Network TEN Disney Tomorrowland Competition
Terms and Conditions
1.
Information  on  how  to  enter  forms  part  of  the  terms  of  entry.    Entry  into  the  Disney Tomorrowland Competition ( “Competition”) is   deemed   acceptance   of   these   terms   and  conditions.
Eligibility to Enter
2.
Entry  is  open  to  all  residents  of  Australia,  however  employees and  the  immediate  families  of
Network Ten Pty Limited (the “Promoter”) and their associated agencies and companies or any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
3.
Entrants  under  18  years  of  age  must  have  the  prior  approval  of  their  parent  or  guardian  to enter.
Competition Period
4.
The competition commences on Sunday 17 May 2015 at 11:00AEST and closes on Saturday 30thMay at 23:30 AEST (“Competition Period”)
5.
The Competition will be advertised on, but not limited to, Network TEN, www.tenplay.com.au
How to Enter
6.
In order to enter, viewers must watch The Project (“the Program”) on the Ten Network during the  Competition  Period.   Throughout  the  Competition  Period  there  will  be  a  competition segment  aired  during  the  Program (or  any  replacement program broadcast in The Project’s timeslot) which will disclose a code word. 
7.
To participate in the Competition entrants must either:
a.
Send a text message to 1999 2222with a code word plus their full name and full address
or
b.
Log  on  to  tenplay.com.au and provide a code  word,  as  well  as  registering their  details
including (but not limited to) name, address, phone number, email address, gender and
interest, to become a TENPlay member.
8.
It is free to become a TENPlay member, however, the cost of accessing the promotional website is dependent on the entrant’s individual service provider.  These Terms and Conditions apply in conjunction with the TEN Members rules.
9.
SMS  entrants  must  have  Premium  Services  enabled  by  their  mobile  phone  carrier  to  enter. 
Entrants  will  be  charged  $0.55  (inclusive  of  GST)  per  entry  (Mercury  Mobility  Pty  Ltd  SMS Helpline 1300914815).
10.
Incomprehensible and incomplete entries will be deemed invalid.
11.
A  limit  of  one  online entry  per  day  per  TENPlay  member  applies.    SMS  entrants  may  enter  as
many times as they like.

12.
For clarity, an entrant can use  any code word announced during the competition period when lodging their entry.
13.
Entries  must  be  received  by Saturday  30  May2015at  23.30AEST to  be  included  in  the  Prize Draw.    Each valid entry  received  over  the  duration  of  the  Competition  Period  will  be  entered into the Prize Draw. 
14.
The time of entry will,in each case,be the time the online entry is received by the Promoter’s database  and/or
the  time  the  SMS  entry  is  received  in  the  Mercury  Mobility  database.    The Promoterand Mercury Mobility Pty Ltd accept no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
15.
The Prize Draw will be held on Monday 1June 2015 at 10:00 AEST at Mercury Mobility Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000.
16.
The  major  prize  winner  will  be  notified  by
email,  in  writing and a  phone  call,  dependent  on these  details  being  provided,within  two  (2)days of  the  draw.  The winner’s details will be
published on the
TENPlay website at tenplay.com.au from Tuesday 2ndJune2015.
17.
Should an entrant’s contact details change during the promotional period, it is the entrant’s
responsibility to notify the Promoter.  A request to access or modify any information provided in an entry should be directed to the Promoter.
18.
An entry that is made on behalf of an entrant by a third party will be invalid.
19.
If  required, an  unclaimed  prize  drawwill  take  place  at Mercury  MobilityPty  Ltd,  Level  1,  16 Anster  Street, Adelaide,  South  Australia  5000  on Tuesday 1stSeptember2015  at  10:00 AEST.
The unclaimed prize winner/s will be notified of their prize in writing and winner’s details will be
published on the TENPlay website at tenplay.com.au from Wednesday 2September2015.

