WIN A DREAM CAMPER ESCAPE COMPETITION
TERMS AND CONDITIONS
On entering this competition you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
1.2 This is a game of chance and the winner will be drawn randomly.
2. WHO CAN ENTER?
2.1 Subject to clause 2.3, entry is open only to residents of New Zealand and Australia over 21 years of age with a full driving licence held for over 12 months.
2.2 Entry will entitle you to 1 entry in the draw if you share your entry with another via email or facebook link. However, for you to be included in the draw, your friend must complete their entry from your invite link.
2.3 Employees and families of the Promoter or the prize suppliers or any of their agencies associated with the Competition or Program are not eligible to enter. This includes a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption)
3. HOW TO ENTER
3.1 Entrants can enter via win.gobycamper.com and select their dream camper escape from the nine options. Entrants will then enter their details and invite a friend to enter the competition via referral link and when they do, the entrant will be in the draw to win their chosen trip. Unless the entrant chooses to opt out, they will be automatically added to the thl / Go By Camper database
3.2 Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.
CRITICAL DATES
3.3 The competition commences on 10 July 2015 and closes at 5pm on the 31 August 2015.
3.4 The prize draw will take place at Tourism Holdings Australia Pty Ltd trading as Britz Campervans, Central West Business Park, Building 2, 9 Ashley Street, Braybook VIC at 11am on the 1 September 2015. The winners will be notified by mail, email and the winner's name will be published on
www.facebook.com/gobycamper on 3 September 2015.
3.5 If any prize is unclaimed a redraw will take place (subject to any directions from a regulatory authority) at Tourism Holdings Australia Pty Ltd at 11am 15 September 2015. In the case of a re-draw the prize winner will be notified by mail, phone and email and the winner's name will be published on
www.facebook.com/gobycamper on 18 September 2015.
4. THE PRIZE AND DETAILS OF PRIZE DRAW
4.1 There is one (1) prize to be won with a total value of up to AU$5000
4.2 No purchase is required to enter.
4.3 The first valid entry randomly drawn from the pool will win their chosen Dream Camper Escape in New Zealand or Australia
4.4 The prize is valid from the 1 September 2015 to the 31th August 2016 excluding all Easter and School Holidays in all states and excluding the 15th of December 2015 to the 15th of January 2016.
4.5 The prize redemption is subject to availability at all times.
4.6 The prize includes Britz 2 person self-drive holiday for 10 days (9 nights) (value $3500) with fully equipped campervan, travel wallet and maps, information on extra driver fees, unlimited kilometres, personal kits for living and sleeping, a Britz Bonus Pack including Liability Reduction 2, nil liability, pre-purchase gas, picnic table and chairs.
4.7 The prize also includes return economy flights for two (2) from your nearest capital city to Australia (excluding Broome) or New Zealand Britz location of winners choice (value up to $1400). Additional experiences available depending on dream camper escape selected. Passengers must make their own way at their own cost to the nearest capital city airport.
4.8 The prize does not include a Refundable Safety Deposit of $250 (2WD) / $500 (4WD) which is payable by credit card on collection of the vehicle. Airport transfers are not included. Fuel is not included and any cost for supplies and incidentals are the responsibility of the prize winner.
4.9 If the winner wishes to add extra rental days to the prize a bonus pack/premium package will apply to all of these additional days. An alternative Liability Reduction option for these extra days cannot be selected.
4.10 The prize is not transferable and cannot be redeemed for cash.
4.11 Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.
4.12 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
4.13 In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.
4.14 The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
4.15 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
4.16 As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indem
4.17 The Promoter's decision is final and no correspondence will be entered into.
5. NO LIABILITY
5.1 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible persons understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Person provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook
5.2 CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING .
5.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation
5.4 The Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
5.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
5.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.
5.7 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
5.8 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees'). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
