Terms and Conditions
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences on 01/09/2015 and final entries close at 5:00pm AEST on 30/08/2016 (“Promotional Period”).

5. To enter, individuals must complete the following steps during the Promotional Period:

a) visit www.onlinepromotion.com.au;

b) follow the prompts to click through to one (1) of the brand specific pages featured on www.onlinepromotion.com.au (each a “Brand Page”);

c) follow the prompts to the promotional entry page featured on that Brand Page;

d) input the requested details (including their full name, gender, age, postcode and a valid email address);

e) submit the fully completed entry form (“Entry Form”); and then

f) provide the unique invitation link provided on screen (“Unique Link”) to a friend they would like to invite to participate in the promotion (“Referred Friend”). Individuals agree and warrant their Referred Friend is an Australian residents aged 18 or over and who has consented to receiving these types of messages from them. Entrants should only invite friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages.

In order to receive an entry into the draw, the individual’s Referred Friend must then follow the unique link provided to them to submit an entry during the Promotional Period. If the individual’s referred friend does not submit an entry via the Unique Link during the Promotional Period, they will not receive an entry in respect to that Entry Form.

6. Upon completion of the above steps, individuals will also have the opportunity to earn additional entries into the draw by inviting additional friends to enter the promotion. To do so, individuals must follow the prompts on screen to invite one (1) or more of their friends to enter the promotion via Twitter, Facebook, Google+, Pinterest and/or email. Individuals agree and warrant that they will only invite individuals who are an Australian residents aged 18 or over and who consent to receiving these types of messages from them. Entrants should only nominate friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages. Individuals will receive one (1) additional entry for every friend they invite to enter the promotion via one of the above methods (“Additional Entry”). The friend/s the individual invites in accordance with this clause are not required to enter the promotion for the individual to receive an Additional Entry in respect to that invitation. However, in order to receive any Additional Entries, the individual’s Referred Friend (as per clause 5(f)) must enter the promotion during the Promotional Period.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Multiple entries permitted, subject to the following: (1) only one (1) Entry Form entry permitted per brand page; (b) only one (1) Additional Entry permitted per friend referred in accordance with clause 6; and (c) each entry must submitted in accordance with entry requirements. For the sake of clarity, individuals are eligible to submit multiple Entry Forms, provided each Entry Form is completed via a different Brand Page.

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardize fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

11. The draw will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, VIC 3141 at 9:30am AEST on 31/08/2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

12. The winner will be notified by telephone and in writing by email within two (2) business days of the draw, and their name will be published online at www.onlinepromotion.com.au from 2/09/2016.

13. The Promoter’s decision is final and no correspondence will be entered into.

14. The first valid entry drawn will win that entrant (“Participant”) the opportunity to play a contingency game (“the Game”) for the chance to win $50,000. The prize will be awarded as a bank cheque made payable in the winner’s name to the value of $50,000.

The winner, if any, will be awarded the prize selected by the Promoter’s representative at the Game.

The below provides examples of how the winner can use the $50,000 Cash prize, awarded as a bank cheque. In all cases below, these are only examples of how the $50,000 Cash prize can be used once awarded.

15. The Game will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, VIC 3141 at 9:00am AEST on 07/09/2016. Any and all costs associated with attending the Game are the sole responsibility of the Participant. If the Participant cannot attend the Game, the Participant may participate in the Game via telephone whereby they will select a number between 1 and 200 (inclusive) and a representative of the Promoter will select the envelope bearing that number on their behalf. In the event that the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.

16. There will be 200 envelopes on display at the start of the Game. One (1) envelope will contain a promotional message representing $50,000. The other 199 envelopes will each contain a promotional message representing $100. The Participant/representative (“Attendee”) must choose only one (1) envelope without touching, handling or interfering in any way with any of the other envelopes on display. If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee selects the envelope containing the promotional message representing $50,000, then, subject to verification by the judges, the drawn Participant will win $50,000. If the Attendee selects an envelope containing a promotional message representing $100, then the $50,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win $100. The prize will be awarded as a cheque made payable in the winner’s name.

17. The drawn Participant’s odds of winning the $50,000 prize, are 1 in 200. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the major prize, and will depend upon the number of entries received.

18. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.

19. Total prize pool value is up to $50,000.

20. The prize, or any unused portion of the prize, is not transferable or exchangeable.

21. A draw for the prize, if unclaimed, may take place on 30/11/2016 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone and in writing by email within two (2) business days of the draw, and their name will be published online at www.onlinepromotion.com.au from 02/12/2016. The winner, if any, will be awarded the prize selected by the Promoter’s representative at the Game.

22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

24. Any cost associated with accessing a promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

25. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking/use of the prize.

28. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

29. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.onlinepromotion.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
