TERMS AND CONDITIONS:

Information on how to enter and prizes form part of these Conditions of Entry. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete or inaudible entries will be disregarded. The Promoter’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into. Information on how to enter forms part of the terms and conditions. Entry into this Competition is deemed acceptance of these terms and conditions of entry.
PROMOTIONAL PERIOD
1. Promotion commences on Sunday, 27th March 2016 at 21:00 AEDT and closes on Friday, 29th April 2016 at 00:00 AEST. Judging will take place at Promoter’s premises 24 Artarmon Road, Willoughby NSW 2068 on Monday, 2nd May 2016 at 09:00 AEST. The winner will be notified by phone and email using the contact details given in their entry by Wednesday, 4th May 2016
WHO CAN ENTER
2. Employees of the Promoter, and their immediate families and all companies and agencies associated with this promotion are ineligible to enter.
3. Entry is open to all residents of Australia who are 18 years or over who live within a 100km radius of Sydney, Melbourne, Canberra, Central Coast NSW or Brisbane and who are aged 18 years and over who are the registered home owner of the premises that they would like the Kitchen Package Prize to be installed in (Eligible Entrant).
4. If the Prize Winner is not the home owner of their premises or not in an area that Freedom Kitchens services i.e If the winner is a resident of SA, WA, TAS, NT or lives outside 100km radius of Sydney, Melbourne, Canberra, Central Coast NSW or Brisbane the winner will be ineligible to win the prize and will receive a $10,000 Freedom Gift Card. 5. The Promoter reserves the right, at anytime, during, or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process (including but not limited to tampering by way of the utilisation of techniques designed to avoid the payment of call costs or the utilisation of automated entry software) or who submits an entry that is not in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
HOW TO ENTER
6. To enter, individuals must:

ii) Answer the following question in 25 words or less: Why should you win a new Freedom Kitchen? They must include their full name, address, email address, daytime contact
number and submit the fully completed entry form as instructed.
AND the entry must not be, without limitation:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libelous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence; p) capable of violating any law;
q) capable of giving rise to civil liability

The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. 8. Multiple entries permitted but are limited to one entry per day. Each entry must be submitted separately and in accordance with the entry requirements.
9. The promoter is neither responsible nor liable for late, lost or misdirected entries. Incomplete, inaudible or indecipherable entries will be deemed invalid.
10. All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
PRIZE DETAILS
11. The most creative one (1) entry chosen from all entries received during the promotional period will be deemed the winner and will receive a Kitchen Package provided by Freedom Kitchens ABN 15 097 861 268 (Freedom Kitchens) valued at a maximum $20,000 (including GST) and is comprised of:
a) Kitchen cabinets with Hettich ArciTech soft-closing drawers and a Caesarstone® Classico benchtop valued up to $13,000
b) Stainless steel kitchen appliance package nominated by Freedom Kitchens, which includes an oven, gas cooktop, slide-out rangehood and dishwasher valued up to $2,000
c) Design, delivery and labour for installation of the Kitchen Package valued up to $5,000
d) The total prize pool is valued at a maximum $20,000.00 (including GST).
PRIZING TERMS AND CONDITIONS
e) The winner will have a choice of specific colours and finishes to include in the installation of the kitchen. These lists will be provided by the service provider at the time of winner notification. If the winner chooses a specific item or the design, delivery and labour for installation costs are outside of the current fee budget provided in the prize winning package, the winner will be advised of the additional cost and can opt to pay the additional cost or bring the total cost within the budget provided in the prize winning package; or
12. For the removal of doubt, the Kitchen Package Prize does not include:
a) trades works (other than kitchen cabinetry installation), glass splashbacks, appliances other than specified, ceiling lighting or flooring or other kitchen accessories including but not limited sink and taps;
b) any gas, electricity, water or associated costs incurred in before, during or after the claiming, installing and using of the Prize;
c) any accommodation, meals or other spending money incurred in relation to or ancillary to claiming or using the Prize;
d) any other ancillary or incidental expenses incurred in connection with the prize, whether before, during or after installation;
e) any insurances or taxes;
f) any construction, electrical, tiling or plumbing services;
g) any ongoing maintenance costs;
h) any costs in excess of the allocated budget per component of the Prize or any other ancillary costs associated with redeeming this Prize.
13. Winner is responsible for all of the trades’ works (other than the actual kitchen installation) such as plumbing, electrical and tiling. Much of this will need to be completed before the kitchen can be installed. The Freedom Kitchens team will make all reasonable attempts to assist the winner with contacts for these trades.
14. The Prize must be redeemed in full, as a package and all works must be completed by 24 April 2017. Freedom Kitchens will contact the winner after winner notification to organise redemption of the Prize.
15. All materials in relation to the installation of the Prize will be provided and all installation will be undertaken by suppliers and persons selected in Freedom Kitchens’ absolute discretion. Freedom Kitchens will provide contracted kitchen installers to install the prize components but are not responsible for any plumbing and/or electrical services or any structural, renovation or construction work. The Prize is subject to all of Freedom Kitchens’ standard terms, conditions and warranties relating to purchase and installation.
16. All prize items are valued in Australian dollars and are inclusive of GST. Prize item values stipulated in the above Condition 11 are based on the recommended retail prices as at the time of writing. The Promoter accepts no responsibility for any variations in prize values between such time and the date of prize redemption. The Prize is not transferable, exchangeable or redeemable for cash. In the event that the winner does not take or redeem a component of the prize by 24 April 2017, that component will be forfeited by the winner and cash will not be awarded in lieu of that component. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
17. The Promoter makes no representation or warranty as to the quality or suitability of any of the goods or services provided as part of the prize other than those which cannot be excluded under the Competition and Consumer Act Cth (2010), or any other warranties (whether express or implied) under any state or federal legislation.
18. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
19. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize. No tickets for any other game will be awarded. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The Prize is not valid in conjunction with any other offer. The Prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the Prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ online, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ online. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
20. The Promoter is not responsible nor liable for any Prize damaged in transit in the delivery of their Prize.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
23. It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
24. The Promoter reserves the right to request the Winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter.
25. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
26. If this Competition is not capable of running as planned due to any reason whatsoever, including but not limited to, programming changes, technical failures (either in the administration of the Competition or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or integrity of the Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify, suspend, terminate or cancel the Competition; and/or (b) disqualify any entrant, as appropriate.
LIABILITY AND RELEASE
27. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the Competition and/or (g) redemption of the prize.
PRIVACY
28. All entries become the property of the Promoter. The collection, use and disclosure of personal information in connection with this Competition are governed by the Promoter’s Privacy Notice available from the Promoter and these Conditions of Entry. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, Competitions or goods and services provided by the Promoter and/or the
Promoter’s partners and sponsors. The Promoter may also disclose information about you to its service providers to enable the Promoter to provide you with services. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. You consent to the Promoter’s use and disclosure of information about you as contemplated by this condition. Sponsor opt-in: The details of all Entrants who opt-in to hear from the Sponsor Freedom Kitchens and their Freedom partner (Steinhoff Asia Pacific (trading as Freedom)) will be entered into a database and the Sponsor and their Freedom partner may use these Entrants’ names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee. By opting- in, Entrants confirm that they allow their details to be used for this purpose. Certain legislation may imply warranties or conditions or impose obligations (collectively Provisions) in relation to the Promoter’s provision of services to you which cannot be excluded, restricted or modified except to a limited extent. If those Provisions apply, to the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect of any claim under those Provisions to, at the Promoter’s option, the supply of the relevant services again or the payment of the costs of having the services supplied again.
