Terms and Conditions
These Terms and Conditions set out the agreement between the Promoter and any person that wishes to enter the Promoter’s “60 Days Around Australia” competition (‘Competition’).
General
1. The Promoter is WTH Pty Ltd t/a Avis Australia (ABN 15 000 165 855) of Level 2, 15 Bourke Road Mascot NSW 2020 ('Promoter').
2. Information on how to enter this Competition and prizes form part of the Terms and Conditions.
3. Entry into this Competition deems acceptance of these Terms and Conditions.
4. To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions prevail.
Who can enter
5. Subject to clause 5, entry into the Competition is open to all residents of Australia who:
5.1 have a full unrestricted Australian driver licence;
5.2 have fulfilled the requirements set out below; and
5.3 accept these Terms and Conditions ('Eligible Entrants' or ‘You’).
6. Employees of the Promoter, immediate family members of the Promoter’s employees, and associated agencies, companies, contractors and individuals are not eligible to enter this Competition. For the purpose of these Terms and Conditions, immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
How to enter
7. Eligible Entrants may enter this Competition during the Promotional Period (defined below) by visiting the Promoter’s Facebook page at
https://www.facebook.com/AvisAustralia and then following the instructions to the Competition entry page to submit an entry form. At the time of entry an Eligible Entrant must specify the individual (‘Companion’) they would like to join them should they be determined to be a winner.
8. It is a condition of eligibility as a Companion that the Companion agrees to these Terms and Conditions and has a full unrestricted Australian driver licence.
9. Entries for the Competition must:
9.1 include all requested contact details for the Eligible Entrant and their Companion;
9.2 include a video submission to the Competition question posed on the Promoter’s Facebook page, along with any requested video or photos from the competition administrator;
9.3 be the entrant’s own original work, and must not have been previously published in any form, anywhere in the world; and
9.4 be received by the Promoter prior to the Competition close date and time.
10. Entries containing and/or depicting illegal, sexually explicit or morally or racially offensive content will be ineligible to win. The Promoter's decision to disqualify an entry is final and no correspondence will be entered into.

Only one unique entry per person will be permitted. Entrants found to be submitting multiple entries may have all entries invalidated.
12. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their Competition entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by Facebook or an entrant in respect of that entrant's participation in the Competition. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook.
When to enter
13. The competition commences on 03/08/15 at 00:01 AM
and closes 22/08/15 at 00:00 AM ('Promotional Period'). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. Entries must be received by the Promoter prior to the competition close date and time.
14. The winners (up to a maximum of four) will be the best valid entries as judged by the judging panel, having regard to skill, creativity and originality, at the Promoter's premises on 30/08/15 at 11:00 AM. The Promoter may select additional entries to be used as replacements in the event that the first entrant chosen as a winner cannot satisfy these Terms and Conditions or take a prize.
15. The winners will be notified by email and or phone. In the event that the prize notification email is returned as undeliverable, such prize will be forfeited and an alternate winner will be selected from all remaining (non-winning) eligible entries. Names of winners may also be published on the Promoter’s Facebook page and/or announced via an electronic newsletter.
16. Prizes will be sent within 9 weeks of the judging date.
Prize on offer
17.
Total prize value is up to $60,920 (Including GST), as at 4/08/15. The prize on offer comprises:
17.1 15 Days Car Hire (including Road Support & Car Insurance), valued at up to $2,666 inc GST
17.2 15 Days meal allowance. This will be provided as a prepaid credit card, calculated on the basis of $120 per person per day.
17.3 15 Days Accommodation Allowance. This will be provided as a prepaid credit card, calculated on the basis of $280 per night ($4200).
17.4 15 Car Allowance – Fuels / Oils / Tolls / Car Cleaning. This will be provided as a prepaid credit card to the value of $1406.00
17.5 15 Days WiFi Access- via a wireless dongle provided. Maximum value: Wifi - Dongle $80.00, Wifi - top ups $700.00 (78 GB), Mobile Phone Call Costs $200.00 (10GB), Extra Bandwidth Allowance $250.00 (20GB) if required.
17.6 5 x Paid activities. Maxiumum value of $2000.00, and will be available via pre-paid credit card.
17.7 15 Days Travel Insurance for two people, valued at $128.00.
17.8 Return economy flights and transfers to the point of departure and from the travel destination to the winner’s nearest capital city.18.
The prize includes travelling, accommodation and meal expenses for two people, complimentary car hire, roadside assistance and internet connectivity. Once issued, any changes to the prize are at the Promoter’s discretion. The prize is non-refundable and non-transferable. No substitutions for the prize will be allowed. All components of the prize must be taken together or otherwise are deemed to be forfeited. Travel is subject to booking availability.19. If the Promoter is unable to contact a winner to claim fulfilment of the promotional prize or if that winner is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the Competition. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into. The Promoter therefore highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
20. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and Promoter’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
21. The prize must be taken on dates and times specified by the Promoter. In the event a winner does not take the prize at the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
22. Obtaining time off work and/or study or related activities to participate in a Competition and/or take a prize will be the sole and absolute responsibility of each winner.
23. The flight portion of the prize(s) are not available to a winner if they reside within 450km of the Competition point of departure, within the same State.
Variation, suspension or cancellation of Competition or prize
24. The Promoter reserves the right to amend these Terms and Conditions if this Competition cannot be run as originally planned. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to applicable laws.
25. Without limiting the application of clause 24, in the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original prize or, subject to any applicable laws, to cancel, terminate, modify or suspend the Competition.
26. The Promoter may also cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this Competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
Waiver, liability and statutory guarantees
27. Except to the extent of any liability that cannot by law be excluded, including the Non-Excludable Guarantees (as defined below), the Promoter, its responsible officers, licensees, employees, contractors and agents will not be liable or responsible and excludes all liability to entrants for any misadventure, accident, injury, loss or claim, whether direct, indirect, special or consequential, arising in any way out of this Competition, including but not limited to:
27.1 any equipment or technical malfunction ,whether or not under the Promoter's control;
27.2 any theft, unauthorised access or third party interference;
27.3 any injury or damage to the entrant's or any other person's computer software or phone, or any combination thereof, related to or resulting from participation in, or sending or receiving of any communication or of any materials in relation to, this Competition;
27.4 any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
27.5 any variation in prize value to that stated in these Terms and Conditions; or
27.6 any tax liability incurred by a winner, an entrant or a Companion.
28. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Competition if the deficiency is caused by or arises as a result of circumstances outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
29. Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’).
Further Terms and Conditions
30. The Promoter reserves the right to request each winner to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, that winner will forfeit the prize in whole and no substitute will be offered.
31. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
32. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to each winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
33. The Competition encompasses the entry mechanic only, meaning that the Competition ends when winners are announced. The prize is the opportunity for two entrants to drive, following a pre-determined route. The prize component is not a competition.
34. Winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
Privacy Collection Statement
35. The Promoter and its related entities collect entrants' personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at

