 “Raine & Horne Your Home Our Backyard” Competition Terms & Conditions

    Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this Raine & Horne Your Home Our Backyard competition (“Competition”) is deemed acceptance of these Terms and Conditions.
    The promoter of the Competition is Raine & Horne (Holdings) Pty Ltd (ABN 17 000 117 626) of 5/55 Harrington Street, Sydney, NSW 2000, telephone: 02 9258 5400 (“Promoter”).
    Entry is only open to NSW, ACT, QLD, WA and NT residents aged 18 years or over who own a residential property in NSW, ACT, QLD, WA or NT that is not exclusively listed for sale with any agent other than agents of the Promoter. Employees (and their immediate families) of the Promoter, participating Raine & Horne offices, government departments and bodies and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    For the purposes of this Competition, a residential property includes single homes, apartments, land and rural properties located in NSW, ACT, QLD, WA or NT but excludes projects (defined below), commercial properties and mortgagee in possession properties. Only one (1) person per residential property is permitted to participate in this Competition. ‘Projects’ are defined as a multi-unit strata development and multi-lot land and house & land estates, being sold either off-the-plan or as a completed building/estates.
    The Competition opens at 9am AEST on 3rd of August 2015 and final entries close at 5pm AEDST on 30th of November 2015 (“Competition Period”).
    To receive an automatic entry into the prize draw, individuals must exclusively list their eligible residential property (in accordance with clauses 3 and 4 above) for sale with any Raine & Horne office in NSW, ACT, QLD, WA or NT during the Competition Period (“Eligible Listing”). Eligible Listings do not need to be sold during the Competition Period to be eligible for the purposes of this Competition. For the removal of doubt, an Eligible Listing does not include non-exclusive listings, co-listings, appraisals or property management.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
    Incomplete or indecipherable entries will be deemed invalid.
    Multiple entries permitted. Only one (1) entry per eligible property.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. For the avoidance of doubt, in the case that an Eligible Listing has more than one (1) home owner, the entry into the prize draw will be awarded to the home owner listed at the time of entry; and any prize will be awarded to the home owner listed at the time of entry.
    There will be eight (Cool prizes to be awarded, two (2) prizes in each Monthly Draw (defined below).
    There will be one (1) draw conducted for the entries received each month of the Competition Period, for a total of four (4) draws (“Monthly Draws”). Entries into each Monthly Draw will open and close on the dates and times specified in the table below. Each Monthly Draw will take place at the Promoter’s premises, 5/55 Harrington Street, Sydney, NSW 2000 at 12noon local NSW time, on the dates outlined in the table below. The Promoter may draw additional reserve entries in each Monthly Draw and record them in order in case an invalid entry or ineligible entrant is drawn.

13. The prize draw winners will be notified by phone call and in writing by email within two (2) business days of the relevant Monthly Draw and their names will be published online at rh.com.au/backyard and in the Australian on the dates outlined in the table above.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. The first two (2) valid entries drawn in each Monthly Draw will each win a trip for two (2) adults to one (1) of the holidays listed below. Each winner will be allowed to select which holiday (out of the four (4) holidays listed below) they wish to take as their prize. Each holiday option is valued at up to AU$5,000 depending on date and point of departure. The holiday options are:
 

    Option 1: The Whitsundays, this options includes:
    Two (2) x return economy airfares from the winner’s nearest Australian capital city to Hamilton Island, QLD (only provided if winner does not reside within close proximity of the Whitsundays, as determined by the Promoter in its absolute discretion. If the winner does reside within close proximity of the Whitsundays (as determined by the Promoter), then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    Five (5) nights twin share at a minimum 4 star accommodation in Hamilton Island (exact accommodation to be determined by the Promoter);
    One (1) full day Great Barrier Reef Adventure by catamaran to the Great Barrier Reef with activities including semi-submersible rides, underwater viewing chamber and snorkelling; and
    One (1) half day relaxing cruise along the coastline to Whitehaven Beach, including beer and wine (exact beer and wine amount to be determined by the Promoter).

 

    Option 2: Red Centre this options includes:
    Two (2) x return economy airfares from the winner’s nearest Australian capital city to Ayers Rock, NT (only provided if winner does not reside within close proximity of Ayers Rock, as determined by the Promoter in its absolute discretion. If the winner does reside within close proximity of Ayers Rock (as determined by the Promoter), then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    Three (3) nights twin share at a minimum 4 star accommodation in the Desert (exact accommodation to be determined by the Promoter);
    Kata Tjuta and Uluru Sunset Tour which includes wine and nibbles (exact wine and nibbles to be determined by the Promoter); and
    A Sounds of Silence dinner, where the winner and their companion will “dine under the canopy of the desert night, while a storyteller shares with you tales as told in the stars”.

