When will the competition start and end?
The competition starts at 9am (AEST) on 01/10/15 and ends at 11:59pm (AEDT) on 31/01/16 (the Competition Period).
Who can enter?
Only Australian residents aged 18 or over who can take a prize on/between the date(s) specified by the Promoter, who are ready and able to claim a prize within 48 hours of notification by the Promoter (and, if the prize is for international travel, who hold a current and valid Australian passport) can enter.
Who can't enter?
Directors, officers, management and employees of: a.the Promoter; or
b.the agencies or companies or participating outlets and venues associated with this competition,
and their immediate families, can't enter.
Do I need to buy anything to enter?
Yes.
Outlets
During the Competition Period, you need to buy: a.a specially marked 6 or 24 can/bottle pack or 10 bottle pack of Carlton Dry beer; OR
b.a specially marked 6 or 24 can pack of Mercury Hard cider,
(each, a Qualifying Purchase) for off premise consumption from any liquor outlet which is stocking specially marked products (Outlets) (excludes online purchases).
Outlet Qualifying Purchases will entitle you to the equivalent number of major prize draw entries as the size of the pack, e.g. a 6 pack will entitle you to 6 major prize draw entries, a 10 bottle pack will entitle you to 10 major prize draw entries and a 24 pack will entitle you to 24 major prize draw entries. Each separate unique code on an Outlet Qualifying Purchase will entitle you to one separate instant win entry, e.g. a code from a 6 can pack will entitle you to one instant win entry and 6 major prize draw entries. Please see the details on pack regarding where the unique code/s are printed in that pack.
Venues
During the Competition Period while promotional material is being displayed in a liquor licensed venue (Venue), you need to buy a standard jug of Carlton Dry beer (to share with friends) (also a Qualifying Purchase) for on premise consumption from a Venue to receive a game card with a unique code (subject to stocks remaining in that Venue) (Game Card). A Game Card unique code will entitle you to 1 major prize draw entry and 1 instant win entry.
Entry instructions
After you have made a Qualifying Purchase you must during the Competition Period visit the promotional page accessible via either
www.carltondry.com.au or
www.mercuryhardcider.com.au (the Websites) and fill out and submit the online entry form, including by providing the unique code received on/with your Qualifying Purchase, selecting the minor prize you would like the chance to win from the options available on the Website (subject to availability) and all other requested information.
Bonus entries
The Promoter may offerbonus entries at any point during the Competition Period at its discretion. If you get a communication from the Promoter containing a bonus entry code, you will automatically receive a bonus entry into the Competition (as specified by the Promoter) if, when you enter, you also enter the bonus entry code. The bonus entry code will expire on the date the Promoter notifies to you.
How are instant win minor prizes awarded?
There are a total of 160 instant win minor prizes to be awarded. Instant winners will be selected by a computerised random system at Prime Focus, 403/62 Beach St, Port Melbourne VIC 3207 (Prime Focus).
You will get an instant online message acknowledging your entry and informing you if you have won a minor prize. If you have won a minor prize, you will receive a return email containing your minor prize tickets as an attachment and you should follow the instructions within the email to redeem your minor prize.
How many winners will there be and how will they be chosen?
There will be a total of 178 winners determined in respect of this competition – 160 minor prize winners and 18 major prize winners.
There will be 18 major prize draws conducted. The major prize draws will be held at 12pm (AEDT) on each Tuesday between 06/10/15 and 02/02/16 (inclusive) at Prime Focus.
The first valid entry drawn randomly in each major prize draw from the entries received up to 11:59pm (AEDT) on the Monday before that draw (or the end of the Competition Period, whichever occurs sooner) (excluding previous major prize winning entries) will win a major prize.
The Promoter may draw additional reserve entries in each major prize draw and record them in order, in case the winning entry/entrant is deemed invalid.
What can I win?
There are in total up to 178 prizes available – up to 160 minor prizes and 18 major prizes.
All prizes will be awarded to the relevant winner and are to be taken by the winner and the number of adult companions as specified by the Promoter.
Minor prizes
Each minor prize is general admission tickets for the winner and 1 adult companion to an Australian music festival (as nominated by the winner during the entry process) valued in total at up to $864 depending on the festival selected by the winner in their entry.See paragraphs 6 and 8 for further minor prize details.
