The following Terms and Conditions apply to the Samsonite Australia & New Zealand ‘Ten Years of Curv’ Competition (the “Competition”):

ABOUT THE COMPETITION

    The Competition is run by Samsonite Australia Pty Ltd (ABN 310 063 63 248) of 5 Anzed Court, Mulgrave, 3170. Telephone (03) 9549 3444.

    The Competition opens at 11.00am (AEST) on Monday 19th October 2015 (the “Opening Date”) and closes at 11.59pm (AEST) on Tuesday 1st   December 2015 (the “Closing Date”). Entrants can submit 3 images per Facebook account per week.

    The Competition consists of three (3) major prize components and twenty one (21) minor prizes (20 minor prizes will be selected at the end of week 5, 1 minor prize to be selected at end of voting week).

    The competition can be entered through a Facebook application on the Samsonite Australia & New Zealand Facebook page.

ELIGIBILITY

    The Competition is only open to Entrants currently residing in Australia and New Zealand and are aged 18 years or over. The Competition is specifically closed to employees of Samsonite Australia and New Zealand, any associated companies, their agencies and their immediate families and anyone else connected with the creation and administration of the promotion.
    Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

    No entries shall be accepted before the Opening Date or after the Closing Date. Third party or bulk entries will not be accepted and entries not in accordance with the entry instructions are invalid.

    Your entry must not disparage Samsonite or any other party affiliated with the promotion or administration of the Competition. Samsonite Australia & New Zealand reserves the right, at its sole discretion, to disqualify any entry which it believes is in breach of this clause.

 

    Entrants will be notified by a thank you page on the Facebook competition app to alert them that their entry has been received.  Once their entry has been assessed by Samsonite, the entrant will receive a Facebook notification indicating if their entry has been approved or rejected. Samsonite Australia & New Zealand does not accept any responsibility for any Entries not being properly recorded or received. Samsonite Australia & New Zealand does not accept any responsibility for any network congestion, technical failure or other problem which results in any Entries not being properly recorded or received.

    NO PURCHASE OF ANY KIND IS NECESSARY TO TAKE PART IN THIS COMPETITION. You do not have to buy or own any Samsonite product in order to enter this Competition.

HOW TO ENTER

    To enter the Samsonite Australia & New Zealand ‘Ten Years of CURV’ individuals must complete the following steps during the Entry Period:

 

Submissions Stage:

    Visit the Samsonite Australia & New Zealand Facebook page and click on competition App https://www.facebook.com/SamsoniteAustraliaNZ
    Entrants are required to upload an image based on a different weekly travel topic. Photograph must be under 5mb in size in jpg format.
      Entrants will be limited to 3 entries per week per Facebook account.
        Week 1  - 19th  October – 25th October 2015 -  Iconic Location
        Week 2 – 26th October – 1st November 2015 – The Great Outdoors
        Week 3 – 2nd November – 8th November 2015 – Incredible Cities
        Week 4 – 9th November – 15th November 2015 – Beautiful Landscapes
        Week 5 – 16th November – 22nd November 2015 – Luxury Escapes

 

     Entrants must complete the entry form including their:
        first name
        surname
        postcode
        Country of residence
        valid email address
        date of birth
        best  day time contact phone number
        List the location at which this photo was taken
    Agree to the terms and conditions.
    Entrants may choose to subscribe to the Samsonite Mailing list to receive further communications from Samsonite
    Entrants may choose to subscribe to the Olympus mailing list to receive further communications from Olympus
    Entrants will have the option to share the competition link
    All entries will be assessed by independent scrutineers at FRANk media, 36B St Edmonds Road, Prahran VIC 3181 (on behalf of the promoter). Frank Media has the right to reject any entries that are deemed inappropriate for the Samsonite/Facebook audience or are not in line with the weekly photography topic/theme:
    All entrants will receive a Facebook notification as to whether their entry has been accepted and has been housed in the photo gallery or if the entry has been rejected. The Promoter’s decision is final and no further correspondence will be entered into.

    All submitted and approved photos will appear on a Photo Gallery on the Samsonite Australia & NZ Facebook page during the promotional period. This will be open to the public to view.
    On Monday 23rd November, the Top 20 entries will be selected by a panel of judges at FRANk media 36B St Edmonds Road, Prahran VIC 3181.
    The Top 20 entries will be notified via email if they have been successful in making it into the voting stage.

 

 


Voting Stage:

    The top 20 images will go live on a display gallery for the public to vote at 11am on 24th November 2015. Voting will be open until 11.59pm, 1st December. No votes before or after this time will be counted. 
    Voting will be limited one vote per Facebook account, all voters will also be required to enter their details to vote including their first and surname, state, valid email address, date of birth and valid best contact phone number.
    Only votes from Australian and New Zealand residents will be counted
    Any finalist suspected of manipulating the voting system, in a way that is deem inappropriate by Samsonite (e.g. incentivising voters, misleading or using falsified accounts) will be disqualified from the competition.
    Votes from third party sources or Facebook users residing outside Australia and New Zealand will not be accepted in this competition.
    At any point in the competition the Promoter can disqualify finalists and votes for manipulating the voting systems.

