What is "Year of the sheep"?

2015 is the Year of the Sheep according to the Chinese Zodiac. It starts on February 19, 2015 and lasts until February 7, 2016.

HOW DOES THE PROMOTION WORK?

It’s very simple! We have 4 fantastic Isuzu D-Max Utes to give away during the Year of the Sheep!

All you have to do is purchase any listed product from the Bayer Sheep range to be in with a chance to win a Ute!

Certain products in the range will entitle you to a higher number of entries. For example, purchasing 1 drum of Piranha Dip for sheep will entitle you to 25 entries whereas purchasing 1 pack of Cobalife VB12 will entitle you to 1 entry. “YEAR OF THE SHEEP” PROMOTION (“Promotion”)
TERMS AND CONDITIONS

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these and any other applicable terms and conditions (together the “Terms and Conditions”). Any entry not complying with the Terms and Conditions is invalid.

2. Entry is only open to Australian residents aged 18 years or over or over who have opted to take part in the Promotion.

3. Employees (and their immediate families) of the Promoter, participating retailers, and the design agencies associated with this Promotion (and each of their immediate families) are ineligible to enter.

4. Promotion commences on 19/02/2015 and final entries close at 11:59pm AEDST on 17/02/2016 (“Promotional Period”).

5. To enter, individuals must complete the following steps during the Promotional Period:

a) purchase any one (1) or more Participating Product(s) (defined in the table below) in a single transaction from a participating retailer (“Qualifying Transaction”). For the purposes of this Promotion, a participating retailer will be any retailer that shelves Participating Product(s) during the Promotional Period; and then

b) visit www.yearofthesheep.com.au, follow the prompts to the promotional entry page, input the requested details (including their full name, telephone number, a valid email address, and the name and quantity of each Participating Product purchased in the Qualifying Transaction), and submit the fully completed entry form (“Entry Form”).

Subject to clause 6, the number of entries an entrant will receive from a single transaction will be dependent on the Participating Product(s) purchased in the Qualifying Transaction, as outlined in the table below.

6. Individuals that submit an Entry Form (in accordance with clause 5 (b)) in respect of a Qualifying Transaction between 12:00am (local time) on 01/09/2015 and 11:59pm (local time) on 30/09/2015 (“Double Entry Period”) will receive double the entries stated in the above table in clause 5 for every respective Participating Product purchased in that Qualifying Transaction. For the sake of clarity, individuals that complete the Qualifying Transaction prior to the Double Entry Period (but during the Promotional Period) will still be eligible to receive double entries, provided that they submit an Entry Form in respect of that Qualifying Transaction during the Double Entry Period. For example, individuals will receive 50 entries for every Piranha 2.5L product purchased in a Qualifying Transaction for Entry Forms submitted during the Double Entry Period, 30 entries for every Avenge 20L product purchased in a Qualifying Transaction for Entry Forms submitted during the Double Entry Period, 14 entries for every Selovin product purchased in a Qualifying Transaction for Entry Forms submitted during the Double Entry Period, etc.

7. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to be submitted by the relevant closing date and such entries will be deemed invalid.

8. Multiple entries permitted, subject to the following: (a) only one (1) entry form submission permitted per Qualifying Transaction/invoice; (b) entrants will receive the corresponding number of entries outlined above (in clauses 5 and 6, as applicable) for each relevant Participating Product they purchase in the Qualifying Transaction; (c) each entry must be submitted in accordance with entry requirements; (d) only one (1) prize permitted per person (excluding residents of SA).

9. Entrants must retain their original purchase invoices(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase invoices(s) must clearly the Participating Product(s) purchased and that the purchase was made during the Promotional Period but prior to entry.

10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

11. There will be four (4) draws conducted for the entries received during the Promotional Period (each a “Prize Draw”). Entries open on 19/02/2015 and close for each Prize Draw at 11:59pm on the dates specified in the table below. All Prize Draws will take place at Tactics Marketing Support, Unit 6, 106 Old Pittwater Road, Brookvale, NSW 2100 at 10:00am on the dates specified in the table below. The winner of each Prize Draw will be drawn at random and will be the first valid eligible entry drawn. Non-winning entries in each Prize Draw will be entered into any subsequent Prize Draw(s). All times indicated are in AEST/AEDST, as per local NSW time. Winners will be notified by telephone and in writing within two (2) business days of the relevant Prize Draw and their names will be published online at www.farmadvisor.com.au from the dates specified in the table below.

12. The Promoter’s decision regarding the prize winners and all other aspects of this Promotion is final and no correspondence will be entered into.

13. The first valid entry drawn randomly in each Prize Draw will each win a new 2014 Isuzu D-MAX 4x4 LS-M Crew Cab Ute with manual transmission. Total prize value is up to RRP$49,697 including one year’ registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner’s colour preference (excluding metallic options), subject to availability. The winner must collect the prize from their nearest authorised IUA dealership.

14. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner (or a representative of the winner) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

15. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the will be forfeited.

16. If any prize is unavailable, or has changed since the Promotion commenced, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

17. Total prize pool value is up to RRP$198,788.

18. Prizes are not transferable or exchangeable and are not redeemable for cash.

19. If a provisional winner cannot be contacted within three (3) months following the relevant Prize Draw, or if the Promoter determines that a provisional winner is not an eligible entrant or is not eligible to accept the prize, or if a provisional winner does not take the prize within three (3) months of the relevant Prize Draw, a draw for any unclaimed prizes in any Prize Draw may take place at the same time and place as the original draws on the dates outlined in the table below, subject to any directions from a regulatory authority. The Promoter is not responsible if the winner cannot be contacted within the three (3) month period due to incorrect or out of date contact details being provided. Winners, if any, will be notified by telephone and in writing within two (2) business days of the draw and their names will be published online at www.farmadvisor.com.au from the dates outlined in the table below.

20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter, including, without limitation, announcing the winner on its website www.farmadvisor.com.au and on other Australian Bayer Animal Health websites run by or for the Promoter.

21. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

22. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

23. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including (without limitation) in connection with a Prize Draw or the use of a prize.

25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize.

26. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

27. By entering the Promotion, entrants agree to the Promoter collecting, storing and using their personal information for marketing purposes, including contacting by electronic messaging (email and SMS) for the purposes of marketing and administration, including to contact the entrant about future promotions, special offers, goods and/or services. Entry is conditional on providing personal information. The Promoter and/or a nominated prize supplier/s, may use any personal information entrants provide in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. The Promoter may disclose the personal information entrants provided for those purposes to its related bodies corporate, contractors, service providers, prize suppliers and agencies connected with this Promotion and to relevant Australian regulatory authorities. As the Promoter is a global organisation, unless otherwise indicated entrants’ information may be stored overseas and maintained in accordance with Bayer Australia’s Privacy Policy which can be viewed at www.bayer.com.au (for a list of countries, see the Promoter’s Privacy Policy).

28. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). For the purposes of administering this Promotion the Promoter’s Privacy Policy can be viewed at www.bayer.com.au. To request access to, or to update/correct, personal information the Promoter holds about them, entrants can contact the office of the Promoter or. Privacy.officer@bayer.com. The Bayer Privacy Policy contains details on how entrants may complain about a breach of the Australian Privacy Principles and any other applicable law and how those complaints will be dealt with.

29. In addition to the privacy terms set out above; if an entrant has ticked an “opt-in” box upon entering the Promotion, the entrant also agrees to the Promoter disclosing and using their personal information to a nominated prize supplier and/or a third party directly associated with the Promotion, as nominated in the consent, to contact them about that parties special offers, updates, and or, for the purposes of direct marketing (including via electronic means).
