HOYTS KIOSK ‘FINDING MR GREY’ PROMOTION

 

TERMS AND CONDITIONS

 

1. Information on how to enter and prize details form part of these Conditions of Entry. Any entry not complying with these terms and conditions is invalid Entry into the ‘HOYTS KIOSK FINDING MR GREY’ is deemed to be acceptance of these Conditions of Entry.

 

2. Entry is only open to residents of Australia that are registered followers of HOYTS Kiosk (@hoytskiosk) on Instagram and Facebook and must be at least 13 years old (“Eligible Entrant”). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

3. The “Finding Mr Grey” competition commences on Wednesday 6 May 2015 at 12:00pm AEST and closes 11:59pm AEST on Tuesday 9 June 2015 (“Competition Period”). All Entries must be received during the Competition Period

 

4. There is one prize to be won during the competition period; A trip for 2 adults to the Whitsundays that includes:

• Return airfare to Hamilton Island from nearest major airport
• 4 nights at the 4-star Hamilton Island Resort in a Coral Sea View Room
• Buffet breakfast daily
• Return airport / launch transfers
• Full day trip with Cruise Whitsundays to the Great Barrier Reef
• Based on travel: Departing 15 May - 14 August, 23 - 31 August, 1 - 22 December 2015, 17 January - 5 February, 16 February - 24 March 2016.

Total prize pool value = $5,000.00 (ex Perth)

 

5. Prize value is correct at time of print. Prizes are not transferable, not exchangeable, cannot be taken as cash and are not valid with any other offer.

 

How to Enter

6. To enter the Competition, an Eligible Entrant must upload a photo of their stylish ‘Mr Grey’ to the HOYTS Kiosk ‘Fifty Shades’ Facebook competition page for your chance to WIN! Optional to tag @HoytsKiosk.

 

7. There is a limit to one entry per person, to be considered an Eligible Entrant. Any entry that is made on behalf of an entrant by a third party will be invalid. All entries must be submitted by a person with his/her own Facebook account and any automated entries, fraudulent entries or entries by persons using an alias shall be invalid.

 

 

How Winners Will Be Determined

8. This is a game of skill and chance plays no part in determining the winner. All valid entries received during the Competition Period will be judge by a panel of judges from Hoyts and Universal Sony Home Entertainment.

 

9. Judging will be based on the most creative photo entry and whether the entry complies with these terms and conditions, including sections 17, 18, 19 and 20.

 

10. Judging will be completed at the offices of the Promoter at 12:00pm Tuesday 9th June 2015. The Winner will be notified on Wednesday 10th June 2015 in writing via email or social media message. The Promoter will notify the winner of the process of claiming the prize.

 

11. The judges have absolute discretion in their determinations and their decisions are final. No correspondence will be entered into.

 

12. In the event that any entrant does not claim his or her Prize within 30 days of written notice being given, the judges may reallocate the Prize to the next most creative entry received within the competition period in which the unclaimed prizes pertains to, that has not yet received a Prize.

 

13. The Promoter reserves the right to request the winner (or entrant) to provide proof of identity and age, proof of residency and proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

 

14. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant:
a. who tampers with the entry process;
b. who the Promoter has reason to believe has breached these terms and conditions;
c. who submits an entry that is not in accordance with these terms and conditions;
d. who has, in the opinion of the Promoter, engaged in any unlawful or other improper conduct which jeopardises, or may jeopardise, the fair and proper conduct of the competition; and/or
e. who has engaged in conduct in entering the competition which is unlawful, fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoter.

 

15. The Promoter reserves the right to disqualify an entrant or the winner if the Promoter becomes aware that the entrant or winner and/or the winner’s entry is of a type described in this section or is otherwise not in accordance with these terms and conditions. The Promoter’s legal rights to recover damages or other compensation from such disqualified persons are reserved.

 

16. The Promoter may, in its sole discretion, determine whether an entry will be posted, or remain posted on the HOYTS Kiosk Facebook, Instagram, Twitter or Google Plus page in its absolute discretion, including if notified that the entry breaches any provision of these terms and conditions.

 

17. Entrants warrant and agree that their entry, including all content of the entry and their photograph (collectively referred to as the “Entry Content”), will at all times be:
a. the original independent creation of the entrant;
b. exclusively and solely owned by the entrant (including the copyright therein); and
c. free of any claims, including copyright or trademark claims by other parties.

 

18. Entrants warrant and agree that their Entry Content (in whole or in part) have not been published previously; do not and will not infringe any third party rights (including intellectual property rights or rights of privacy, publicity or confidentiality); are not unlawful, fraudulent, defamatory, obscene, profane, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, insulting, scandalous, inflammatory, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication or objectionable; will not contain viruses or cause injury or harm to any person or entity.

 

19. Entrants warrant and agree that they:
a. will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems;
b. have the full authority to grant to the Promoter the rights referred to in these terms and conditions; and
c. they are fully responsible for their Entry Content.

