Participation in the Promotion is deemed acceptance of these Conditions of Entry.

The entrant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Conditions of Entry generally.
All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on every person who enters. No correspondence will be entered into.

PROMOTION PERIOD
The Promotion will commence at 12.01am AEDT on 17/12/2015 and conclude at 11.59pm AEDT on 31/01/2016 (Promotion Period), or when the allocation of unique Promotion entry codes (Promo Codes) is exhausted for residents of Australia and the allocation of scratch cards (Scratch Cards) is exhausted for residents of New Zealand, whichever occurs first.
WHO CAN PARTICIPATE
Entry in the Promotion is only open to Australian and New Zealand residents, who have their parent/guardian’s permission to enter if under 18 years of age, excluding:
(a)management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes);
(b)a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 9(a) of these Conditions of Entry;
(c)persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrants). The persons referred to in paragraph 9(b) of these Conditions of Entry includes natural and non-natural relations (in the opinion of the Promoter). The Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO PARTICIPATE
To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:
(a)purchase any Eligible Product (as defined below in paragraph 12) from a Participating Outlet (Qualifying Purchase);
(b)collect a Promo Code (in Australia) or Scratch Card (in New Zealand) from staff at the time of making the Qualifying Purchase (while Promo Codes last);
(c)if the Eligible Entrant has not downloaded the HOYTS app previously, using a compatible mobile device, download the HOYTS app from the mobile device’s relevant app store;
(d)follow the links in the HOYTS app to access the Promotion entry form (Online Entry Form); and
(e)fully complete and submit the Online Entry Form by providing:
i.their Promo Code/unique code printed on their Scratch Card;
ii.all details requested by the Promoter, including but not limited to their first name, surname, date of birth, email address, contact phone number, postcode and state/territory or region; and
iii.indicating their acceptance of these Conditions of Entry,
(Eligible Entry).

Eligible Entrants may submit a limit of six (6) Eligible Entries on any given day during the Promotion Period, subject to each Eligible Entry corresponding to a separate Promo Code/Scratch Card.
All Promo Codes submitted in an Eligible Entry and Scratch Cards will have the chance to win an Instant Prize (as defined in paragraph 24) and upon submission of the Eligible Entry will also be entered in the Major Prize Draw (as defined in paragraph 27) for the chance to win the Major Prize (as defined in paragraph 28).
Eligible Entrants must use a compatible mobile device to access the HOYTS app and the Online Entry Form. Any costs associated with accessing the HOYTS app and the Online Entry Form are the entrant’s responsibility and are dependent on the internet service provider used.
The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times during the Promotion Period.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
Entries are deemed to be received at the time of receipt into the Promoter's database, not the time of transmission by the entrant.
Entrants can only enter the Promotion in their own name. Entrants who enter using multiple aliases (i.e. multiple names, addresses and/or email addresses) will be disqualified.
VERIFICATION
Eligible Entrants must retain their original Promo Code/Scratch Card in order to claim an Instant Prize or the Major Prize (if won).
If requested by the Promoter, Eligible Entrants must produce, within the time requested by the Promoter at its absolute discretion:
(a)appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize (if won) and compliance with these Conditions of Entry; and
(b)their Promo Code/Scratch Card that corresponds to all entries they have submitted in the Promotion.
If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the Eligible Entrant will be deemed invalid. A prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that an Eligible Entrant cannot provide suitable validation or verification, the Eligible Entrant will forfeit their prize and no substitute will be offered.
INSTANT PRIZES
Residents of Australia - Upon submitting an Eligible Entry, the Eligible Entrant will be notified via on-screen notification whether or not they have instantly won a prize from the prize pool in paragraph 25 (Instant Prize). If an Eligible Entrant is notified that they have won an Instant Prize, the Eligible Entrant must follow the on-screen prompts to claim their Instant Prize. All Instant Prize winners will also receive an email sent to the email address supplied in their winning Eligible Entry with their Instant Prize and claim details. Regardless of whether an Eligible Entrant is an Instant Prize winner or not, their Eligible Entry will be entered into the Major Prize Draw.
Residents of New Zealand – Eligible Entrants must scratch the latex panel on their Scratch Card to reveal whether or not they have won an Instant Prize. In order to claim an Instant Prize, the Eligible Entrant must submit their Eligible Entry and follow the on-screen prompts to claim their Instant Prize. All Instant Prize winners who submit an Eligible Entry will receive an email sent to the email address supplied in their Eligible Entry with their Instant Prize and claim details. Regardless of whether an Eligible Entrant is an Instant Prize winner or not, their Eligible Entry will be entered into the Major Prize Draw. An Eligible Entrant who is not an Instant Prize winner can submit an Eligible Entry into the Major Prize Draw.

