Terms and Conditions:
1. Information on how to enter forms part of the terms of entry. Entry into the Taubmans Competition (“Competition”) is deemed acceptance of these terms and conditions.
Eligibility
2. Entry is open to all residents of Australia. However, employees and the immediate families of Network Ten Pty Limited (the “Promoter”), Mercury Mobility Pty Ltd, PPG Industries Australia Pty Ltd (Taubmans) and their associated agencies and companies or any organisation or individual associated with the provision of the prize(s) are not eligible to enter. Entrants under 18 years of age must have parental/guardian permission before entering this competition.
3. The Competition commences on Monday 24 August 2015 at 14:00 AEST and closes on Monday 21 September 2015 at 10:00 AEST (“Competition Period”). Winners will be judged from all entries received throughout the competition period and One (1) Major Prize Winner, and One (1) Minor Prize Winner will be selected by a judging panel at Network Ten at 1 Saunders Street Pyrmont, Sydney, NSW 2009 on Tuesday 22 September 2015 from 14:00 AEST. The Winner will be the Entrant who, in the sole opinion of the judges, has created the most aesthetically pleasing photo (colour choice, interior design etc) using the Taubmans Paint Your Own Room tool on the competition page. The prize winners will be notified by a phone call within 10 business days of judging and in writing and the winner’s details will be published on the TENPlay website at tenplay.com.au from Wednesday 7 October 2015.

8. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on the aesthetic value of the Paint Your Own Room photo that has been created. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
9. A limit of one online entry per day per person applies.
10. The time of entry will in each case be the time the online entry is received by the Promoter’s database and the Taubman’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason. If an entrant creates more than one design via the Taubman’s PYOR tool only the first creation submitted on any given day will be considered the daily entry. All other entries will be deemed invalid.
11. All reasonable attempts will be made to contact the Winner. If any Prize remains unclaimed by the winner or unallocated or forfeited for any reason, by 10:00 AEST on Thursday 22 October 2015, the Prize/s will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize. This Unclaimed Prize Determination will take place at Taubmans at 9 Birmingham Avenue, Villawood NSW 2163 from 10:00 AEST on Thursday 22 October 2015. The Winner of the Unclaimed Prize Determination will be notified by telephone and in writing within 2 days of the Unclaimed Prize Determination.
12. An entry that is made on behalf of an Entrant by a third party will be invalid. The Entrant warrants to the Promoter the entry submitted is an original literary work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
13. The Promoter and or Taubman’s are entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
14. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Error and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
16. Prizes
There will be one (1) Major Prize Winner, and one (1) Minor Prize Winner. The Prize Winners will win one of the following Prize Packages (dependent on if they are the major or minor winner):

The total value of the Prize Package for this competition is $10,500.00 AUD and is correct at the time of printing.
17. Except as stated in Clause 22 prizes cannot be transferred.
18. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to any directions given under State Regulation.
19. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
20. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
21. The Taubmans voucher awarded to Minor Prize winner must be used in accordance with the terms and conditions applicable to the voucher as specified by Taubmans.
22. If the prize winner is under 18 years of age at the time of judging, the prize will be awarded to their nominated Parent or Guardian on behalf of the winner. The winner and parent or guardian may be required to sign a prize transfer form.
23. Prize monies will be transferred directly into the bank account nominated by the winner. The Promoter will not be responsible for the winner not receiving prize funds as a result of incorrect bank account number details or other details affecting the transfer.
24. By accepting the prize, the winner agrees to participate in and cooperate as required with all reasonable media editorial requested relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned through the duration of the prize.
25. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN or the advertising or marketing thereof, in any media whatsoever through the world and the winner will not be entitled to any fee for such use.
26. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
27. Prizes will be awarded to the person named in their contestant entry. Should an entrant’s contact details change during the Competition Period it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
28. It is a condition of accepting the prize the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
29. In the case of the intervention of an outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism,
power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
30. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
31. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engage in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
32. The Promoter, Mercury Mobility Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
33. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under State Regulation.
34. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.

A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.
38. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to Network Ten Pty Limited’s privacy policy which contains information, amongst other things, about how you may access personal information that is held by Network Ten Pty Limited about you and seek correction of such information.