Intellectual property ownership
36. As entrants must submit their own original answers, such answers must not have been previously published in any form, anywhere in the world. Entries that are found to have been derived from third party material or works will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter.
37. Each winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this clause. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter's legal rights to recover damages or other compensation are reserved.
38. All right, title and interest (including copyright) in an entry becomes and remains the property of the Promoter who may publish or cause to be published any of the entries received. Entries will not be returned to entrants. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their Companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
39. The winners must each take photographic and video footage of their trip for use by the Promoter. This includes a minimum of 10 photographs and 2 minutes of video footage each day. The winners must each post the minimum number of images and minimum amount of video footage to the Promoter’s nominated cloud account every day by 4:00pm AEST. Each winner grants the Promoter a perpetual and exclusive licence to use any images and video footage that they have posted to the Promoter’s nominated cloud account for any purpose associated with the Competition or promotion of the Promoter’s products.
40. Each winner is prohibited from publicly posting or communicating footage or images from the trip (including but not limited to those posted to the Promoter’s nominated cloud account) on any other platform or social media service without the prior written consent of the Promoter.
41. Any images or footage taken pursuant to clause 39 containing illegal, sexually explicit or morally or racially offensive content will be grounds for an automatic cancellation of the prize. The relevant winner will have to pay their own passage home from the point of disqualification.
Driving & Licence Requirements
42. You will be bound by the Avis Car Rental Terms and Conditions of Rental in respect of the car hire component of the prize, available at

Failure to abide by the Avis Terms and Conditions of Rental will make you automatically ineligible and you will be disqualified from the prize. Disqualified contestants will have to pay their own passage home from their point of disqualification.
43. Entrants under the age of 25 are not eligible for the Competition or eligible to redeem the prize. Only the winners are permitted to drive the car. Entrants must have a full unrestricted Australian driver licence to be eligible. Entrants with any provisions placed against their licence including but not limited to being under a probation period, will not be deemed eligible.
44. Entrants with a previously disqualified licence due to traffic and driving offences will not be eligible, nor will entrants with a history of drink driving.
45. Drivers must abide by all state and territory road rules, this includes maintaining the speed limit at all times.Any traffic infringements including, but not limited to speeding and parking fines will be the responsibility of the driver. If any driver receives a fine for drink driving, reckless / dangerous driving or use of a handheld device, during the Competition, the driver and their fellow Companion will be automatically ineligible and will be disqualified from the competition. Disqualified contestants will have to pay their own passage home from their point of disqualification.
46. Drivers must operate the car in a safe and controlled manner at all times. Drivers are prohibited from using cameras, video recorders or any other handheld device whilst driving the vehicle.
47. Whilst a guide will be supplied that suggests driving times to navigate between destinations on the route, the guide is simply a suggestion and not a mandatory travel timetable. The guide has been put together keeping in mind the speed limits, traffic laws and a reasonable amount of travel time aggregated for each day.
48. Drivers are required to drive at their own pace between their starting point and their destination. Drivers are required to drive in a safe manner, this includes obeying all road rules and traffic laws. Drivers need to take a 15-minute break for every two hours of driving they do. Drivers are not permitted to drive the car for longer than 30 minutes between 8:00pm – 6:00am.

Medical
50. Entrants must be fit and healthy with no pre-existing medical conditions. Entrants must not have any pre-existing medical conditions which impair their ability to drive and hold a full unrestricted Australian driver licence.
