Terms and Conditions:

1. Information on how to enter forms part of the terms of entry. Entry into the Nissan The Bachelor Competition (“Competition”) is deemed acceptance of these terms and conditions.
Eligibility
2. Entry is open to all residents of Australia who are 18 years of age or older at the time of entry. However, employees and the immediate families of Network Ten Pty Limited (the “Promoter”), Mercury Mobility Pty Ltd, Nissan Motor Co. (Australia) Pty. Ltd. (“Nissan”) and their associated agencies and companies or any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
3. The Competition commences on Monday 27 July 2015 at 14:00 AEST and closes on Sunday 20 September 2015 at 23:59 AEST (“Competition Period”).
4. The Competition will be advertised on, but not limited to, Network TEN, and www.tenplay.com.au.
To Enter
5. To participate in the Competition entrants must:
a. Log on to tenplay.com.au and register their details including (but not limited to) name,
address, phone number, email address, gender and interest, to become a TENPlay member.
6. It is free to become a TENPlay member, however, the cost of accessing the promotional website is dependent on the entrant’s individual service provider. These Terms and Conditions apply in conjunction with the Ten Members rules.
7. A limit of one online entry per TENPlay member per day applies.
8. Entries must be received by Sunday 20 September 2015 at 23:59 AEST to be included in the Prize Draw. Each valid entry received over the duration of the Competition Period will be entered into the Prize Draw.
9. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter and Mercury Mobility Pty Ltd accept no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
10. The Prize Draw will be held on Monday 21 September 2015 at 14:00 AEST at Mercury Mobility Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000.
11. The major prize winner will be notified by a phone call within two days of the draw and in writing. The major prize winner’s details will be published on the TENPlay website at tenplay.com.au from Monday 21 September 2015.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but is not limited to, entrants and households using multiple email addresses, postal addresses, PO Box addresses to register single or multiple entries. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
13. An entry that is made on behalf of an entrant by a third party will be invalid.
14. If required, an unclaimed prize draw will take place at Mercury Mobility Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Monday 21 December 2015 at 10:00 AEDT. The unclaimed major prize winner will be notified of their prize in writing and winner’s details will be published on the TENPlay website at tenplay.com.au from Monday 21 December 2015.
15. Prize
There will be One (1) Major Prize winner who will win a Nissan QASHQAI Ti manual in Ivory Pearl, including all on-road costs.
Total prize value is $36,500.00 (incl GST) and is correct as at the time of writing these Terms and Conditions.
16. Additional options/accessories and all ancillary costs are the responsibility of the winner. Unless expressly stated, all other expenses become the responsibility of the winner.
17. Major Prize Details cannot be changed (ie. model/transmission/colour), and Prize must be accepted as stated above.
18. The Promoter accepts no responsibility for the condition of the Major Prize Vehicle once dispatched to the winner. The Major Prize Vehicle comes with Compulsory Third Party Insurance only and the winner of the Major Prize Vehicle will be responsible for obtaining any additional insurance at their own cost.
19. Prize cannot be transferred (except as detailed in clause 20). Prize cannot be redeemed for cash and must be accepted as provided.
20. If the prize winner does not hold a current Australian Driver’s Licence the prize will be awarded to the adult nominated by the winner, who holds a current Australian Driver’s Licence, on behalf of the winner. The winner may be required to sign a prize transfer – legal release to formalise the transfer.
21. All reasonable efforts will be undertaken to make the Major Prize available for collection by the Major Prize Winner at the nearest authorised Nissan dealer to the Major Prize Winner’s residential address within 28 days of the Major Prize Winner being determined, or such other time as agreed in writing between the Major Prize Winner and Nissan Motor Co. (Australia) Pty. Ltd. in the event there are issues with vehicle stock availability.
22. If the prize is unavailable, for whatever reason, the Promoter, and Nissan, reserve the right to substitute the prize for a prize of equal or greater value, subject to any directions given under State Regulation.
23. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
24. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
25. By accepting the prize, the winner agrees to participate in and cooperate as required with all media editorial requested relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned through the duration of the prize.
26. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN or the advertising or marketing thereof, in any media whatsoever through the world and the winner will not be entitled to any fee for such use.
27. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
28. Prizes will be awarded to the person named in their contestant entry. Should an entrant’s contact details change during the Competition Period it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
29. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
30. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
31. It is a condition of accepting the prize the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
32. In the case of the intervention of an outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
33. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course
the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
34. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engage in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
35. The Promoter, Mercury Mobility Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
36. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under State Regulation.
37. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
38. You consent to The Promoter collecting your personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the winner and prize fulfilment). Your personal information may be disclosed to Mercury Mobility Pty Ltd and third party service providers for this purpose. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements The Promoter will only publish the winner’s surname, initial and State. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.
39. You may choose to opt in to receive information from Nissan Motor Co. With your express consent to do so, Nissan Motor Co. will handle entrant’s personal information (e.g. first name, last name, address, suburb, state, postcode, phone number, email address, gender, date of birth) in accordance with their Privacy Policy which can be accessed at www.nissan.com.au/Privacy. Nissan Motor Co.’s Privacy Policy may be updated from time to time and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. The entrant may at any time, opt out of receiving contact from Nissan Motor Co. by phoning 1800 035 035 or by sending an email to csc@nissan.com.au asking to be removed from their mailing list.
40. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to Network Ten Pty Limited’s privacy policy which contains information, amongst other things, about how you may access personal information that is held by Network Ten Pty Limited about you and seek
correction of such information. See www.tenplay.com.au/privacypolicy to view Network Ten Pty Limited’s APP Privacy Policy in full. Our APP Privacy Policy also contains information about how you may complain about a breach of the APPs, or a registered code that is binding on our organisation and how Network Ten Pty Limited will deal with such complaints. We may disclose your personal information to related entities and third party service providers outside Australia.