The  total  Prize  Pool  is  valued  at  $13,797.96(including  GST).   
The  Promoter  accepts  no responsibility for change in prize value between now the ultimate prize redemption date.
22.
Any  ancillary  costs  associated  with  redeeming  the  prize/sare  not  included.    These  are  the
responsibility of the winner.
23.
All prizes are non-transferrable. No cash alternative is available for any prize.
24.
The  Major  Prize  winner and  their  companion  are  responsible  for  all  other  expenses  including spending money (unless specified), meals (unless specified), drinks, transfers (unless specified),
laundry  charges,  activities  (unless  specified),  incidentals,  taxes  (excluding  departure  and  any
other  flight  associated  taxes  included  within  the  prize),  energy  surcharges,gratuities,  services charges and all other ancillary costs. 
25.
The  Major  Prize  winner  and  their  travelling  companion/smust  travel  at  the  same  time,  must
depart from the same capital city and are responsible for transport from their residence to their
nearest capital city for flight departure.  It is the winners’ responsibility to organise transfers to
and from the winnerand their travelling companion’s residence and nearest capital city.
26.
Network TEN makes no representation as to the safety conditions or other issues that may exist
at any destination.
International travel advice can be obtained from various sources, including
government,  local  consular  offices  and  the  web  site  of  the  Australian  Department  of  Foreign
Affairs and Trade.at www.dfat.gov.au.
27.
In the unlikely event that a prize should becomeunavailable(due to force majeure or prize not being  suitable  for  the  winners,  etc), DJP  Marketing  &  Promotions  Ltd. reserves  the  right  to
substitute  the  prize  for  a  prize  of  equal  value,  subject  to  any  directions  given  under  State
Regulation.
28.
Once prizes  have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
29.
The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of
the  prize,  if  the Promoter  determines,  attheirabsolute  discretion,  that  a  winner is  not  in  the
mental or physical condition necessary to be able to safely participate in the prize.

30.
Prizes
must  be  taken  as  offered.   
Any
prize,  or  any  unused  portion  of
any
prize,

not
exchangeable or cannot be re

The  winner,  and  their  travelling  companion/s,  must  be  in  possession  of  a  valid  5

passport, and must have a minimum of 90 days validity remaining on the passport for the
duration of the prize holiday.

It  is  the  responsibility  of  the  winner

The Promoter and
DJP Marketing
& Promotions Ltd. do not accept responsibility
or cost
for these documents being obtained.
33.
The
winner
and their travelling companion/s must provide a copy of their passports

to ensure names are spel

correctly and
valid
passports
are held for all travellers in accordance
with these terms and conditions

34.
In  acceptance  of  the  prize,  the  Winner  acknowledges  that  they  may  incur  ongoing  costs
associated with the prize which are
the entire responsibility of the winner.
35.
The  Major  prize  winner  and/or  their  companion  may  be  required  to  provide  a  credit  card  pre
-
authorisation or cash deposit to cover any incidentals. Once accommodation vouchers are issued
they are non
-
changeable.
36.
In
dependent  financial  advice  should  be  sought  as  tax  implications  may  arise  as  a  result  of
accepting the prize.
37.
Prizes will be awarded to the person named in their contestant entry.  Should an entrant’s
contact details change during the Competition Period i
t is the entrant’s responsibility to notify
the  Promoter.   A  request  to  access  or  modify  any  information  provided in  an  entry  should  be
directed to the Promoter.
38.
The Promoter’s decision is final and the Promoter will not enter into correspondence regardin
g
the Competition result.
39.
It  is a  condition  of  accepting  the  prize  that  the  winner  must  comply  with  all  the  conditions  of
use of the prize and the prize supplier’s requirements.
40.
Personal  information  about  all  prize  winners  will  be shared  with  the
prize  p

agents, to the extent necessary for prizes to be delivered to the prize winners.

It is a condition of accepting the prize the winner may be required to sign a legal r
elease in a
form determined by T

