QANTAS CASH – CHANCE TO WIN $250,000 PROMOTION - TERMS AND CONDITIONS
1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way
2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 1300 825 302) (Promoter).
DURATION
3. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia on the date stated. The promotion commences at 12.01am (AEDT) on 25 February 2016 and closes at 11.59pm (AEDT) on 22 March 2016 (Promotion Period).
ELIGIBILITY TO ENTER
4. Entry into the promotion is open only to Australian residents who are Qantas Frequent Flyer members, are 18 years of age or older, are eligible to receive the Qantas Card with the option of Qantas Cash as set out in Clause 5
and have successfully activated the Qantas Cash facility (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate.
5. To be eligible to receive the new Qantas Card with the option of Qantas Cash you must be an Australian resident Qantas Frequent Flyer member 16 years of age or older. Heritage Bank Limited (AFSL 240984) (the Issuer) issues Qantas Cash under arrangements between it, Qantas and MasterCard Prepaid Management Services Australia Pty Limited (AFSL 386837) (a MasterCard business). MasterCard Prepaid Management Services Australia Pty Limited distributes Qantas Cash (together with Qantas which is an authorised representative of MasterCard Prepaid Management Services Australia Pty Limited for the purposes of providing general financial product advice with respect to Qantas Cash). ENTRY INTO THE PROMOTION
6. Eligible Entrants will enter the competition when, during the Promotion Period, they:
(a) register for the competition by one of the following methods:
(i) online by submitting their details at winqantascash.com; or
(ii) By clicking on the ‘Register now’ link contained in an email sent to Qantas Frequent Flyer members promoting the competition and following the instructions; and
(b) successfully apply to activate Qantas Cash
7. The Promoter is not responsible for any lost, late or misdirected entries.
8. Eligible Entrants are permitted a maximum of one entry (multiple entries are not permitted).
9. The time of entry will be deemed to be the time the entry is received by the Promoter.
10. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
THE PRIZE
11.
There will be eleven (11) prizes in total, comprising one (1) Grand Prize of a minimum value of AU$25,000 and a maximum value of AU$251,000 (including travel and accommodation in Sydney if required), and ten (10) Runner Up Prizes of AU$1,000. The maximum total prize pool value is AU$261,000.(a) The value of the Grand Prize will be determined at an Envelope Selection – one (1) sealed envelope will contain a card with the message “Congratulations! You’re looking at AU$250,000, thanks to Qantas Cash”, the remaining ninety-nine (99) sealed envelopes will each contain a card with the message “Congratulations! You’re looking at AU$25,000, thanks to Qantas Cash”. The Grand Prize Winner will select one sealed envelope from 100 sealed envelopes to reveal their prize value (Envelope Selection). The cash amount value selected will be loaded directly onto the Winner’s activated Qantas Cash facility after the winner has met certain identification requirements (to be determined by the Issuer of Qantas Cash. If the Grand Prize winner selects the envelope containing the AU$250,000 message, the cash amount will be loaded onto the Winner’s Qantas Cash facility after having met certain identification requirements.
(b) The Runner Up Prize will be ten (10) prizes of AU$1,000 each. Each of the 10 Runner Up Prize Winners will receive AU$1,000 loaded onto their Qantas Cash facility after they have been contacted.
12. The chance of the Winner selecting the maximum AU$250,000 value for the Grand Prize is one in one hundred.
13. The Envelope Selection will take place at Qantas Airways Limited, 10 Bourke Road, Mascot, NSW 2020, in Sydney, New South Wales, between the period of 29 March 2016 and 30 April 2016, on a date and time to be agreed between the Promoter and the Grand Prize Winner. The Grand Prize Winner (or their proxy) will be flown to Sydney (if required, one Qantas return economy airfare (flight associated taxes included), and 1 night in a 3 star accommodation (to a total of $1,000) as determined by the Promoter to be provided) from their nearest Australian capital city and transported to the Envelope Selection location.
14. If the Grand Prize Winner is unable to attend the Envelope Selection, they may appoint a proxy to attend and choose an envelope in their absence. If the Grand Prize Winner is unable to attend the Envelope Selection, and is also unable to appoint a proxy to attend on their behalf, they may choose to be awarded AU$25,000 to be loaded onto their Qantas Cash facility. If the Grand Prize winner chooses this option he or she will forfeit the chance to win the AU$250,000 Grand Prize.
15. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.
16. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
DRAWING OF ENTRIES
17. The draw will take place at 2:00pm (AEDT) on 29 March 2016 at the offices of MDSA at 15 Grosvenor Street, Neutral Bay, NSW 2089 and will be conducted by MDSA (Drawer). The winners will be determined by an automated random draw of all eligible entries.
18. The result of the draw is final and no correspondence will be entered into.
NOTIFICATION OF THE WINNERS
19. The winners will be notified by email and phone (using the details provided in each winner's Qantas Frequent Flyer online profile or his/her details provided via the entry form on winqantascash.com at the time of entry) within 2 business days after the draw and their names will be published on winqantascash.com on 31 March 2016 and in The Australian newspaper on 5 April 2016. The winners are responsible for ensuring that the contact details in his/her Qantas Frequent Flyer online profile, or his/her details provided via the entry form on winqantascash.com at the time of entry, are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.
RIGHT OF THE PROMOTER TO REDRAW
20. The Promoter reserves the right to redraw in the event of an entrant being unable to comply with these Terms and Conditions, forfeiting or not claiming a Prize. For any prize that remains unclaimed at 5.00pm (AEDT) on 29 June 2016, a second draw will be conducted by the Drawer on 13 July 2016 at the same time and place as the original draw subject to any written direction given under applicable law. Any winners determined in accordance with this clause will be notified by email or phone (using the details provided in the winner's Qantas Frequent Flyer online profile or provided via the entry form on winqantascash.com at the time of entry) within 2 business days following the draw and their name published at winqantascash.com and in The Australian newspaper on 20 July 2016. The winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile and provided via the entry form at the time of entry is accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details. If an Envelope Selection is required for an unclaimed prize winner the event will take place on 12 August 2016 at a time to be agreed between the Promoter and the unclaimed Grand Prize Winner, at the same location outlined in condition 13 of these Terms & Conditions.
LIMITATION OF LIABILITY AND VARIATION OF TERMS
21. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
22. The exclusion of liability in clause 21 does not apply to limit or exclude liability:
(a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; or
(b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
ENTRY DETAILS AND PRIVACY
24. Entry details remain the property of the Promoter. The name, photograph of the winners and testimonial from the winners may be used for promotional purposes by the Promoter, unless the winners otherwise notify the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at available at qantas.com/privacy.
TAX IMPLICATIONS
25. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