All Instant Prize vouchers expire 23/03/2016 (excl. StarCash Cards - see card for expiry). The total value of Instant Prizes available to be won in the Promotion is AUD$1,034,348 RRP (including GST) for residents of Australia and AUD$170,352 RRP (including GST) for residents of New Zealand.
MAJOR PRIZE DRAW AND MAJOR PRIZE DETAILS
A random electronic prize draw consisting of all Eligible Entries received in the Promotion will be conducted by a representative of the Promoter at Prime Focus, 403/62 Beach Street, Port Melbourne, VIC 3207 (Draw Location) at 12 noon AEDT on 01/02/2016 (Major Prize Draw).
The first Eligible Entrant with an Eligible Entry drawn in the Major Prize Draw will win the opportunity to play the Game (as defined in paragraph 30) for the chance to win $1,000,000 (Drawn Participant). The Promoter may draw additional Eligible Entrants in the Major Prize Draw and record them in order to use in the event the Drawn Participant or nominated proxy cannot attend the Game.
The Game will take place at Nova 96.9, Level 5, 33 Saunders Street, Pyrmont NSW 2009 (Game Location) between 6.00am and 9.00am AEDT on 05/02/2016. The exact time of the Game will be advised by the Promoter closer to the Game.
The Game will consist of 50 cans of Coca-Cola:
(a)one (1) can of Coca-Cola will contain a promotional message representing the $1,000,000 prize; and
(b)the other 49 cans of Coca-Cola will each contain a promotional message representing a $20,000 consolation prize, (Game).
Prize money will be awarded to the winner via transfer to the winner’s nominated Australian or New Zealand bank account.
To play the Game, the Drawn Participant must choose only one (1) can of Coca-Cola without touching, handling or interfering in any way with any of the other cans of Coca-Cola on display. If the Game Participant is found to have breached this condition, he/she will be disqualified.
If the Drawn Participant selects the can of Coca-Cola containing the promotional message representing the $1,000,000 prize, then, subject to verification by the judges, the Drawn Participant will win the $1,000,000 prize.
If the Drawn Participant selects a can of Coca-Cola containing a promotional message representing a consolation prize, then the $1,000,000 prize will not be given away and, subject to verification by the judges, the Drawn Participant will receive the consolation prize as described in paragraph 30(b).
Two (2) nights’ accommodation at an establishment selected by the Promoter (minimum three (3) stars, twin-share) is included in the prize. The Drawn Participant may select a companion to attend the Game with them and share their accommodation. If the Drawn Participant is under 18 years of age, their companion must be aged 18 years or older and agree to act as their guardian. The Drawn Participant must hold a valid credit card and present it upon check in at the accommodation establishment to cover any incidental or other hotel charges.
If the Drawn Participant resides outside of New South Wales, the Promoter will liaise with the Drawn Participant to organise travel for the Drawn Participant and their nominated companion to and from Sydney in order for the Drawn Participant to play the Game, which will include return economy flights from the Drawn Participant’s nearest capital city to Sydney, and airport/hotel/Game location transfers. Flights must be taken to coincide with the Game, departing and returning on the date/s as determined by the Promoter in its absolute discretion. Spending money, meals, taxes (excluding airline and airport taxes if applicable), insurance, transport to and from departure point, additional transfers and all other ancillary costs are not included. All travel components be taken together as a single trip as booked by the Promoter. Once booked, no changes to the booking are permitted.
Participation in the prize is subject to such other terms and conditions as may be imposed by those involved in providing the goods or services included in the prize (Third Party Terms). The Drawn Participant and nominated companion are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behavior while a participant in the prize. The Promoter assumes no liability (and will provide no compensation) to the Drawn Participant and/or nominated travelling companion who, as a result of any failure to comply with any Third Party Terms, is unable to participate in the prize (or any part of it); or suffers any other loss or damage.
If the Drawn Participant cannot attend the Game, the Drawn Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided that the Drawn Participant gives the Promoter written, signed notice to that effect at least 48 hours before the start of the Game.
The Drawn Participant’s odds of winning the $1,000,000 prize are 1 in 50.
Total maximum potential Major Prize value is up to $1,000,000.
If the prize winner resides in Australia the prize money will be awarded in Australian Dollars, and if the prize winner resides in New Zealand the prize money will be awarded in New Zealand Dollars.
The Major Prize cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If the Major Prize is obtained through any of these methods, it will not be honoured.
NOTIFICATION OF MAJOR PRIZE WINNER
The Drawn Participant will be notified in writing and by phone, and advertised on
www.HOYTS.com.au and
www.HOYTS.co.nz from 02/02/2016.
RE-DRAW (IF ANY)
If the Drawn Participant is not contactable or does not claim the prize by 11.00am AEDT on 03/02/2016 (and there are no reserve Eligible Entrants drawn in accordance with paragraph 28 remaining), a random electronic re-draw will be conducted at 12 noon AEDT on 03/02/2016 at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from the relevant gaming departments (Re-Draw).
The Re-Draw Drawn Participant (if any) will be notified in writing, and advertised on

