HOW TO ENTER:

2.Then, complete the entry form below including your personal details and in 40 words or less, tell us: “How does Oprah inspire you to live your best life?” The responses will be judged to determine the winners.

Competition starts 19th November and ends 29th November 2015.

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian and New Zealand residents aged 18 years.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences on 19/11/2015 and final entries close at 11:59pm AEDST on 29/11/2015 (“Promotional Period”).

5. To be eligible to enter, individuals either must be an existing Weight Watchers member as at 19/11/2015, or they must sign up to become a Weight Watchers member during the Promotional Period.

6. To enter, eligible individuals must then complete the following steps during the Promotional Period:
•a) visit http://shop.weightwatchers.com.au/meetoprah for Australian residents or http://shop.weightwatchers.co.nz/meetoprah for New Zealand residents and follow the prompts on the promotion entry page;
•b) input the requested details (including their full name, telephone number, State/Territory of residence, postcode and a valid email address);
•c) provide an original and creative answer to the promotional question “How does Oprah inspire you to live your best life?” in 40 words or less;
•agree to these Terms and Conditions by ticking the relevant tick box; and
•submit the fully completed entry form.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Only one (1) entry is permitted per person throughout the Promotional Period. Entrants may only use one (1) email address to enter the promotion

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

11. This is a game of skill and chance plays no part in determining the winners.

12. All valid entries received during the Promotional Period will be individually judged against each other based on the originality, literary merit and creative merit of the answer provided to the promotional question. The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in the event any potential winner is determined to have submitted an invalid entry or is deemed an ineligible entrant.

13. The best thirty (30) valid entries, as determined by the judges, will each win a VIP Experience for the winner only at the ‘An Evening with Oprah’ event in Sydney, NSW scheduled to take place on 12/12/2015 (“Major Prize”). The Major Prize includes:
•return economy airfares from winner's nearest domestic airport (if winner resides in Australia - only provided if the winner's nearest domestic airport isn't the Sydney Airport) or from the nearest international airport (if winner resides in New Zealand) to Sydney, NSW. If the winner’s nearest domestic airport is the Sydney Airport, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash;
•return transfers from the airport to the accommodation in Sydney. If the winner's nearest domestic airport is the Sydney Airport, then the prize does not include airport transfers and the airport transfer component of the prize is not redeemable for cash;
•one (1) night accommodation at a hotel in Sydney (exact hotel determined by the Promoter), with check-in on 12/12/2015 and check-out on 13/12/2015;
•return transfers from the accommodation to the 'An Evening with Oprah' event;
•a VIP experience at the 'An Evening with Oprah' event at Allphones Arena in Sydney on 12/12/2015, including an opportunity to meet, and have a photograph taken with Oprah Winfrey in a VIP setting, and a ticket to attend the show.

14. The following conditions apply to the Major Prize: Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to correspond with the 'An Evening with Oprah' event in Sydney, NSW on 12/12/2015 and is subject to booking and flight availability. Each winner is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Each winner must depart from and return to the same departure point. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Each winner may be required to present their credit card at time of accommodation check in.

15. Major Prize winners will be notified by email, and their names will be published online at www.facebook.com/WeightWatchersAUNZ on 30/11/2015.

16. Once the Major Prize winners have been selected, all remaining entries (i.e. all entries received during the Promotional Period excluding the entries received from the Major Prize winners) will then be divided into the following six (6) groups based on the entrant’s State/Territory or country of residence: (1) VIC/TAS; (2) NSW/ACT; (3) WA; (4) QLD; (5) SA/NT; and (6) NZ (each a "Group"). The entries received in each Group will be individually judged against all other entries received in that Group based on the judging criteria outlined in clause 11 above. The judges may select additional reserve entries in each Group which they determine to be the next best, and record them in order of merit, in the event any potential winner is determined to have submitted an invalid entry or is deemed an ineligible entrant.

17. The best valid entries in each Group, as determined by the Promoter, will each win one (1) ticket to 'An Evening with Oprah' event (each a "Minor Prize"). The exact number of Minor Prizes awarded in each Group, and the exact location and date of the Minor Prize event each winner will attend, is outlined in the table below:

18. Minor Prize winners must follow the instructions specified by Promoter to collect their ticket from the relevant venue prior to the 'An Evening with Oprah' event they have won a ticket to. Any ancillary costs associated with redeeming a Minor Prize including but not limited to any travel and//or accommodation costs, spending money, meals, taxes, items of a personal nature and all other ancillary costs are the responsibility of the Minor Prize winners and are not included in the Minor Prize. Should tickets not be collected redeemed for the applicable Minor Prize event they will be void and Promoter will have no further obligation to such winner.

19. Minor Prize winners will be notified via email between 30/11/2015 and 4/12/2015.

20. The Promoter’s decision is final and no correspondence will be entered into.

21. If for any reason a winner does not take/redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

23. The 'An Evening with Oprah' ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

24. The VIP experience awarded as part of the Major Prize provides each winner with an opportunity to meet Oprah, and an opportunity to have a photograph taken with Oprah. These elements of the prize are not guaranteed and are subject to the goodwill of Oprah on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.

25. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

26. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to answers to the promotional question ("Content"). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
•they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
•their Content shall not contain viruses or cause injury or harm to any person or entity;
•they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
•the Content is the original work of the entrant that does not infringe the rights of any third party;
•they consent to any use of the Content which may otherwise infringe the Content creator's/creators' moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
•they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

27. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any 'An Evening with Oprah' event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a prize.

33. As a condition of accepting a prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

34. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at  www.weightwatchers.com.au/legal/privacy.aspx.  In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Australian entrant’s personal information to any entity outside of Australia.

35. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