 

20. Entrants hereby grant the Promoter and the Promoter’s personnel, representatives, contractors, agents and related entities, a non-exclusive, perpetual, irrevocable, royalty-free, world-wide licence to use their Entry Content (and the intellectual property rights therein, including copyright) for the purpose of this competition and related marketing and publicity purposes. The owner of any copyright in the Entry Content consents to any use of the Entry Content which may otherwise infringe the owner’s moral rights, pursuant to the Copyright Act 1968 (Cth).

 

21. Consideration for the Promoter accepting the entrant’s entry, the entrant releases and forever discharges the Promoter from all claims that the entrant may have or may have had but for this release arising from or in connection with:
a. any entrant’s participation in this competition (including the Entry Content itself);
b. the Promoter’s use or attempted use of the Entry Content; and
c. the winner’s acceptance and/or use of the prize.

 

22. The entrant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in this competition), arising as a result of or in connection with:
a. the entrant’s participation in this competition;
b. the entrant’s non-compliance with these terms and conditions (including a breach of any warranties contained in these terms and conditions); and/or
c. the entrant’s acceptance or use of the prize.

 

23. In this section 22, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising

 

24. All entrants acknowledge that the Promoter can rely on these terms and conditions even if the Promoter only learns of a person’s ineligibility to enter after the Promoter has awarded a prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.


25. Entrants agree that if a prize winner fails to comply with these terms and conditions, the Promoter may at its discretion award the prize to another entrant in accordance with these terms and conditions or may choose not to award such prize.


26. If for any reason this competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures, vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, adverse publicity, or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness, operation or integrity of this competition, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify or suspend this competition.


27. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to entrants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.


28. Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes;
a. accepts no responsibility for late, lost or misdirected entries; and
b. will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss or damage or loss of opportunity) or for any personal injury suffered or sustained in connection with any aspect of this competition or the acceptance, collection and/or use of, or participation in, the prize, except for any liability which cannot be excluded by law.


29. This section 27 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.


30. Promoter collects personal information from entrants to enable entrants to participate in this competition and the Promoter uses this personal information for the administration of this competition and prize fulfillment. The Promoter may disclose an entrant’s personal information to the Promoter’s employees, contractors, agents, and affiliates for the purposes of administering this competition and for prize fulfillment, but no further use of this information will be made without prior consent. All personal details will be held in accordance with the HOYTS Privacy Policy, which can be accessed by visiting http://www.hoyts.com.au/common/footer/privacy_policy.aspx.


31. By the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s decision in relation to any aspect of this competition is final and no correspondence will be entered into.


32. Entrants unconditionally and irrevocably release and discharge Instagram, Facebook, Twitter and Google Plus from any and all liability in relation to this competition. Entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter and Google Plus. Entrants acknowledge that any information provided by entrants is provided to the Promoter and not to Instagram, Facebook, Twitter and Google Plus.


33. These terms and conditions constitute the entire agreement of the parties relating to the entry and the conduct of this competition. The laws of Australia apply to this competition to the exclusion of any other law and entrants submit to the exclusive jurisdiction of the courts of Australia.


34. The Promoter is The Hoyts Corporation Pty Ltd ABN 31 006 082 551 of Level 50, 680 George St Sydney NSW 2000.

 

Travel Terms and Conditions


35. Prices are correct as at 15 April 2015 are subject to change at any time without notice.

 

36. Prices are per person based on twin share.

 

37. Valid for sale until 31 March 2016.

 

38. Package price is based on travel wholly within the travel dates (Departing 15 May - 14 August, 23 - 31 August, 1 - 22 December 2015, 17 January - 5 February, 16 February - 24 March 2016.)

 

39. Valid for new bookings only.

 

40. Any changes to above package will require a re-quote by Flight Centre.

 

41. Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.

 

42. ALL PRODUCT IS SUBJECT TO AVAILABILITY.

 

43. Promoter not responsible for any airfares to reach flights to Hamilton Island departing from Adelaide, Brisbane, Melbourne, Perth or Sydney.

 

44. Winner must provide minimum 60 days notice of intention to travel.

 


45. The prize does not cover regional flights or any flights/accommodation or other costs associated with travel to/from your place of residence to nearest capital city airport point of departure. Prize does not include, items of personal nature, meals and beverages unless otherwise stated, laundry, telephone calls, additional nights or room upgrades and upgrades and all other ancillary costs associated with redeeming the prize other than those specified.

 


46. All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Flight Centre Limited upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers.

 


47. The Promoter, prize provider and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent any winner and/or their companion from participating in the Activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

 


48. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.

 


49. The competition is open to Australian Residents. If the winner is under the age of 18 years the prize may be awarded, at the absolute discretion of the promoter, to their parent or legal guardian. In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over.

 


50. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the promoter.
