TERMS AND CONDITIONS OF ENTRY

1. Information on how to enter the Competition forms part of these terms and conditions of entry. Participation in this Competition is deemed acceptance of these terms and conditions of entry.

2. The Competition commences at 9.00am Monday October 12th 2015 and concludes at 5.00pm Sunday April 10th 2016 ('Promotional Period').

3. The promoter of this Competition is Harness Racing Board (ABN 22 764 910 853), 400 Epsom Road, Flemington, Victoria, 3031 Telephone: 03 8378 0200 ('Promoter').

4. Officers and employees of the Promoter (and their immediate families) and the associated companies and contractors of the Promoter are ineligible to enter the Competition.

5. The Competition is open to entrants 18 years of age or over.

6.To be eligible to win, individuals must sign up to be a HRV database member ('Member') through the HRV Trots Cruiser website at http://www.trots-comp.com ('Website'') during the Promotional Period. The Promoter reserves the right to decline any entry if any of the information required to be entered on the Website to become a Member, including email address, full name and contact phone number, is not stated clearly on the sign up form.

7. Individuals may only enter the Competition once through the Website. Entrants may be invited to enter the Competition a second time by completing a short survey sent to the registered email from the validated first entry. The time of entry into the Competition will be the time the online entry or survey (as the case may be) is received by the Promoter’s database (as determined by the Promoter in its discretion).

8.The Promoter reserves the right to verify the validity of entries, prize claims and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry or prize claim that is not in accordance with these terms and conditions or who tampers with the entry process. An entry that is incomplete, indecipherable, illegible or non-compliant with these terms and conditions is invalid and will not be accepted or considered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9.The Promoter also reserves the right to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, to register single or multiple entries.

10. Any entry that is made on behalf of an entrant by a third party will be invalid.

11. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in any of clauses 8, 9 or 10 of these terms and conditions.

12. Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

13. The winner of the Competition will receive a demo model Toyota FJ Cruiser 4.0 litre petrol which had a value of $44,317.40 (the 'Prize') at the start of the Promotional Period. The car will include 12 months registration valued at $770.09 (which will be paid for by the Promoter once the Prize has been drawn). The total prize value at the start of the Promotional Period is $45,087.49

14. The Prize is subject to any written conditions provided with the Prize. The winner accepts that the Prize is second hand and that as a demo model it may have minor defects and have accumulated mileage when provided to the winner. To the full extent permitted by law, the Promoter makes no representation or warranty whatsoever to the winner about the condition of the Prize on delivery to the winner or its suitability for the winner's purposes. If the winner accepts the Prize, it does so on an 'as is where is' basis

15. If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification the Gambling Regulations Act 2003 (Vic) and any regulations made under that legislation ('State Regulation').

16. It is a condition of accepting the Prize that the winner comply with all the conditions of use of the Prize and the Prize supplier’s requirements.

17. The winner of the Competition will be determined by a draw conducted by the Promoter at Harness Racing Victoria – 400 Epsom Road Flemington 3031 on 15th April 2016. The Promoter reserves the right to draw additional entries in case an invalid entry or ineligible entrant is drawn. The winner need not be present at the draw.

18. The winner of the Prize will be notified by phone and/or email within one business day of the draw. The name of the winner will also be published on the Website and the HRV website at www.hrv.org.au.

19.The Prize will be available for collection by the winner on Friday April 22nd 2016 from HRV, 400 Epsom Road, Flemington, Victoria, 3031.

20. The Prize may not be exactly as illustrated in any display, marketing or promotional materials for the Competition.

21. The Prize is not exchangeable or transferable and cannot be redeemed for cash.

22. If this Competition is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the Competition to the full extent permitted by law.

23. The Promoter's decision is final and no other correspondence will be entered into.

24. It is a condition of entry that the entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a Prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of the Competition (including any outcome), and promoting any products and services, distributed and/or supplied by the Promoter.

25. In consideration for the Promoter awarding the Prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the Prize ('Works'). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

26. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

27. Nothing in these Terms and Conditions limit, exclude or modify, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').

28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and condition; (e) any tax liability or duty incurred by a winner or entrant; or (f) use of the Prize.

29. OPT-IN: All entries become the property of the Promoter. By entering the Competition, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic communication. Please contact the Promoter if you wish to opt out.

30. By entering the Competition, each entrant consents to the Promoter collecting their personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the winner and prize fulfilment). Entrants' personal information may be disclosed to third party service providers for this purpose. Entrants' personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements, the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter. Entrants who are not willing for this to occur should not participate in the Competition.
