Terms and Conditions
1. Information on how to enter forms part of the terms and conditions ("Terms and Conditions"). Entry into the "Steel Blue Celebration Competition" ("Competition") is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer.
Competition Period
The competition commences on Monday 7 September 2015 at 14:00 am AEST and closes on Thursday 24 September
2015 at 09:00 am AEST (“Competition Period”).

Eligibility to Enter
Entry is open to all residents of Australia 18 years and over. However, employees and the immediate families of Network Ten Pty Limited ABN 91 052 515 250, of 1 Saunders Street, Pyrmont, NSW 2009 ("Network Ten" or the “Promoter”) or Footwear Industries Pty Ltd (ABN 15 068 608 917) trading as Steel Blue of 18 Irvine Drive, Malaga, WA, 6090 (“Steel Blue”), and their associated agencies and companies, or any organisation or individual associated with the provision of the prize(s), are not eligible to enter.
If the Major Prize winner is unable to attend the Shell Advance Malaysian Motorcycle Grand Prix Malaysian at Sepang International Circuit, in Sepang, Malaysia, Thursday 22nd October 2015 to Monday 26th October, 2015, they will forfeit the prize in full and a new winner will be selected.
How to Enter
To participate in the Competition entrants must take a picture or video representing the entrant’s “Steel Blue Celebration”, which must be the entrant’s own original work and which does not include any third party intellectual property (such as a logo), does not breach music copyright laws or for which moral rights are not attributable to any third party and has the approval of any person featured in the work, then:
Via INSTAGRAM: log into their Instagram account and upload your video or photograph to Instagram with the hashtag #steelbluecelebration (note 15 sec video limit); or
Via TWITTER: log into their Twitter account and Upload your video to YouTube or Vimeo and Tweet the link using the hashtag #Steelbluecelebration or Tweet your photograph with the hashtag #Steelbluecelebration (note 15 sec video limit); or
Via FACEBOOK: log into their Facebook account and upload their video or picture to Ten Sport Facebook page TensportTV with the hashtag "#Steelbluecelebration " (note 15 sec video limit).

This is a game of skill; chance plays no part in determining the winner. All Entries will be reviewed by a panel of judges comprising employees of the Promoter and/or an agency commissioned by the Promoter at the dates and times described in clause 13. Each entry will be individually judged based on its creative merit. 1 x Major Prize Winner will be selected based on the most unique and creative entry whether it be a video or a photograph. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
This promotion is in no way sponsored, endorsed, administered by or associated with Instagram, Twitter or Facebook. You are posting your information on Instagram, Twitter and Facebook. The information you provide will only be used for the purpose of this competition unless otherwise specified in these terms and conditions.
Photographs and videos contained within Entries made by uploading videos or pictures to Instagram, Twitter or Facebook as per Clause 6.a, b and c. may aggregate onto a media wall hosted on tenplay.com.au. Entrants agree, by submitting an Entry as per Clause 6.a, b or c. that their entry may feature on tenplay.com.au, steelblue.com.au as well as the social media sites used to post the Entry.
Incomprehensible and incomplete entries will be deemed invalid.
A limit of one online entry per person per day (either via Instagram, Twitter or Facebook) applies to this Competition If an eligible entrant submits more than one (1) Entry per day (whether deliberately or mistakenly), that eligible entrant’s first Entry of the day will apply and any additional Entry submitted that day will be void. The Promoter may, in its absolute discretion, ignore any Entry which it deems to be offensive or inappropriate, or not otherwise made in accordance with these Terms and Conditions.
The time of each Entry will, in each case, be the time that each Entry is successfully uploaded to Tenplay.com.au or uploaded to Instagram, Twitter or Facebook. The Promoter accepts no responsibility for any late, lost or misdirected Entries due to technical disruptions, network congestion or for any other reason.
Entries must be received by Thursday 24 September 2015 at 09:00 AEST to be included in the Prize Judging. Each valid Entry received during the Competition Period will be entered into the Prize judging. An Entry will only be valid if the entry includes #steelbluecelebration and the entrant's Instagram and/or Facebook account is set to public status. Pictures and videos must remain on the entrant's Instagram, Twitter or Facebook account at least 7 days after the last time and date for judging described in clause 2.
The time of entry will in each case be the time the online entry is received by the Promoter’s social aggregation tool via the Instagram, Twitter or Facebook #steelbluecelebration. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
The Winner will be judged from all entries received throughout the entry period.
Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. social media account holder). The winner will be contacted via their social media account with the request to contact the Promoter via email to verify their details.
Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
All reasonable attempts will be made to contact the Winner. As the Major Prize is event based, if the Major Prize does not respond to the Promoters request to be contacted to claim the prize via their social media account and the prize remains unclaimed by the winner or unallocated or forfeited for any reason, by Monday 28 September 2015 at 12:00 noon AEST, the Prize will be re-allocated to the entrant that has submitted the next entry which best meets the judging criteria excluding the entrant that has failed to claim the prize. The Major Prize Unclaimed Prize Determination will take place at Network TEN at 1 Saunders Street, Pyrmont, NSW 2009 on Monday 28 September 2015 at 12:01 am AEST. The winner of the Major Prize Unclaimed Prize Determination] will be notified via direct message on their social account either Twitter or a comment on the entrants Instagram image or a post on the entrants Facebook page on the same day of the Unclaimed Prize Determination and will be published on the Website from Tuesday 29 September 2015.
