SPORTSBET’S POMMEL
Terms and Conditions
1. The promoter is Sportsbet Pty Ltd ABN 87 088 326 612, a company incorporated in Australia under the Corporations Act 2001 (Cth), trading as ‘Sportsbet.com.au’ (“Promoter”).
2. This competition (“Competition”) starts at 10.00am (AEST) on Monday 6 July 2015 and will end at 12.00am (AEST) on Monday 13 July 2015, or earlier, in accordance with clause 7. (“Competition Period”).
3. Information on how to enter and the prizes forms part of these terms and conditions (“Terms”). Participation in this Competition is deemed acceptance of these Terms.
4. This Competition is open to all entrants who:
a. are over 18 years of age;
b. are Australian residents;
c. have a Twitter account or Facebook account (“Social Media Account”);
d. comply with Twitter’s and Facebook’s Terms of Service;
e. comply with these Terms; and
f. are not management, employees or agents of the Promoter or its related entities (or immediate family members of such people) or of retailers or agencies associated with this Competition,(“Eligible Entrants”).
5. During the Competition Period, Eligible Entrants can enter the Competition by submitting a witty remark aimed at the English cricket team (nothing beyond friendly banter!) which includes “#Pommel” using their Social Media Accounts to “@sportsbetcomau” or “Facebook.com/sportsbetcomau” (“sledge”). Each sledge will be subject to moderation.
6. Each sledge will be placed in a queue based on the time that it is received by the Promoter, and each sledge will trigger a cricket ball being fired at a piñata from a bowling machine, which can be viewed via live stream at
www.pommel.com.au.
7. The Eligible Entrant whose sledge corresponds to the cricket ball that ‘breaks’ the piñata, causing the piñata to explode (as confirmed at
www.pommel.com.au and not the live stream itself), will be the Major Prize winner. Once the piñata explodes, no further cricket balls will be fired at the piñata, and the Competition will end.
8. To be eligible to win a prize, an Eligible Entrant must:
a. sledge within the Competition Period; and
b. ensure that your sledges comply with these Terms.
9. The live stream is an indication of progress only and will vary according to an individual’s device and internet connection.
10. The Competition will take place during the following sessions each day within the Competition Period: 10.00am-1pm, 1.30pm-4.30pm, 5pm-9pm and 9.30pm-midnight (each a “Session”).
11. Any Eligible Entrant who recruits a new Eligible Entrant to enter into the Competition via email and/or social media will be entered into a draw to win a prize (“Referral Prize”). At the conclusion of each Session, the Promoter will draw one winner using Microsoft Excel’s RAND formula at Level 18, 367 Collins Street, Melbourne, VIC 3000 and each will be awarded a Referral Prize. Eligible Entrants receive one entry into a draw for a Referral Prize for every new Eligible Entrant they recruit during that Session. There will be a maximum of 28 Referral Prizes in the Competition Period. Once the Competition Period ends, no further Referral Prizes will be awarded.
12. Throughout the Competition Period, the Promoter will place 6 objects around the piñata, which will be reset for each Session. The Eligible Entrant whose sledge corresponds to the cricket ball that causes one of these objects to break (as confirmed at
www.pommel.com.au and not the live stream itself) will be awarded a prize (“Crash Prize”). There will be a maximum of 6 Crash Prizes in each Session and a maximum of 70 Crash Prizes in the Competition Period. Once the piñata explodes, no further cricket balls will be fired at the piñata, and no further Crash Prizes will be awarded.
13. There are 99 prizes to be won: 1 Major Prize, 28 Referral Prizes and 70 Crash Prizes (each a “prize”):

14. Maximum of one of each prize per entrant. In the event a winning entrant has already been determined a winner of a prize of the same description, the prize will not be awarded to that entrant, and:
a. in the case of a Referral Prize, the Promoter will repeat the process set out in clause 11 and redistribute that Referral Prize; and
b. in the case of a Crash Prize, that prize will not be awarded in that Session.
15. By Friday 17 July 2015, Promoter will contact each winner via Twitter or Facebook to verify identification and coordinate their Electronic Fund Transfer or cooler postage. If a winner does not respond to Sportsbet’s communications by 17 October, 2015, three months after being contacted, he/she will not to be able to claim their prize.