 

    Option 3: Margaret River, this options includes:
    Two (2) x return economy airfares from the winner’s nearest Australian capital city to Perth, WA (only provided if winner resides outside of WA. If a winner is from WA, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    Six (6) days car rental (exact car type and rental company to be determined by the Promoter) – only provided if winner or his/her travel companion for the prize has a valid unrestricted driver’s licence in Australia. If the winner or his/her travel companion does not meet these licence requirements the winner will forfeit this element of the prize;
    Two (2) nights twin share at a minimum 4 star accommodation in Perth (exact accommodation to be determined by the Promoter);
    Three (3) nights twin share at a minimum 4.5 star accommodation in Margaret River (exact accommodation to be determined by the Promoter); and
    One (1) full day ‘Wine and Dine’ small group tour visiting boutique wineries in Margaret River, including a-la-carte lunch at Hay Shed Hill winery (exact tour and lunch menu to be determined by the Promoter).

 

    Option 4: Tasmania, this options includes:
    Two (2) x return economy airfares from the winner’s nearest Australian capital city to Hobart and returning from Launceston, TAS;
    Eight (Cool days car rental (exact car type and rental company to be determined by the Promoter) - only provided if winner or his/her travel companion for the prize has a valid unrestricted driver’s licence in Australia. If the winner or his/her travel companion does not meet these licence requirements the winner will forfeit this element of the prize;
    Two (2) nights twin share at a minimum 4.5 star accommodation in Hobart (exact accommodation to be determined by the Promoter);
    Two (2) nights twin share at a minimum 4.5 star luxury accommodation in Strahan (exact accommodation to be determined by the Promoter);
    Two (2) nights twin share at a minimum 4.5 star accommodation in Cradle Mountain (exact accommodation to be determined by the Promoter);
    One (1) night twin share at a minimum 4.5 star accommodation in Launceston (exact accommodation to be determined by the Promoter);
    A world Heritage Gordon River cruise, including buffet lunch (exact cruise and buffet lunch to be determined by the Promoter);
    An eight (Cool week National Park Pass for two (2); and
    The winner’s choice of either: (i) A Port Arthur Historic Site Silver Experience, plus 3-hour Wilderness Cruise; OR (ii) A full-Day Dove Canyon tour for two (2).

 

Spending money, additional meals, additional beverages, laundry, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the prize winner and their travel companion and are not included. No extension or variation of the travel dates nominated by the Promoters will be permitted. Prizes must be booked and travellers confirmed up to one (1) month before intended travel date/s. Prize must be taken within twelve (12) months of winner notification and is subject to booking, flight and accommodation availability. All travel is only valid for/must occur between the following dates: 1st February 2016 to 24th March 2016, 26th April 2016 to 24th June 2016, 25th July 2016 to 16th September 2016, 10th October 2016 to 9th December 2016. Prize cannot be taken during the following blackout dates: 11th June 2016 to 13th June 2016 inclusive. The winners and their companions are responsible for ensuring that they have any requisite visas, vaccinations and travel documentation. The winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check-in. The prize is valid for travel to the winner’s choice of one (1) of the specified packages only. All components of the prize must be taken together. Any element of the prize not taken will be deemed to be forfeited. All travel plans must be arranged with Corporate Traveller. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the sole cost of the prize winner and their travel companion. The prize cannot be used in conjunction with any other discounts or special offers. Any passes or tickets issued as part of the prize are subject to prevailing terms and conditions of use and any tickets or passes are only valid for use within the stated duration on the passes or tickets issued or the duration of the prize winner’s prize, whichever is earlier. The Kata Tjuta and Uluru Sunset Tour requires local payment of $25 per person for National Park entry, which will be borne by the Promoter. Travel insurance is not included and we recommend the winner and their companion take out travel insurance prior to travel. Taking the prize is subject to any prevailing terms and conditions of the applicable airline operator as well as any accommodation/transport/services/transfers/travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the prize winner or their travel companion, are unable to use any element of the prize as stated for whatever reason, including refusal of entry or participation in certain activities for health, age, behaviour or safety reasons.

 

16. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
 
17. Car hire prize is subject to standard rental conditions. Petrol and insurance is not included. Car hire prize in clause 15, options 3 and 4 have unlimited kilometres for the duration of the car hire prize (as stated above in the relevant holiday option in clause 15) based on the car hire being a full-size Sedan (Toyota Camry or similar with the exact car hired to be determined by the relevant car hire company). The driver must have a current valid driver’s licence issued in an Australian State or Territory and meet any age requirements.
 
18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of the use and enjoyment of the prize, except for any liability which cannot be excluded by law.
 
19. Subject to the unclaimed prize draw, if for any reason a winner does not take a prize (or any element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
 
20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
 
21. Total prize pool value is up to $40,000. Prizes, or any unused portion of a prize, are not transferable, refundable, negotiable or exchangeable and cannot be taken as cash.
 
22. A draw for any unclaimed prizes may take place on 31st March 2016 AEDST at the same time and place as the original Monthly Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email within two (2) business days of the unclaimed prize draw and their names, if applicable, will be published online at rh.com.au/backyard and in the Australian from 4th April 2016.
 
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
24. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
 
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
 
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize or participation in any element of a prize.
 
27. As a condition of accepting a prize each winner and their companion must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
 
28. The Promoter collects personal information ("PI") in order to conduct the Competition and will, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.raineandhorne.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. In the event that an entrant wishes to opt out of receiving information on promotions, services and market research provided by Raine and Horne they can email marketing@rh.com.au. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the prize. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