All reasonable attempts will be made to contact the Unclaimed Prize Winner. If any of the Prize remains unclaimed by the unclaimed prize winner or unallocated or forfeited for any reason, by Wednesday 30 September at 10:00 am AEST, the Prize will be re-allocated to the entrant that has submitted the next entry which best meets the judging criteria excluding the entrant/s that has failed to claim the prize. The unclaimed prize winner will be notified the amount of time they have to claim the prize thereafter until a winner who accepts the prize is found.
An entry that is made on behalf of an entrant by a third party will be invalid.
The Promoter and Steel Blue is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. Entrants who submit an image via Instagram, Twitter or Facebook may be published on the Website.
The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an Entry that is not in accordance with these
Terms and Conditions or who tampers with the entry process. Error and omissions will be accepted at the Promoter’s
discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The total prize pool is valued at up to $8,250.00 (excluding GST). The Promoter accepts no responsibility for any change in prize values between now and the ultimate prize redemption date. The prize redemption date relates to the Shell Advance Malaysian Motorcycle Grand Prix Malaysian at Sepang International Circuit, in Sepang, Malaysia, Thursday 22nd October 2015 to Monday 26th October, 2015.
Any ancillary costs associated with redeeming the prize/s are not included. These are the responsibility of the winner.
Prizes are strictly non-transferrable and non-negotiable, and may not be replaced or refunded.
The Major Prize winner and their companion are responsible for all other expenses including spending money (unless specified), meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The airline carrier is at the discretion of the Promoter and prize supplier. If the entrant wishes to select a specific carrier any costs associated with this selection of that airline over and above the Promoter’s selected carrier will be borne by the entrant and not the Promoter or the prize supplier. Frequent Flyer points are not available from any airline. If flights are booked and the Major prize winner does not utilise the booked flights they withdraw all rights to claim the flights at a later date. Any changes to the flight and accommodation booking once booked are at the expense of the Major Prize winner.
The Major Prize winner’s travelling companion must be 18 years or older.
The Major prize winner and/or their companion may be required to provide a credit card pre-authorisation or cash deposit to cover any incidental upon check in at the hotel.
The Major prize winner and their companion must hold a valid passport with at least 6 months left before expiration on the passport at the time of judging to be considered a valid entrant. If the winner does not hold a passport with the said conditions it is at the discretion of the Promoter whether they are considered an eligible entrant or not. Not holding a
valid passport could invalidate the entrant. If the entrant cannot be validated The Promoter may choose the next best entrant as the winning entry.
The Major Prize winner and their travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city (Sydney, Melbourne, Perth, Adelaide or Brisbane) for flight departure. It is the winners’ responsibility to organise transfers to and from the winner and their travelling companion’s residence and nearest capital city. Prize does not include any costs associated with travelling to and/or from the departure and arrival points in Australia.
As a condition of accepting a major prize, each winner (and their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers (including Steel Blue) in their absolute discretion, including but not limited to a consent, waiver, release and indemnity form.
The Promoter is not responsible for any additional or incurred costs while the winner and their travelling companion are travelling.
If for any reason a Major Prize Winner is unable to attend the event stipulated as the Major Prize, they will forfeit their entitlement to the Major Prize in full and will void any further entitlement.
By accepting the Prize, the Major Prize Winner agrees they are subject to any, and all, Terms and Conditions of the Promoter and Malaysian Motorcycle Grand Prix and Sepang International Circuit.
The Promoter makes no representation as to the safety conditions or other issues that may exist at any destination or event. It is the winners’ responsibility to check the safety of each destination. Latest information can be found on the Australian Government, Department of Foreign Affairs and Trade website at
http://dfat.gov.au/If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to any directions given under State Regulation. If the event on October 22 to 26, 2015 does not go ahead, this element of the prize is forfeited in full and no compensation will be made subject to state regulation.
Prizes must be taken as offered. Any prize, or any unused portion of any prize, are not exchangeable or cannot be redeemed as cash. Prizes cannot be used in conjunction with any other special offer. Prize values are in Australian dollars. The Promoter accepts no responsibility for any variation in the prize values. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
In acceptance of the prize, each Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
The Promoter is neither responsible nor liable for any prize damaged in transit in the delivery of their prize.
The Promoter’s prize supplier will arrange for the delivery of the prize within twenty-eight (28) days of the winner being determined. The prize will be delivered to the address provided by the winner in response to the winner being notified that they have won the prize. It is the responsibility of the winner to provide correct delivery details and to be available to receive delivery of their prize as organised by the Promoter and notified to the winner.
General Provisions
If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and subject to any written directions from a regulatory authority, to cancel, terminate, modify or suspend the Competition.
If your Entry is selected as a winning Entry, validation of your circumstances, the validity of your Entry will be undertaken by the Promoter. Methods of validation (without limitation) will be determined by the Promoter in its complete discretion. If an Entry is judged to be a winning Entry, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner signs any such legal documentation.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Steel Blue (including their respective officers, employees and agents) each excludes all liability (including negligence), for any personal injury; or loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Steel Blue (including each of their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference: (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters)due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Steel Blue and Network TEN or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
You consent to The Promoter collecting your personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the winner and prize fulfilment). Your personal information may be disclosed to third party service providers for this purpose. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published on tenplay.com.au or as required under the relevant lottery legislation. For purposes of public statements and advertisements The Promoter will only publish the winner’s surname, initial and State. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.
The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to the Promoter's privacy policy which contains information, amongst other things, about how you may access personal information that is held by the Promoter about you and seek correctionofsuchinformation.
