One Two Free + Win a Weekend Away

A good coffee is something worth sharing but a Muffin Break coffee is worth sharing with the ones you love. That’s why we are offering you a special offer to share – One Two Free, buy any two Coffees and get a free Muffin.

Offer is valid at all Muffin Break stores in Australia from the 6th July until the 9th August 2015 inclusive. Not valid with any other offer. Excludes savoury muffins and babycinos.

Plus those who do bring a friend and take-up this offer will be rewarded with the chance to win a weekend away for two, another way we allow you to share great moments at Muffin Break.

There will be three holidays to be won nationally. Winners will be chosen based of the best and most creative answer to – Who would you like to share a coffee with, where and why?

The winners will have a choice of three locations; The Hunter Valley, Margaret River and The Yarra Valley. Each weekend away will include some very special extras; including a luxury dinner for two, a day spa treatment, wine tour and car hire.

TERMS AND CONDITIONS
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is
deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian and New Zealand residents aged 18 years or over. Employees (and their immediate families)
of the Promoter, participating Muffin Break stores and agencies associated with this promotion are ineligible to enter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by
adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother,
step-sister or 1st cousin.
3. Promotion for Australian residents commences on 06/07/2015 and ends at close of business (for in-store entries) and last
mail received (for mail entries) on 10/08/2015 (“Australian Promotional Period”). Promotion for New Zealand residents
commences on 03/08/2015 and ends at close of business (for in-store entries) and last mail received (for mail entries) on
07/09/2015 (“NZ Promotional Period”).
4. To be eligible to enter, individuals must purchase, any two (2) coffees of any size in a single transaction from any Muffin
Break store in Australia or New Zealand during the relevant Promotional Period (“Qualifying Transaction”).
5. To enter, individuals must then complete the official entry form, including an answer to the question “Who would you like to
share a coffee with, where and why?” in 25 words or less and then either:
Australian Residents:
 Place the competed entry form in the entry box provided in store by close of business on 10/08/2015; or mail the
completed entry form to The Director – Operations and Marketing, Foodco Group PTY LTD, Reply Paid 303, Double
Bay, NSW, 1360 by last mail received on 10/08/2015.
New Zealand Residents:
 Place the completed entry form in the entry box provided in store by close of business on 07/09/2015; or mail the
completed entry form to Muffin Break Competitions, PO Box 137228, Parnell, Auckland 1151 by last mail received
on 07/09/2015.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age
and/or place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has
reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any
unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and
omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage
does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from
such an offender are reserved.
7. Incomplete or illegible entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of
the number of coffees in excess of two (2) purchased in that Qualifying Transaction. For the removal of doubt, if an entrant
purchases four (4) coffees in a single transaction, the entrant will only be entitle to one (1) entry form; (b) each entry must be
substantially unique; and (c) each entry must be submitted separately and in accordance with entry requirements.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the
identity of the entrant.
10. The judging will take place at Foodco Australia, Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore
Park NSW 1360 from 17/08/2015 (for Australian residents) and at Foodco New Zealand, Level 2, 92 Parnell Road, Auckland
1052 from 14/09/2015 (for New Zealand residents). The judges may select additional reserve entries, which they determine
to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. Winners will be notified by
telephone and email. This is a game of skill and chance plays no part in determining the winners. Each entry will be
individually judged based on literary and creative merit of the answer provided to the promotional question as well as how
the entry demonstrates a shared coffee moment. The Promoter’s decision is final and no correspondence will be entered
into.
11. Entries will be divided into the following groups: Australia and New Zealand.