Major prizes
Each major prize is a trip to an Australian or international location specified by the Promoter, on dates to be specified by the Promoter, valued between $5,000 and $25,000 (depending on the location and the winner’s point of departure). Each major prize will consist of return economy flights (unless the winner resides in the state/territory of the destination), a minimum of two nights' twin share accommodation in a minimum 3 star hotel (or equivalent), and further activities, merchandise, products and transport as specified by the Promoter. See paragraphs 7 and 8 for further major prize details.
There is a limit of one minor prize and one major prize per household (except for SA residents).
Total prize pool
The total prize pool is up to $350,000.
How many times can I enter?
Outlet entrants can enter multiple times, provided you only enter once per unique code. Venue entrants can only enter once per day. Each entry must be submitted separately in accordance with these Terms and Conditions.
How and when will the winners be informed?
If you are an instant winner, you will be informed instantly in writing online, and also by email and SMS within two days and your name and state/territory of residence will be published on the promotional page accessible via the Websites within seven days of winning for a period of 28 days.
If you are a major winner, you will be informed in writing via email and SMS within one hour of the draw, and your name and state/territory of residence will be published on the promotional page accessible via the Websites on the day after the draw for a period of 28 days.
If you are a winner of any prize, your name and state/territory of residence may also be published on the Promoter's Carlton Dry and/or Mercury Hard cider Facebook page/s.
Must I keep anything to verify my entry?
You must keep the original itemised purchase receipt(s) (for Outlet entries), and unique code (either on the bottle cap, inside the 6/24 pack or on the Game Card) for all entries as proof of purchase. If you don't produce the proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize. Purchase receipt(s) must clearly identify the Outlet of purchase (which must be a participating Outlet), the product purchased (which must be a Qualifying Purchase), and the date of purchase (which must be during the Competition Period before you submitted your entry). If, in the Promoter's opinion, you have shared any receipts or unique codes with another person, your entries will be invalid and you will lose any right to a prize.
If I win a major prize, when must I claim my major prize?
If you are drawn as a major winner you will have 48 hours from the time of notification to claim your prize.
What if I don't claim my major prize on time?
If, despite all reasonable efforts, the Promoter can't contact a major prize winner (and they don't contact the Promoter), or a major prize winner chooses not to take the relevant prize, within 48 hours of notification the Promoter will discard the entry and randomly redraw another winner at 1pm (AEDT) on the Thursday after the original relevant major draw (at the same location as the original draw), who will be given 48 hours to claim the prize. To clarify, the unclaimed prize draws will be conducted (if there is an unclaimed major prize to re-award that week) on each Thursday between 08/10/15 and 04/02/16 (inclusive).
If you are a winner in any unclaimed prize draw, you will be informed by email, Facebook and SMS within 1 hour of the draw and your name and state/territory of residence will be published on the promotional page accessible via the Websites on the day after the draw for a period of 28 days. If you are a winner in any unclaimed prize draw, your name and state/territory of residence may also be published on the Promoter's Carlton Dry and/or Mercury Hard cider Facebook page/s.

3.In NSW, all advertising material for this competition will include a prominent message regarding responsible consumption of alcohol. Participation in this competition is subject to each Venue’s/Outlet’s liquor serving policy.
Entry
4.Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database. If you return a Qualifying Purchase your entry will be deemed invalid (unless product is defective). You will receive a return online message confirming your entry and letting you know if you have won an instant win prize. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.
5.Game Cards from any other competition cannot be used for this competition. Game Cards are void if forged, stolen or interfered with.
Prizes
6.If you win a minor prize, the prize must be taken on the date/s and time and at the location of the relevant festival to which you have won tickets. You and your companion must make your own way to and from that location. If the festival tickets include camping access, you and your companion are responsible for supplying and preparing all camping equipment necessary to attend the event. Festival tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant festival location. You must keep your tickets safe and the Promoter will not replace lost or stolen tickets.