www.HOYTS.co.nz from 04/02/2016.
If a $100 Ibis Hotel Voucher or StarCash Card remains un-won at the 11.00am AEDT on 03/02/2016, these will also form part of the Re-Draw. Any other un-won Instant Prizes will be distributed in the Promoter’s discretion.
GENERAL
The total maximum prize pool available to be won in the Promotion is up to AUD$2,204,700 RRP (including GST). The total maximum prize pool available to be won in Australia is up to AUD$2,034,348 RRP (including GST). The total maximum prize pool available to be won in New Zealand is up to AUD$1,170,352 RRP (including GST).
The total number of Promo Codes available across the Participating Outlets in Australia is 840,000 and the total number of Scratch Cards available across the Participating Outlets in New Zealand is 160,000.
Printing errors or other quality control matters outside the control of entrants will not be used as the sole basis for refusing to award a prize.
Scratch Cards are void if stolen, forged, mutilated or tampered with in any way.
Unless otherwise due to fraud or ineligibility under these Conditions of Entry all existing claims to Instant Prizes will be met even in the instance that the advertised prize pool has been exceeded.
Please note – between 25/01/2016 and 29/01/2016 inclusive, the “Fitzy & Wippa” radio show may award up to 50 single entries in to the Major Prize Draw.
Prizes are not transferable, exchangeable or redeemable for cash, unless otherwise stated in these Conditions of Entry. The prizes must be taken as offered and may not be varied.
The Promoter shall not be liable for a prize being lost, stolen, damaged or tampered with in any way before it reaches the winner or after it has been released to the winner.
The Promoter accepts no responsibility whatsoever for any variation in the value of the prizes from the time of printing Promotion materials.
The Promoter accepts no responsibility whatsoever for any entries not received for any reason during the Promotion Period. The Promoter does not warrant that the entry mechanism will be available, or the Participating Outlets will be open, at all times during the Promotion Period.
If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to relevant gaming regulations, including cancelling, terminating, modifying, postponing or suspending the Promotion.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
The:
(a) Promoter, the Promoter's related entities and all agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors, of all entities referred to in paragraph 58(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
The prize winners must, at the Promoter's request, participate in any Promotion activity (such as, but not limited to publicity, advertising, filming and photography) relating to the winning of a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material in perpetuity.
The Promoter accepts no responsibility whatsoever for any tax liabilities that may arise from winning or receiving the benefit of a prize.
CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
PERSONAL INFORMATION
Immediately upon submission by an entrant, all entries become the sole property of the Promoter.
All information entrants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion, contacting and verifying the winners and awarding prizes.
Should an entrant's Personal Information change during the Promotion Period, it is the entrant's responsibility to notify the Promoter by contacting the Promoter using the Contact Us form on the Promotion Website.
The Promoter may disclose entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian and/or New Zealand regulatory authorities (depending on an entrant’s place of residence).
OPTING-IN TO HEAR FROM THE PROMOTER
