NEW CALEDONIA PROMOTION
TERMS AND CONDITIONS


1. Information on how to enter and the Prizes (as defined below) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian and New Zealand residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences on 13/08/2015 and ends at 5:00pm AEST (in Australia) and 5:00pm NZST (in New Zealand) on 05/10/2015 ("Promotional Period").

5. To enter, individuals must complete the following steps during the Promotional Period:

a. visit neighbours.new-caledonia.co.nz (for New Zealand residents) or neighbours.new-caledonia.com.au (for Australian residents);

b. follow the prompts to the promotion entry page;

c. select one (1) of the following five (5) locations in New Caledonia that they would like to stay if selected as a winner: (1) Noumea; (2) Isle of Pines; (3) Bourail; (4) The North; or (5) Loyalty Islands (each a "Accommodation Location");

d. select one (1) of the following five (5) locations in New Caledonia that they would like to have dinner if selected as a winner: (1) Noumea; (2) Isle of Pines; (3) Bourail; (4) The North; or (5) Loyalty Islands ("Dinner Location");

e. input the requested details (including their full name, a valid email address, and post code);

f. provide an original and creative answer to the promotional question "Why would you like to meet your New Caledonian neighbours?" in 25 words or less; and

g. submit the fully completed entry form.

6. Incomplete or indecipherable entries will be deemed invalid.

7. Only one (1) entry permitted per person. Multiple entries are not permitted

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10. This is a game of skill and chance plays no part in determining the winners. Entries will be divided into two (2) groups based on the entrant's country of residence (each a "Country Group"). The entries received in each Country Group will be individually judged against all other entries received in that Country Group based on the originality, literary merit and creative merit of the answer provided to the promotional question. The judges may select additional reserve entries in each Country Group which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.

11. The winners will be notified by email.

12. The Promoter's decision is final and no correspondence will be entered into.

13. The best valid entry in each Country Group, as determined by the judges, will each win a trip for two (2) people to New Caledonia, valued at up to NZ$5,000/AU$4,500 depending on date and point of departure ("Prize"). The Prize includes:

- return economy airfares to Noumea, New Caledonia with Aircalin for two (2) people from Auckland (for the New Zealand Country Group winner) or from the winner's closest airport of Melbourne, Sydney or Brisbane (for the Australia Country Group winner);

-return transfers from the Noumea airport to the accommodation for two (2) people;

-seven (7) nights twin-share accommodation in a minimum 4-star hotel for two (2) people in the Accommodation Location nominated on their entry form (exact hotel to be determined by the Promoter in its absolute discretion);

- daily hotel breakfast for two (2) people (exact menu to be determined by the Promoter in its absolute discretion);

- an organised dinner for two (2) people at the Dinner Location nominated on their entry form. If the selected Dinner Location is located on the Isle of Pines or Loyalty Islands, the Prize will also include return domestic flights to that location and return transfers to the restaurant (if required). If the selected Dinner Location is located in Noumea, Bourail or The North, the Prize will also include return transfers to that location from their accommodation (if required); and

- if the selected Accommodation Location is located on the Isle of Pines or Loyalty Islands, the Prize will also include return domestic flights to that location from Noumea. If the selected Accommodation Location is located in Bourail or the North, the Prize will also includes car rental (six (6) days for The North; three (3) days for Bourail). The driver must have a current valid driver's licence issued in New Zealand or in an Australian State or Territory and meet any age requirements.

14. Any cost associated with travel to/from the departure airport in Australia or New Zealand (as applicable) will be the responsibility of the winner and will not be borne by the Promoter. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 05/10/2016 and is subject to booking and hotel/flight availability. Prize cannot be taken during Australian or New Zealand school holidays, public holidays or other peak periods. During the entire duration of the Prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of any Prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

15. Car hire prize is subject to standard rental conditions. Petrol and insurance is not included. Unlimited kilometres permitted during the car rental.

16. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a Prize, subject to any written directions from a relevant regulatory authority.

17. If for any reason a winner does not take a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.

18. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserve the right to substitute the Prize or that part of the Prize with a prize to the equal value and/or specification.

19. Total Prize pool value is up to NZ$5,000/AU$4,500.

20. The Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.

21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

23. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in value of the Prizes to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a Prize.

26. As a condition of accepting a Prize, each winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event that a winner's companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.

27. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://en.visitnewcalednia.com. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia, including its parent company located in New Caledonia (for details, see the Promoter's Privacy Policies).