Prizes (for Australian Residents- 3 total)
12. The best three (3) valid entries, as determined by the judges, from all entries received in Australia will each win a weekend
away for two (2) adults to their choice of destination from the following three (3) options, valued at up to AU$4,000,
depending on their chosen location.
Australia - Option 1: Margaret River Weekend Away:
13. Prize is a weekend away for two (2) adults to the Margaret River in Perth, WA valued at up to AU$4,000 depending on date
and point of departure. Prize includes:
 Two (2) x Return economy airfares from winner's nearest capital city to Perth, WA (if required);
 Two (2) nights twin share minimum 5 star accommodation;
 Breakfast daily;
 3 days car hire including unlimited kilometres (minimum driver’s age is 21 years or over with a full valid unrestricted
drivers licence). In the event that neither the winner or their chosen companion is over the age of 21 and/or does not
have a valid unrestricted driver’s licence the car hire element of the prize will not be included and cash will not be
awarded in lieu of the car hire;
 A gourmet dinner for two (2) adults at Cape Lodge Restaurant up to the value of AU$250;
 A 90minute Massage for two (2) adults at Cape Lodge Spa; and
 A tour for two (2) adults to the regions premium wineries, food and creative establishments.
Australia - Option 2: Hunter Valley Weekend Away
14. Prize is a weekend away for two (2) adults to the Hunter Valley in NSW valued at up to AU$4,000 depending on date and
point of departure. Prize includes:
 Two (2) x Return economy airfares from winner's nearest capital city to Sydney, NSW (if required);
 Two (2) nights twin share minimum 5 star accommodation;
 Breakfast daily;
 3 days car hire including unlimited kilometres (minimum driver’s age is 21 years or over with a full valid unrestricted
drivers licence). In the event that neither the winner or their chosen companion is over the age of 21 and/or does not
have a valid unrestricted driver’s licence the car hire element of the prize will not be included and cash will not be
awarded in lieu of the car hire;
 A full day private Hunter Valley wine tour for two (2) adults (including lunch); and
 A gourmet dinner for two (2) adults at Botanica up to the value of AU$300.
Australia – Option 3: Yarra Valley Weekend Away
15. Prize is a weekend away for two (2) adults to the Yarra Valley in Melbourne VIC valued at up to AU$4,000 depending on date
and point of departure. Prize includes:
 Two (2) x Return economy airfares from winner's nearest capital city to Melbourne, VIC (if required);
 Two (2) nights twin share minimum 4 star accommodation;
 Breakfast daily;
 3 days car hire including unlimited kilometres (minimum driver’s age is 21 years or over with a full valid unrestricted
driver’s licence). In the event that neither the winner or their chosen companion is over the age of 21 and/or does not
have a valid unrestricted driver’s licence the car hire element of the prize will not be included and cash will not be
awarded in lieu of the car hire;
 A 5 course gourmet tasting menu with matching wines for two (2) adults at Eleonore’s Restaurant;
 A 60minute massage for two (2) adults at Natskin Spa; and
 A half day cellar doors tasting with private guide for two (2) adults.
Prize (for NZ residents - 1 total)
16. The best valid entry, as determined by the judges, from all entries received in New Zealand will win a weekend away for two
(2) adults to the Marlborough Region, valued at up to NZD$4,000 depending on date and point of departure. Prize includes:
 Two (2) x Return economy airfares from winner's nearest airport of Auckland, Christchurch or Wellington to Nelson,
Blenheim (if required);
 Two (2) nights twin share minimum 5 star accommodation;
 Breakfast daily;
 3 days prestige car hire including unlimited kilometres (minimum driver’s age is 25 years or over with a full valid
unrestricted drivers licence). In the event that neither the winner or their chosen companion is over the age of 25 and/or

does not have a valid unrestricted driver’s licence the car hire element of the prize will not be included and cash will not
be awarded in lieu of the car hire;
 A full day tour of the Marlborough Region in a convertible Mustang (with driver) for two (2) adults;
 A 60minute massage for two (2) adults at Tracey Wax Beauty & Spa; and
 A 7 course Herzog’s Legendary Degustation dinner for two (2) adults (including Paired wine).
If any winner is from the same State/Territory/Region as their chosen weekend away (as determined by the Promoter), then
the prize does not include airfares and the airfare component of the prize is not redeemable for cash.
Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations,
transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are
not included. Prize must be taken by 17/08/2016 and is subject to booking and flight availability. Prize cannot be taken during
any school holidays, public holidays or other peak periods.
17. Winners (and his/her/their companion) must depart from and return to the same departure point and travel together.
Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize.
Prize is subject to the standard terms and conditions of individual prize and service providers. Winners may be required to
present their credit card at time of accommodation check in.
18. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize
has been booked, take a prize (or an element of a prize) at the time stipulated, then the prize (or that element of the prize)
will be forfeited and will not be redeemable for cash.
19. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or
suspend the promotion, or suspend or modify a prize.
20. All car hire elements are subject to standard rental conditions. Petrol and insurance is not included. The driver must have a
current valid driver’s licence issued in an Australian State or Territory or New Zealand (as required) and meet any age
requirements as specified.
21. If for any reason a winner does not take or claim a prize (or an element of the prize) by the time stipulated by the Promoter,
then the prize (or that element of the prize) will be forfeited.
22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or
that part of the prize) with a prize to the equal value and/or specification.
23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise
specified.
24. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to
comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent
permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever.
Entrants warrant and agree that:
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any
intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually
inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not
suitable for children aged under 15, or otherwise unsuitable for publication;
(b) their Content shall not contain viruses or cause injury or harm to any person or entity;
(c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
(d) the Content is the original literary work of the entrant that does not infringe the rights of any third party;
(e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights
pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright,
content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
25. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a
non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt,
publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional,
marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including
photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose
of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.

27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any
reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised
intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to
disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the
statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied
warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any
statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of
the promotion.
29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s
control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable
control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any organized tour
or activity is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax
liability incurred by a winner or entrant; or (g) taking of a prize, participation in a prize and/or use of a prize.
30. As a condition of accepting a prize, the winner (and his/her companion) must sign any legal documentation as and in the
form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release
and indemnity form.
31. Applicable to Australian Residents Only: The Promoter collects personal information ("PI") in order to conduct the
promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service
providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in
its Privacy Policy, which can be viewed at www.muffinbreak.com.au. In addition to any use that may be outlined in the
Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional,
marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The
Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants
may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will
be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal
information to any entity outside of Australia.
32. Applicable to New Zealand Residents Only: The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service
providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period,
unless otherwise advised, use the information for promotional, marketing and publicity purposes, including sending
electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information
to the Promoter. All entries become the property of the Promoter.