romoter in its absolute
discretion.
42.
The  Promoter  of  this  competition  has  hired  DJP  Marketing  &  Promotions  Ltd.  to  handle  the
complete fulfilment of the grand prize holiday.
DJP Marketing & Promotions Ltd. is registered in
the  UK.  Company  Registration  Number:  8065185,  and  regist
ered  to  address  107  Bell  Street,
London NW1JTL, England.
43.
The  winner  will  be  required  to  provide  three  (3)  separate  dates  of  preferred  travel,  and  DJP
Marketing & Promotions Ltd. will work towards fulfilling at least one of the winners preferred
travel  da
tes.
Winners  must  give  at  least  sixty  (60)
days’ notice
prior  to  their  requested
departure dates.
44.
Dates  of  travel  within  holiday  periods  are  subject  to  availability.
Blackout  dates  will  apply
unless  specifically  pre
-
arranged  prior  to  the  competition  be
ing  run.  Blackout  dates  include
Christmas, Easter and summer holidays.
The airline carrier is at the discretion of the Promoter.
Any  requests  for  a  preferred  carrier  are  not  guaranteed.  If  granted,  it is  the winners’
responsibility to cover any additional
costs. Once flights are booked they cannot be changed. If
booked flights are changed, it will be at the expense of the winner.
45.
Once  confirmed  in  writing,  travel  dates  and  names  of  those  travelling  are  not  changeable
without incurring extra fees. The Promo
ter and DJP Marketing & Promotions Ltd. do not accept
responsibility  for  any  fees  incurred  as  a  result
of  any
changes  made
and
these  costs  will  be
borne
by the winner and their companion/s.
46.
Travel is valid for twelve (12) months from the initial draw date.
47.
Winners  who  do  not  travel  within  twelve  (12)  months  will  become  null  and  void  and  will  no
longer be entitled to their grand prize.
48.
The winner and their companion/s must sign a legal indemnity form, provided by DJP Marketing
& Promotions Ltd., prior to departure as standard procedure.
49.
DJP Marketing & Promotions Ltd. have offered the grand prize in good faith.
50.
If  for  any  reason  this
Competition  is  not  capable  of  running  as  planned,  including  due  to
infection  by  computer  virus,  bugs,  tampering,  unauthorised  intervention,  fraud,  technical
failures  or  any  causes  beyond  the  control  of  the  Promoter,  which  corrupt  or  affect  the
administrat
ion, security, fairness or integrity or proper conduct of this promotion, the Promoter
reserves the right in its sole discretion to disqualify any individual who tampers with the entry
process, take any action that may be available, and to cancel, terminat
e, modify or suspend the
Competition.
51.
If your entry is selected as a winning entry, validation of your circumstances, the validity of your
entry  will  be  undertaken  by  the  Promoter
.    M
ethod  of  validation  (without  limitation)  will  be
determined by the Promo
ter in its complete discretion.  If the winning entry is deemed to be a
winner
, the
winner will be notified as per the terms and conditions herein.  In the event that the
Promoter requests the entrant to sign any legal documents relating to the verificatio
n of their
medical circumstance
, the
legal documents will take the form determined by the Promoter.  It is
a condition of accepting the prize the winner signs
any such legal documentation.
52.
Nothing in these Terms and Conditions limits, excludes or modifies
or purports to limit, exclude
or   modify   the   statutory   consumer   guarantees   as   provided   under   the   Competition   and
Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer
protection laws in the State and Territories of Au
stralia (“Non
-
Excludable Guarantees”).   Except
for any liability that cannot by law be excluded, including the Non
-
Excludable Guarantees, the
Promoters   (including   its   respective   officers,   employees   and   agents)   excludes   all   liability
(including negligence)
, for any personal injury; or loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the promotion.
53.
Except   for   any   liability   that   cannot   by   law   be   excluded,   including   the   Non
-
Excludabl
e
Guarantees,  the  Promoters  (including  its  respective  officers,
employees
and  agents)  is  not
responsible for an excludes
all liability (including negligence), for any personal injury; or any loss

or  damage  (including  loss  of  opportunity);  whether  direct,  i
ndirect,  special  or  consequential  ,
arising  in  any way  out  of:   (a)  any  technical  difficulties  or  equipment
malfunction  (whether  or
not  under  the  Promoter’s  control);  (b)  any  theft,unauthorised   access   or   third   party interference:  (c)  any  entry  or  prize  claim  that  is  late,  lost,  altered,  damaged  or  misdirected
(whether or not after their receipt by the Promoters)due to any reason beyond the reasonable
control  of  the  Promoter;  (d)  any  variation  in  prize  value  to  that  stated  in  these  Terms  and
Conditions;
(e)
any tax liability incurred by a winner or entrant; or (f) use of the prize.
54.
If  this  promotion  is  interfered  with  in  any  way  or  is  not  capable  of  being  conducted  as
reasonably anticipated due to any reason beyond the reasonable control of the Promoters, t
he
Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to
disqualify  any  entrant;  or  (b)  subject  to  any  written  directions  from  a  regulatory  authority,  to
modify, suspend, terminate or cancel the promotion, as a
ppropriate.
55.
All entries become the property of the Promoter.  The Promoter collects personal information
about you to enable you to participate in this promotion but no further use of this information
will be made without prior consent.
56.
You   consent   to   Th
e   Promoter   collecting   your   personal   information   for   the   purpose   of
conducting  and  promoting  this  Competition  (including  but  not  limited  to  determining  and
notifying the winner and prize fulfilment).  Your personal information may be disclosed to third
part
y service providers for this purpose.  Your personal information may be disclosed to State
and Territory lottery departments and winners’ names published as required under the relevant
lottery  legislation.    For  purposes  of  public  statements  and  advertiseme
nts  The  Promoter  will
only publish the winner’s surname, initial and State.  A request to access, update or correct any
information  should  be  directed  to  the  Promoter.    If  you  are  not  willing  for  this  to  occur  you
cannot participate in the promotion.

Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth)
and  by  entering  the  Competition,  you  (the  entrant)  are  taken  to  consent  to  Network  Ten  Pty
