TERMS AND CONDITIONS

Eligibility to enter

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over (“Eligible Entrants”).

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-­spouse, de-­facto spouse, child or step-­child (whether natural or by adoption), parent, step-­parent, grandparent, step-­ grandparent, uncle, aunt, niece, nephew, brother, sister, step-­brother, step-­sister or 1st cousin.

Promotional Period

4. Promotion commences at 9:00am AEDT on 20/10/15 and closes at 5:00pm AEDT on 01/12/15 (“Promotional Period”).

How to enter

5. To enter, Eligible Entrants must during the Promotional Period:
a) visit www.missionforhealth.com.au/promotions;;
b) follow the prompts to the promotion entry page;;
c) input the requested details including their first name, last name, valid email address, full street
address, gender;; and
d) read and then consent to these Terms and Conditions by selecting the relevant mandatory tick-­box
and submit the fully completed entry form.

6. Only one (1) entry permitted per person.

Prize

7. There is one (1) prize to be won in this promotion.

8. The winner will receive thirty-­three (33) fortnightly home cleaning sessions, each lasting two (2) hours, valued at $92.00 per session.

9. Cleaning sessions will be provided by Clean Homes. The frequency of the cleaning sessions will be one (1) per fortnight and will be serviced at the same time each fortnight. The cleaning sessions must commence within four (4) weeks of the winner accepting the prize. The cancellation of a fortnightly cleaning session by the winner will result in the winner forfeiting that session. The cancellation of a fortnightly cleaning session by Clean Homes will be made up at the end once all sessions have been performed. Cleaning sessions will be provided subject to any terms and conditions outlined on http://www.cleanhomes.com.au/faq. If the winner has any queries regarding the service they can contact Clean Homes on 1300 305 182.

10. In the event that the winner resides in an area that falls outside of the serviceable area of Clean Homes, the winner will receive an alternate prize of two (2) $500 Woolworths Essentials Gift Cards, two (2) $500 Coles Group & Myer Gift cards and one (1) $1,000 Westfield Gift Card (“Vouchers”).

11. The total prize pool value for the promotion is up to $3,036.00.

Prize Draw

12. The draw will take place at Handling Matters, 1/3 Green Street, Brookvale, NSW 2100 at 12:00pm AEDT on 09/12/15.

13. The winner will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 18/12/15. Upon notification, the winner must confirm their details by replying to the Promoter’s email notification (full name, postal address, valid email address and phone number) within the time frame specified by the Promoter. The Promoter and/or its agency will contact the winners if they require further details for prize delivery.

14. A draw for the prize, if unclaimed, may take place on 10/03/16 (“Unclaimed Prize Draw Date”) at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified in writing within two (2) business days of the Unclaimed Prize Draw Date and their name will be published in The Australian on 18/03/16. In the event the prize is awarded in the unclaimed prize draw, the cleaning sessions must commence within four (4) weeks of the unclaimed prize draw winner accepting the prize.

General conditions

15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

16. Incomplete or indecipherable entries will be deemed invalid.

17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

18. The Promoter’s decision is final and no correspondence will be entered into.

19. Subject to the unclaimed prize draw clause, if for any reason the winner does not take/redeem a prize (or an element of the prize, then the prize (or that element of the prize) will be forfeited.

20. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

21. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

22. Any ancillary costs associated with redeeming the Vouchers are not included. Any unused balance of the Vouchers will not be awarded as cash. Redemption of the Vouchers is subject to any terms and conditions of the issuer including those specified on each voucher.

23. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant;; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, or re-­ commence it on similar terms, as appropriate.

25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-­Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-­Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury;; or any loss or damage (including loss of opportunity);; whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-­Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury;; or any loss or damage (including loss of opportunity);; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);; (b) any theft, unauthorised access or third party interference;; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;; (d) any variation in prize value to that stated in these Terms and Conditions;; (e) any tax liability incurred by the winner or entrant;; or (f) use of a prize

28. The Promoter collects personal information for the purpose of conducting this promotion and which is reasonably necessary for or directly related to the Promoter’s functions and activities including marketing and sale of its products to consumers. By entering this promotion Eligible Entrants consent to the use of their personal information for that purpose, and agree that the Promoter may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes. Eligible Entrants have the option of providing personal information to the promoter anonymously, unless the Promoter considers it impractical for it to deal with the Eligible Entrant anonymously. It may be necessary for the Promoter to transfer data to another of the Promoter’s offices in another country, or to overseas entities such as an agent. The Promoter will take all reasonable steps necessary to ensure that any personal information transferred overseas is kept securely and in accordance with the APP’s. The Promoter also may use personal information for the purpose of sending Eligible Entrants direct marketing material. Eligible Entrants consent to receiving direct marketing material by entering this promotion, but will be able to unsubscribe from any such communications if they wish.
