TERMS AND CONDITIONS

1. Instructions on how to enter this promotion forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The promotion is open to Australian residents aged 18 years or older.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

4. Promotion opens 9.00am AEDST on Sunday 20th September 2015 and closes at 5.00pm AEDST on Sunday 13th December 2015 (“Promotional Period”).

5. This promotion is a game of skill and chance plays no part in determining the winner.

6. Eligible persons must enter via one of the following entry methods during the Promotional Period:
(A) Website Entry
(i) visit www.haymespaint.com.au/roomreveal
(ii) input the requested details, select their favourite ‘room reveal’ from the three options presented and in 25 words or less explain why they’d like to win the contents of the space
(iii) accept these Terms and Conditions
(iv) submit the fully completed entry form

(B) Facebook entry
(i) visit www.facebook.com.au/haymespaint
(ii) navigate their way to the Haymes Room Reveal Promotion tab on the Haymes Facebook page
(v) input the requested details and select their favourite ‘room reveal’ from the three options presented and in 25 words or less explain why they’d like to win the contents of the space
(iii) accept these Terms and Conditions
(iv) submit the fully completed entry form.

7. Multiple entries permitted per person, however each entrant will only be eligible to win one prize.

8. Each entry will be individually judged based on the originality, literary merit and creative merit of the answer provided to the promotional question. Winners will be judged on Thursday, 21st January 2016 at 11am at 224 Normanby Rd, Southbank, VIC 3066 and winners will be notified by email within 2 business days of a determination being made. The winners’ name and state of residence will be published on the Promoter’s website and Facebook page on or before Monday 8th February 2016.

9. The best three valid entries for each room, as determined by the judges, will win the following corresponding prize:
a. Room Reveal #1 – Haymes Paint in collaboration with Kip & Co:
i. Prize includes cord bean bag, linen cot fitted sheet, bamboo swankie blankie, fringe swish swish blanket, wall hanging rainbow hills, rainbow cushion, rug, The Family Love Tree ‘palm tree planter’ large and Incy Interiors ‘Teeny’ cot. Approximate retail value $3,000
ii. Haymes premium paint in colour of the winner’s choice to the retail value of $1,000.
b. Room Reveal #2 – Haymes Paint in Collaboration with The Family Love Tree and Clair Bremner:
i. Prize includes custom recycled timber buffet, 1950’s patio chair, cushion, rug, phone, 2 x small pots, horse ornament, mug, mirror, Unearthed wall planters 1x large and 1x medium. Approximate retail value $3,800
ii. Haymes premium paint in colour of the winner’s choice to the retail value of $1,000.
c. Room Reveal #3 – Haymes Paint in Collaboration with Madeleine Stamer and Phillip Withers:
i. Prize includes Phillip Withers landscape design consultation, Madeleine Stamer bespoke ceramic flower, cushion and custom wall hanging, The Family Love Tree 1950’s zig zag outdoor chair, The Family Love Tree ‘palm tree planters’ 2x large and 1x small, Bloomingville nature storage basket, Morgan & Finch sea grass storage baskets 1x large and 1x medium, large white belly basket, mint belly basket, brass jug and armadillo rug. Approximate retail value $3,200

ii. Haymes premium paint in colour of the winner’s choice to the retail value of $1,000.

10. Estimated total prize pool valued at: A$13,000 including GST.

11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

12. Entries are deemed to be received at the time they are received by the Promoter and not at the time of submission by the entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence due to error, omissions, tampering, deletion, theft, communications failure or otherwise. Incomplete, indecipherable or illegible entries will be deemed invalid.

13. Winners will be contacted to arrange a mutually convenient time for the prize to be delivered/collected. The promoter undertakes to ensure delivery of all prizes by Friday 26 February 2016.

14. The Promoter’s decision is final and no correspondence will be entered into.

15. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value.

16. If for any reason a winner does not take/redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.

17. Prizes are not transferable or exchangeable and cannot be taken as cash.

18. Winners consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

20. Any cost associated with submitting an entry or accessing the Haymes promotional website or Facebook page is the entrant’s responsibility.

21. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of a gift.

23. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.haymespaint.com.au/information/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entrant’s PI will not be disclosed to any entity outside of Australia.

24. As a condition of entering, the entrant may be required to sign any legal documentation as and in the form required by the Promoter and/or reward suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

25. Entry and continued participation in the promotion is dependent on entrant’s following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