16. In the event that a winning entrant has failed to contact Promoter in accordance with these Terms, all Eligible Entrants will be entered into a draw to win the unclaimed prizes. The Promoter will draw the winner/s using Microsoft Excel’s RAND formula at 9.00am (AEST) on 19 October, 2015 at Level 18, 367 Collins Street, Melbourne, VIC 3000. The winning entrant/s will be notified via Twitter or Facebook with their name published on the Promoter’s website (
www.pommel.com.au), blog (sportsbet.com.au/blog/) and/or other channels. The first unclaimed prize to be drawn will be the Major Prize (if applicable), followed by any unclaimed Referral Prizes (if applicable), followed by any unclaimed Crash Prizes (if applicable). In the event a winning entrant has already been determined a winner of a prize of the same description, the prize will not be awarded to that entrant, and the Promoter will repeat the process set out in this clause.
17. In the event that the piñata does not break within the Competition Period and the Major Prize remains unallocated, all Eligible Entrants will be entered into a draw to win the unallocated Major Prize at the conclusion of the Competition Period. The Promoter will draw the winner/s using Microsoft Excel’s RAND formula.
General
18. You must:
a. only use a maximum of one Social Media Account on each social network (Twitter and Facebook) to enter the Competition. Anyone found to use multiple accounts on a social media network to enter will be ineligible;
b. only use your Social Media Accounts (and not somebody else’s) to enter the Competition;
c. ensure that your sledge does not include anything which:
i. is or may be offensive, illegal, defamatory, obscene, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, unsuitable for children aged under 18 or otherwise unsuitable for publication;
ii. may infringe the privacy, intellectual property or other rights of any person; or
iii. is likely to or may embarrass any individual or body or bring the Promoter into disrepute.
19. The prizes will be supplied by the Promoter using Electronic Fund Transfer or postage (as applicable). The prizes are provided on an “as is” basis.
20. This Competition is only open to Eligible Entrants who act at all times in good faith, sincerely, without fraud. Any entrant or entry that the Promoter suspects, in its discretion, to be in breach of these Terms or attempting to gain an unfair advantage over other competitors (e.g. by the use of technology) will not be eligible.
21. General:
a. The Promoter reserves the right to cancel or change the Competition at any time throughout the Competition Period without notice.
b. The decisions of the Promoter are final. No correspondence will be entered into.
c. The Promoter reserves the right, at any time, to verify the validity of sledges and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits a sledge that is not in accordance with these Terms or who tampers with the entry process.
d. Incomplete, indecipherable or illegible entries will be deemed invalid.
e. There will be a maximum of 99 prize winners in this Competition.
f. The total prize pool has a maximum value of $21,896.50. If any prize or any part of a prize is unavailable, the Promoter reserves the right to substitute it with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
g. The winners’ names will be published on the Promoter’s website (
www.pommel.com), blog (sportsbet.com.au/blog/) and/or other channels.
h. The prizes (or any part thereof) are not transferable or redeemable for something other than cash or coolers.
i. Entry to the Competition is free, but entrants are responsible for any costs imposed by their internet service or other technology providers.
j. The Promoter may prohibit an entrant’s participation in this Competition, cancel or suspend the prize (or part thereof) if the Promoter considers that the entrant behaves in a way which may diminish its name or reputation, is in bad faith, is designed to gain an unfair advantage, is fraudulent, is otherwise contrary to law or these Terms, or is otherwise inappropriate.
k. Errors and omissions may be accepted at the Promoter’s discretion.
l. The Promoter accepts no responsibility for any tax implications that may arise from the prizes. Independent financial advice should be sought. Where the operation of this Competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
m. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter’s control, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, to the fullest extent permitted by law: (a) to disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition.
n. The Promoter may collect personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use entrants’ information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to entrants. Entrants should direct any request to opt out, access, update or correct information to the Promoter at
customerservice@sportsbet.com.au.
o. To the fullest extent permitted by law, the Promoter (and the prize suppliers) will not be liable for any loss or damage an entrant or winner suffers as a result of participating in this Competition (including the prizes), unless caused by the Promoter’s negligence or wilful misconduct.
