Abode Balloon Giveaway term and conditions
Section 1: Promotion
a) Promotion: Any person or organisation who subscribes to the Abode Newsletter at abodehotels.com.au between 26 November 2015 and 9 February 2016 is eligible to enter the draw.
b) Promoter: Abode Hotels Unit Trust (ACN: 158 140 964) of Unit 18, Level 1, 24 Iron Knob Street, Fyshwick ACT, 2609.
c) Promotion Period: The Promotion will commence at 12.01am (AEST) on 16 November
2015 and will close at 11.59pmm (AEST) on 9 February 2016.
Section 2: Eligibility
a) Eligibility: To be eligible to enter the promotion the entrant must:
i. Be above 18 years of age; and
ii. Be an Australian resident
iii. Enter during the promotion period: 12.01am (AEST) on 16 November 2015 and 11.59pmm (AEST) on 9 February 2016.
b) Non-Eligibility: Entrants are not eligible to enter the promotion or win any prize if they are a manager, an employee or immediate family member of an employee of the promoter, or an employee of their agencies associated with the promotion.
Section 3: Entry to the Promotion
a) Receipt of entries will close at 11.59pm (AEST) on 9 February 2016.
Section 4: Draw
a) Major Prize Draw:
i. A representative of the promoter will conduct a manual random draw from all eligible entries at 12.00 noon (AEST) on Wednesday 10 February 2016 at Unit 18, Level 1, 24 Iron Knob Street, Fyshwick ACT, 2609.
ii. The prize winner will be selected manually at random from all entries that comply with these terms and conditions.
b) Prize Winners:
i. The major prize described below in Section 5 will be awarded to the first eligible entry drawn.
ii. Winners will be notified by email within 48 hours of the prize draw.
iii. Winners will be published on
www.abodehotels.com.auSection 5: Prizes
a) Prize Components: There is one (1) major prize as follows:
i. Major prize includes:
• a hot air balloon flight in Canberra for four people
• two nights’ accommodation for four people at Abode Hotel Woden in Canberra
• Breakfast on two mornings at Abode Woden in Canberra
Behind the scenes tour of the Australian War Memorial and The National Museum
The above prizes equal the value of $5,200.00.
b) Prize Conditions: The prize is subject to the following conditions:
i. No exchange of Prize: The prize cannot be exchanged or redeemed for cash. If for any reason, the prize winner cannot take any component of the prize and he/she does not wish to transfer the prize, then the prize will be forfeited.
ii. Taxes: If the prize or receipt of it incurs a tax liability, the prize winner is liable for payment of such tax.
iii. Ancillary Costs: All transport, meals, beverages, mini bar, room service, spending money, insurances, service charges, transfers, taxes (other than those included in the flight portion of the prize) and ancillary costs are not included in the prize unless specified and are the responsibility of the prize winner.
iv. Prize Availability:
• All components of the prizes, are valid from 18 March 2016 until 20 March 2016. In the event that any component of a prize is unavailable for any reason, subject to state legislation, the promoter reserves the right to substitute that prize component with another prize of equal value and the prize winner will be notified accordingly.
• Flights are to be provided from the nearest capital city of winner to the value of $2,000.
• Balloon flights are pending weather conditions. In the event that the flight has been cancelled there will be no other flights offered.
• The major prize winner will be required to contact central reservations to book the accommodation and balloon flights with a minimum of 14 days prior to the event. Contact details for booking will be provided to the prize-winner when notified of winning the prize.
v. The prize must be taken as stated. No compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. There can be no changes made to travel arrangements once tickets are issued. If the prize is not utilised within the validity period it will be forfeited.
d) The prize winner may be required to present a credit card at the time of accommodation check in and will be liable for all incidental hotel expenses incurred by the prize winner save for the prize components listed in Section 5.
e) The promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the prize winner and their travel companion to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event.
f) The prize winner and travel companion are advised to consult their healthcare professional regarding health checks prior to taking the prize and to check for any perceived hazards with appropriate organisations.
Section 6: Prize Winner
a) Contact: The promoter will contact the prize winner by email by Tuesday 10 February 2016 to confirm their eligibility under these terms and conditions and to confirm whether the prize winner wishes to claim their prize.
b) Claim of Prize: If the prize winner wishes to claim their prize, they must confirm the fact and their eligibility to win under these terms no more than 1 week after the draw date. If the prize winner fails to do either or both of these things by the deadline, the prize winner will be deemed to have forfeited the prize.
c) Redraw: Subject to any written directions given by state authorities or other applicable law, in the event that a prize remains unclaimed, the promoters will conduct a redraw, following the same procedure and format as set out under the Section 4 above. The redraw will take place at 2.00pm (AEST) on 17 February 2016 at the same place as the original draw described in Section 4.
d) Redraw Winner: The Promoter will contact the prize winner by email. In the event that this redrawn prize winner is not eligible, the promoters will conduct a redraw until the prize is awarded (subject to any further regulatory directions).
e) Winner Publicity: In accepting the prize, the prize winner agrees to participate in any publicity arrangements made by or on the behalf of the promoter. The prize winner further acknowledges that the promoter reserves the right to publicise their name, address and photographs without any payment being made to them in respect of this
Promotion.
Section 7: General Conditions
a) Offer conditions: Subject to availability and cannot be used in conjunction with any other offer.
b) Lost, Delayed Communication: The promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.
c) Disputes: In the event of a dispute, the decision of the promoter is final and binding and no correspondence will be entered into.
d) Privacy Notice: During the course of the promotion, the promoter may collect personal information in relation to entrants. This may include, but is not limited to, the names, email addresses, telephone numbers of the entrants. The entrant’s personal information is collected so the promoter is able to conduct the prize draw and to contact and award the prize to the prize winner, to publish the results of the promotion.
e) Consent to use of Personal Information for marketing purposes: Furthermore, by entering this promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of the information collected by the promoter.
