answer to the Competition Question, will win the Major Prize (Winner). The second to fifty-sixth (2nd) – (56th) best answers to the Competition Question will each win a Runner Up Prize (Runners Up).

16. This is a game of skill and chance plays no part in determining the Winner or the Runners Up.
17. The Winner and the Runners Up will be notified by telephone and email on or before 26/05/15. The Winner and Runners Ups' names will be published in The Australian on 15/06/2015.


18. The Promoter’s decision in relation to any aspect of this Promotion is final and binging and no correspondence will be entered into.


19. The Major Prize is a trip for two (2) adults (aged 18 years and over) to Switzerland valued at up to AU$12,000 (including GST), with the exact value of the Major Prize depending on date and point of departure (Major Prize). The Major Prize includes:


two (2) return economy flights (including any applicable airport/airline taxes) from the Winner’s nearest capital city to Zurich, Switzerland;


ten (10) nights minimum three (3) star accommodation (twin share) in Zurich for two (2) adults (Hotel);


attendance at a “Meet and Greet with Rodger Federer” event (details TBC, subject to Roger Federer's availability);


participation in a Lindt chocolate workshop at the Lindt head office in Kilchberg; and transfers to and from airport in Zurich to Hotel.


20. Spending money, additional meals, additional taxes, insurance, passports, visas, vaccinations, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included.
21. The Promoter requires the Winner and his/her travelling companion cover themselves with full travel insurance valid for international travel. Receipt of insurance for each person travelling must be supplied to the Promoter prior to travel. Should the Winner and his/her travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver prior to travel.


22. All components of the Major Prize must be taken together in a single trip and cannot be redeemed separately. Any part of the Major Prize that is not taken for any reason is forfeited. The Major Prize cannot be exchanged for other travel, flights or accommodation at other destinations.


23. Major Prize must be taken during July - December 2015, with the exact travel dates to be determined and confirmed by the Promoter closer to the actual travel dates and subject to booking and flight availability. Itinerary to be determined by the Promoter in consultation with the Winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary of the Major Prize in its sole discretion.


24. The Winner also acknowledges and agrees that the "Meet and Greet with Roger Federer" component of the Major Prize is subject to Roger Federer's availability, which is outside the Promoter's control.


25. All aspects of the Major Prize (including transfers and accommodation) are for the Winner and his/her nominated companion travelling together at all times. The Winner and his/her companion must depart from and return to the same departure point and travel together. Frequent flyer or other loyalty / reward points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of the relevant individual prize and service providers providing each component of the Major Prize. The Winner acknowledges that she / he may be required to present his/her credit card at time of accommodation check in.


26. Runner Up Prize: Each Runner Up Prize consists of a one-year supply of Lindt Lindor chocolate balls comprising one (1) delivery valued at AU$1,120 (RRP) (including GST). Flavour of the Lindt Lindor chocolate balls selected at the promoter’s digression and subject to availability.


27. Each Runner Up Prize will be delivered to the nominated residential address of the Runner Up, as provided in the Runner Up's entry form. The Runner Up Prizes will be delivered to the Runners Up on or before 19/06/2015. A valid street residential address must be provided. The Promoter will make all reasonable efforts to deliver the Runner Up Prizes to the addresses provided. Due to the perishable nature of the Runner Up Prize, the Promoter recommends that the Runners Up are present at their nominated residential addresses to receive the delivery of the Runner Up Prizes to ensure it is properly received and stored. The Promoter takes no responsibility for any damage or deterioration in the Runner Up Prizes post-transit. Any Runner Up Prize which is damaged, or deteriorates, post-transit will not be substituted or replaced by the Promoter.


28. If the Promoter is unable to contact the Winner or any of the Runners Up to claim fulfilment of the Major Prize or Runner Up Prizes (as applicable) within 14 days of the Judging, that Winner or Runner Up (as applicable) will forego their prize in its entirety and the relevant prize will be awarded to the next best entry as assessed by the judges during the Judging.


29. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.


30. If Roger Federer is unavailable for the Meet and Greet in Switzerland due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel the Meet and Greet component of Major Prize.
31. Total prize pool value is up to AU$73,600 (including GST).


32. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.


33. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the Winner or a Runner Up (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.


34. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.


35. Any cost associated with accessing the Website is the entrant’s responsibility and is dependent on the Internet/data service provider used.


36. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.


37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion or as a result of accepting or using the Major Prize or Runner Up Prizes. If the Promoter (including its respective officers, employees, agencies and agents) fails to comply with a Non-Excludable Guarantee, there may be remedies available to you, including under the Competition and Consumer Act 2010 (Cth).


38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), including problems with internet or network congestion, injury or damage to an entrant's or another person's computer related to entry into this Promotion; (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the “meet and greet” with Roger Federer is postponed/cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by the Winner or a Runner Up or entrant; or (g) use or taking of a prize.


39. As a condition of accepting the Major Prize, the Winner (and his/her companion) must sign any legal documentation as, and in the form, required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.


40. All entries become the property of the Promoter.


41. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. By entering, entrants consent to the Promoter, until such time as they withdraw their consent by giving notice to the Promoter, using the information for conducting the Promotion, contacting the entrant in relation to the Promotion, publishing the Winner and Runners Ups' names in accordance with paragraph 17 of these Terms and Conditions, promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information by contacting the Promoter on 02 8268 0026. The personal information collected in connection with this Promotion will be used, stored and disclosed in accordance with the Promoter’s Privacy Policy, available at http://www.lindt.com.au/swf/eng/privacy-policy/. The Promoter's privacy policy also contains information about how entrants can make a complaint.