7.If you win a major prize, your prize will be a trip for you and adult companion/s (as specified by the Promoter) to an Australian or international location specified by the Promoter, on dates to be specified by the Promoter, valued between $5,000 and $25,000 (depending on the location and the winner’s point of departure), and includes, for each of you and your companion/s:
a.return economy airfares (including airfare taxes) from your nearest Australian capital city to the destination (flights are not included if you live in the state/territory of the destination, and if so, you and your companion/s must make your own way to and from the destination at your own cost);
b.a minimum of two nights' twin share accommodation in a minimum three star hotel (or equivalent);
c.return transfers between the destination airport and hotel for you and your companion/s (not included if you live in the state/territory of the destination); and
d.access to additional activities, spending money and transport as specified by the Promoter.
8.All accommodation, activities and transport are subject to booking and availability. All minor and major prizes must be taken on/between the dates specified by the Promoter. You and your companion/s are responsible for all other costs related to the relevant prize, including any additional meals, additional transfer costs, insurance (including excesses), in-room charges and additional taxes. All persons taking a travel prize must depart and return at the same time. All prizes are subject to any additional conditions of the travel or prize supplier/s including any conditions of entry into an event, activity or festival venue (including behaviour requirements and applicable dress codes). Any failure by you or your companion/s to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s). Costs for changes made by you (or your companion/s) to any prize after it has been booked must be paid by you and your companion/s as applicable. If the trip is for travel overseas, you and your companion/s must ensure that each of you have all necessary documents to travel to the relevant destination, including a current and valid passport and any visas required.
9.If an event, festival or activity included in a prize is abandoned, called off or postponed for any reason, you and your companion/s forfeit your entitlement to that prize element and you will not be given any cash or alternative tickets as a substitute for attending the event or activity. If relevant, the winner/s will still receive all other components of the prize as long as they are still taken on the original dates.
General
10.If you are a winner, you (and your companion/s) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You (and your companion/s) consent to the Promoter using your names and images in any promotional or advertising activity. If you are a major prize winner, the Promoter or its nominee may make an audio-visual record of you and your companion/s taking the prize and may use that record (or an edited version of it) for any promotional or advertising activity.
11.You and your companion/s accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities.
12.In order to participate in the activity/activities awarded as part of the prize, you and your companion/s must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). You must ensure that you and your companion/s are healthy and fit enough to take the prize. The Promoter may deem that you or your companion/s are insufficiently healthy or fit. You and your companion/s must follow all requirements of the people responsible for managing the relevant activities.
13.You and your companion/s must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize. If you or any nominated companion does not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.
14.If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the prize on/between the dates specified, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
15.You must not:
a.tamper with the entry process;
b.engage in any conduct that may jeopardise the fair and proper conduct of the competition;
c.act in a disruptive, annoying, threatening, abusive or harassing manner;
d.do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
e.breach any law; or
f.behave in a way that is otherwise inappropriate.
16.You are responsible for your companion/s and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companion/s if any of them breaches these conditions, whether or not legally bound by them.
17.If you (or your companion/s, if applicable), in the opinion of the Promoter, are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion/s) from participating in any elements of the prize, at its discretion.
18.The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
19.The Promoter’s decision in connection with all aspects of this competition is final.
20.Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. If a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
21.By entering, you request that your full address not be published.
22.By accepting or participating in any prize, your companion/s accept these Terms and Conditions.
23.If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
24.The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
25.Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
26.Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
27.Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes. Prizes will only be delivered to addresses in Australia.
28.The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You provide your information to the Promoter and not to Facebook. You completely release Facebook from any and all liability.
Collection and use of your personal information
29.The information you provide will be used by the Promoter for the purpose of conducting this competition. The information your companions provide will be used by the Promoter for the purpose of fulfilling the prize and otherwise administering this competition. The Promoter may collect your or your companions’ personal information (including through its contractors or agents) or disclose your or your companions’ personal information to its related companies, contractors and agents to assist in conducting this competition, storing data or communicating with you or your companions. Those disclosures may include disclosures to organisations in locations such as the USA, the UK, India and Germany. By entering this competition, you consent to the storage of your personal information on the Promoter’s database and the Promoter may use this information to contact you with special offers, news and information about its products, including contacting you via electronic messaging. By entering this competition, you consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth). The Promoter’s Privacy Policy, located at
