1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in the Freedom Win a Freedom Kitchen Competition ("Competition") is deemed acceptance of these Terms and Conditions.
Promoter
2. The Promoter is Steinhoff Asia Pacific Limited trading as Freedom, ABN 55 051 493 764, of Level 4, 1 Epping Road, North Ryde NSW 2113 (“Promoter”).
Competition Period
3. The competition commences at 9.00am (AEST) on 4 September 2015 and closes at 23:59pm (ADST) on 3 November 2015 (“Competition Period”).
Eligibility to Enter
4. Entry is open to Australian residents over the age of 18.
5. Employees (and their immediate family members) of the Promoter, or any related body corporate of the Promoter, as well as any franchisee or any agency associated with this Competition are ineligible to enter. Immediate family members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. (“Eligible Entrants”).
6. Entry is open to all residents of Australia aged 18 years and over who are the registered home owner of the premises that they would like the Kitchen Package Prize to be installed in. If the Prize Winner is not the home owner of their premises or not in an area that Freedom Kitchens services i.e If the winner is a resident of SA, WA, TAS, NT or lives outside 100km radius of Sydney, Central Coast NSW, Canberra, Melbourne or Brisbane the winner will be ineligible to choose the Kitchen Package Prize and will receive the Freedom Gift Card.
7. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
How to Enter
8. To enter the Competition, an eligible entrant must complete all requested personal details on the entry form at freedom.com.au during the Competition Period:

11. Entries are deemed to be received at the time of receipt into the Competition database and NOT at the time of transmission by the entrant.
Prize Draw
12. The random computerized prize draw will be conducted by Mike Da Silva & Associates (Aust) P/L (“MDSA”) at Ground Floor, 15 Grosvenor Street, Neutral Bay, NSW 2089 at 2:00pm ADST on 17 November 2015.
13. The winner will be notified by phone & in writing via email within 2 business days of the draw and their name, suburb & state will be published on
www.freedom.com.au from 23 November 2015. The winner must claim the prize by 3 November2016.
Prize
14. The first Eligible Entry drawn will be deemed the major prize winner and they will win their choice of either a Kitchen Package provided by Freedom Kitchens ABN 15 097 861 268 (Freedom Kitchens) valued at a maximum $20,000, or a Freedom Gift Card valued at a maximum $10,000. Maximum prizepool value is $20,000.
The Kitchen Package Prize choice is comprised of:
a) Kitchen cabinets with Hettich ArciTech soft-closing drawers and a Caesarstone® Classico benchtop valued up to $13,000
b) Stainless steel kitchen appliance package nominated by Freedom Kitchens, which includes an oven, gas cooktop, slide-out rangehood and dishwasher valued up to $2,000
c) Design, delivery and labour for installation of the Kitchen Package valued up to $5,000
d) The total prize pool is valued at a maximum $20,000.00 (including GST). The winner will have a choice of specific colours and finishes to include in the installation of the kitchen. These lists will be provided by the service provider at the time of winner notification. If the winner chooses a specific item or the design, delivery and labour for installation costs are outside of the current fee budget provided in the prize winning package, the winner will be advised of the additional cost and can opt to pay the additional cost or bring the total cost within the budget provided in the prize winning package; or
The Freedom Gift Card prize choice is comprised of:
A $10,000 The Freedom Gift Card which will be posted to the winner by registered mail and is valid for twelve (12) months from the date of card issue. The Freedom Gift Card is subject to its terms of issue which can be found at
http://www.freedom.com.au/terms-and-conditions/gift-card-terms-and-conditions/. Any unused balance of the Freedom Gift Card will not be awarded as cash.
15. For the removal of doubt, the Kitchen Package Prize does not include:
a) trades works (other than kitchen cabinetry installation), glass splashbacks, appliances other than specified, ceiling lighting or flooring or other kitchen accessories including but not limited sink and taps;
b) any gas, electricity, water or associated costs incurred in before, during or after the claiming, installing and using of the Prize;
c) any accommodation, meals or other spending money incurred in relation to or ancillary to claiming or using the Prize;
d) any other ancillary or incidental expenses incurred in connection with the prize, whether before, during or after installation;
e) any insurances or taxes;
f) any construction, electrical, tiling or plumbing services;
g) any ongoing maintenance costs;
h) any costs in excess of the allocated budget per component of the Prize or any other ancillary costs associated with redeeming this Prize.
16. Winner is responsible for all of the trades works (other than the actual kitchen installation) such as plumbing, electrical and tiling. Much of this will need to be completed before the kitchen can be installed. The Freedom Kitchens team will make all reasonable attempts to assist the winner with contacts for these trades.
17. The Prize must be redeemed in full, as a package and all works must be completed by 3 November 2016. Freedom Kitchens will contact the winner after winner notification to organise redemption of the prize.
18. All materials in relation to the installation of the prize will be provided and all installation will be undertaken by suppliers and persons selected in Freedom Kitchens’ absolute discretion. Freedom Kitchens will provide contracted kitchen installers to install the prize components but are not responsible for any plumbing and/or electrical services or any structural, renovation or construction work. The Prize is subject to all of Freedom Kitchens’ standard terms, conditions and warranties relating to purchase and installation.
19. All prize items are valued in Australian dollars and are inclusive of GST. Prize item values stipulated in the above Condition 9 are based on the recommended retail prices as at the time of writing. The Promoter accepts no responsibility for any variations in prize values between such time and the date of prize redemption. The prize is not transferable, exchangeable or redeemable for cash. In the event that the winner does not take or redeem a component of the prize by 3 November 2016, that component will be forfeited by the winner and cash will not be awarded in lieu of that component. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
20. The Promoter makes no representation or warranty as to the quality or suitability of any of the goods or services provided as part of the prize other than those which cannot be excluded under the Competition and Consumer Act Cth (2010), or any other warranties (whether express or implied) under any state or federal legislation.
21. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
22. All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
23. The Promoter and its associated agencies and companies accept no responsibility for the prize damaged or lost in transit.
Unclaimed Prize Draw
24. If the prize is still unclaimed after three (3) calendar months of the original prize draw, the Promoter will conduct a further draw for the prize, subject to any directions from any regulatory authority. The unclaimed prize draw will be conducted at the same time and place as the original draw on 2 March 2016. In the case of a winner in the unclaimed prize draw, they will be notified by telephone and in writing within two (2) business days of the unclaimed prize draw and their name will be published on
www.freedom.com.au from 9 March 2016. The unclaimed prize winner must claim the prize by 17 March 2017. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.
General
25. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the Promoter may (where necessary with the approval of the relevant Department) cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
26. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. To the fullest extent permitted by law and without limiting any other conditions of entry, the Promoter may, in its discretion, terminate, modify or suspend the promotion, subject to any directions given by any relevant authority. All entrants participating in the promotion at the point of termination, modification or suspension of the promotion will be notified by the Promoter in writing. In the event of modification or suspension of the promotion, the entrant may choose to terminate their participation in the promotion at no cost.
28. All entries will be automatically opted in to marketing communications from Freedom and Freedom Kitchens. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the Promoter’s privacy policy which is available at

29. This is not a game of skill. The prize winners will be selected by MDSA at random through an automatic selection process.
30. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
31. Incomplete entries will be deemed invalid and removed from the draw. The Promoter's decision is final and no correspondence will be entered into
32. The prize is not transferable or exchangeable and cannot be taken in any other form (including not being able to be taken as cash).
33. Subject to the unclaimed prize draw clause 22, if for any reason a winner does not take possession of their prize by the time stipulated by the Promoter, then the prize will be forfeited.
34. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.
35. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prize. Independent financial advice should be sought.
