Terms and Conditions – DEWALT Facebook CompetitionsPromotion
Entry into this DEWALT Competition ("Promotion") constitutes your acceptance of these terms and conditions ("Terms and Conditions").
This promoter is Stanley Black & Decker Australia Pty Ltd (ABN 82 000 021 938) of 82 Taryn Drive, Epping, VIC 3076, Australia ("Promoter").
The Promotion commences at the time of the original post and closes as stated in the original post (“Promotion Entry Period”).
Definitions
In these Terms and Conditions and the Promotion:
(i) 'Entry' means a creative comment &/or photo
(ii) ‘Facebook’ means the social networking site available at
www.facebook.com which members of the public can become of member of (subject to the terms and conditions of Facebook);
(iii) ‘Facebook Account’ means an account with Facebook set up by a Facebook Member;
(iv) ‘Facebook Member’ means a person who has registered, been accepted as and continues to be a member of Facebook (
www.facebook.com) and has agreed to the terms and conditions of that membership;
(v) ‘Prize’ means one (1) DEWALT tool, selected by the Promoter valued at a minimum RRP $10.00;
(vi) All monetary values that appear in these Terms and Conditions are in Australian dollars and represent the recommended retail price or value of each item or product as at the date of the original post inclusive of GST.
Entry
Entry is only open to Australian residents, aged 18 years or over that are current Facebook Members. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. The Promoter reserves the right to verify validity of all entries and eligibility of participants in the Promotion.
This Promotion is free to enter, however, any costs associated with becoming eligible to enter, entering or participating in this Promotion such as internet access, upload or download costs will be at your own cost.
This Promotion involves a skill and chance plays no part in determining the winner.
To enter, you ("the Entrant") must:
(i) log in to your Facebook Account;
(ii) read and agree to these Terms and Conditions;
(iii) upload your Entry as a comment &/or photo as stated in the original post.
Entries must be submitted in the format(s) accepted on Facebook as comments and must comply with the terms and conditions of Facebook as well as these Terms and Conditions.
Completing and submitting an Entry is deemed to be acceptance of these Terms and Conditions.
Multiple Entries or Edited Entries are not permitted. Where a person attempts to submit multiple or subsequent Entries, only the first Entry will be accepted. All subsequent Entries will be disqualified and ineligible for a prize. This includes Entries made by one person from multiple or different Facebook Accounts.
If an Entrant would like to remove their Entry from consideration in connection with the Promotion after it has been submitted, they must request removal via private message on the DEWALT Australia Facebook Page - requests will be attended to within 14 days of the request being made.
All Entries must be received during the Promotion Entry Period. Late, incomplete, indecipherable or ineligible entries will be deemed invalid.
Submission of Entries generally
All Entries uploaded or posted as part of the Promotion must be relevant to the Promotion as determined by the Promoter in their absolute discretion. The Promoter reserves the right to review the Entries and remove and reject any Entry which is offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Promotion or does not comply with any part of these Terms and Conditions as determined in the Promoter's absolute discretion.
Entrants consent to their Entry being used by the Promoter in the future and grants them a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable transferable license to use, reproduce, modify, adapt, publish and display the Entry for any purpose in any media without compensation, restriction on use, attribution or liability. Entrants warrant that they have the fully authority to grant these rights.
Entrants warrant and agree that:
(i) They will not submit, produce or upload any photo that is fraudulent, or may be in breach of any intellectual property, privacy, publicity or other rights;
(ii) No rights in the Entry have been previously granted to any person, firm, corporation or other entity;
(iii) They will obtain full prior consent from any person who has jointly created or has any rights in the Entry;
(iv) They will comply with all applicable laws and regulations including without limitation those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting the above, the Entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter for any breach of the above warranties.
Judging of Entries
At the end of the Promotion Entry Period, the Promoter will judge all valid Entries received during the Promotion Entry Period taking into account the quality, originality and creativity of the Entry and the relevance of the Entry to the Promotion.
All decisions of the Promoter are final and no correspondence will be entered into. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission.
Winners and prizes
The best Entries as determined by the judging panel ("Winner") will receive one (1) Prize. The Winners will be notified via Facebook within 5 days of the Promotion Entry Period ending.
The Promoter will use its reasonable endeavours to deliver the prize to the winner within 28 days of being selected pursuant to the above clauses.
If the Promoter is unable to contact a winner, or the winner does not claim their Prize within three (3) months of the judging date, then that winner will forfeit their Prize and no cash or other prize will be awarded in lieu.
If a winner fails to provide a valid or complete address for delivery of the Prize, or delivery has not been successful to an address provided (after reasonable attempts by the Promoter) the Prize shall be forfeited by that recipient.
The Promoter may award a forfeited Prize to the next-best Entry as determined by the expert panel appointed by the Promoter. The winner of any unclaimed Prize will be notified through Facebook three (3) months after the judging date
Prizes are not transferrable or exchangeable and cannot be taken as cash.
If any prize is unavailable the Promoter at its discretion reserves the right to substitute the prize with a prize of equal value.
As a condition of accepting a prize, a winner may be requested to sign legal documentation as and in the form required by the Promoter including a legal release and indemnity form.
Limitation of Liability
By entering the Promotion, Entrants agree to release and hold harmless the Promoter from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Promotion, or acceptance or use of the prize, the substitution of a prize in accordance with these Terms and Conditions, the administration of the Promotion, the Promoter's use of any of the rights granted herein. The Promoter assumes no responsibility for the conduct of any Entrant in this Promotion or in any Entry.
Facebook acknowledgements
Participation in this Promotion is considered acceptance of the following:
(i) a complete release of Facebook by any Entrant;
(ii) an acknowledgement that this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook; and
(iii) that the information provided by each Entrant is provided to the Promoter (as detailed in these Terms and Conditions) and not to Facebook.
Participation and entry in this Promotion is conditional upon the Entrant complying with all rules, regulations and guidelines set down by Facebook.
Personal information
All Entries become the property of the Promoter.
The information that each Entrant provides will only be used in connection with, or relating to, the administration of this Promotion and support of the Promoter’s social network pages (including, without limitation, any marketing communications you opt-in to receive from Promoter) and in accordance with these Terms and Conditions.

If any term or condition of these Terms and Conditions or the application thereof to any person or any circumstance shall be or become illegal, invalid or unenforceable, the same shall be read down, if such reading down is possible, and if found to be impossible, shall be severed and the remaining terms, agreements and conditions shall not be affected.
These Terms and Conditions are to be interpreted in accordance with the laws of the State of Victoria and all parties submit to the non-exclusive jurisdiction of the Courts of that State