 

DRAW & PRIZE

    Minor Prizes Draw – A total of 21 minor prizes will be given out (20 top entries and 1 Lucky Draw Prize). The top 20 entries will be selected by a panel of judges at FRANk Media Pty Ltd 36B St Edmonds Road, Prahran VIC 3181 (Draw Location) as a representative of the Promoter.
    Schedule of Minor Prize Draws:
    20 Minor Prizes winners will be selected on Monday 23rd November 2015. The winners will be contacted by email and announced on Tuesday 24th November 2015 via the Samsonite Australia & New Zealand Facebook Page.
    1 Lucky draw winner will be conducted at 12pm on Wednesday 2nd December 2015. The winner will be contacted by Email and announced on Thursday 3rd December 2015 via the Samsonite Australia & New Zealand Facebook page. 
    Minor Prizes – The top  twenty (20) Eligible Entrants will each win:
    1 X Convertible Travel Pillow $34.95
    1 X RFID Covers $24.95

(Total $59.90)

    Minor Prizes –the Lucky Draw Winner (1) will win:
    55cm Cosmolite $579


(Total $579)

    All Minor Prizes will be dispatched after Friday 4th December 2015.

    The Major Draw winners will be notified via email within two days after to closing date of voting (1st December 2015). The details will be published on the Samsonite Australia Facebook page on Friday 4th December 2015.

    Major Prize – The first Eligible Entrant with the most votes will win:

    One x Samsonite Cosmolite 55cm $579.00 RRP
    One x Olympus OM-D-E-M10 Mark II Single Lens Kit –RRP $999
    One x $2000 Travel Voucher

The second Eligible Entrant with the second most votes will win:

    One x Samsonite Cosmolite 75cm $849
    One x Olympus OM-D-E-M10 Mark II Single Lens Kit –RRP $999
    One x $1000 Travel voucher

(Total $2,848)
The third Eligible Entrant with the third most votes will win:

    One x Samsonite Cosmolite 75cm $849
    One  $500 Travel Voucher

(Total $1,349)

    The total value of the Prize pool available to be won in the Promotion is valued at up to $10,401 (Including GST).

    If a draw relating to the number of votes effects the determining of 1st, 2nd or 3rd place, we will do an electronic draw to determine the winner of the affected placing. The loser of the draw will be awarded the next place down and so on.

    The major prize winners will be given three (3) months to claim their prizes. If the winners do not respond within this time, Samsonite reserves the right to select another winner based on the next most voted for images who has not yet received a prize. This will be determined at 12pm on the 4th March 2016, at FRANk Media 36B St Edmonds Road, Prahran Vic 3181, subject to any directions from a regulatory authority.

    The re-selected winners, if any, will be notified by telephone and email and a message being published on the Samsonite Australia website and Facebook page from Tuesday 8th March, 2015

    The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants are providing their information to Samsonite Australia & New Zealand and not to Facebook. The information provided will only be used for purposes as detailed in clause 27.

    Samsonite Australia & New Zealand shall not be liable for any claims or complaints of any nature with respect to the Prize. There is no cash alternative and the Prize is not negotiable, transferable or returnable.

    Luggage and camera colours will be selected by the promoter.

    The Winner agrees not to sell, offer to sell or use the Prize for any commercial or promotional purposes (including the Prize on an internet auction site).

    By entering this Competition, Entrants expressly authorise unlimited access for Samsonite Australia & New Zealand, without further consideration, to transmit, reproduce, communicate and broadcast entries including photography on any Samsonite Australia & New Zealand business and marketing collateral; including but not limited to company website, email communications, social media channels.

    The Winner agrees to take part in post-Competition publicity at the request of Samsonite Australia & New Zealand. By entering the Competition, Entrants agree to Samsonite’s unrestricted use of any post-Competition publicity for Samsonite’s own purposes in all activities, without limitation, marketing and promotional activities worldwide including use on the Samsonite websites and social media channels.

    Information regarding personal data provided in the Entry will be held and processed in a database for the purpose of managing entry into the Competition. The information will not be used for any other purpose than as stated in these Terms & Conditions or as separately accepted by you. If you have separately agreed to receive communications from Samsonite Australia & New Zealand or any other party then your personal data may be used by them for such purposes, including direct marketing.

GENERAL

    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    The Promoter reserves the right, at any time, to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information that have been submitted through the use of multiple identities, email addresses or accounts.

    Incomplete or indecipherable entries will be deemed invalid.

    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    The Promoter’s decision is final and no correspondence will be entered into.

    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

        any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
        any theft, unauthorised access or third party interference;
        any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
        any variation in prize value to that stated in these Terms and Conditions;
        any tax liability incurred by a winner or entrant;
        or participation in a prize.

    As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

     The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. By providing your email address, you grant the promoter, Samsonite Australia, the right to send you promotional email messages. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

    The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

    Any personal data that you provide will be held and processed in accordance with the requirements of the 1998 Data Protection Act.

 

    Samsonite Australia & New Zealand reserves the right to amend these Terms and Conditions and/or cancel the Competition, subject to approval from the relevant statutory authority.
