    The #BrotherMakesMemories (“Competition”) is organised by Brother International (Aust) Pty Ltd (ABN 17 001 393 835) (“The Organiser”).

    This competition is in no way organised, endorsed or administered by, or associated with Facebook Inc. The entrant releases Facebook Inc from all liability in relation to this Competition. Entrants provide information to the Organiser, and not to Facebook Inc. Participation in the Competition constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Organiser, which are final and

    Winning a prize is contingent upon fulfilling all requirements as stated in these Official Each winner is solely responsible for the payment of any tax liability that may result from their acceptance and receipt of any prize. All applicable Commonwealth, State, Territory and local laws and regulations apply. Entry and participation is void where prohibited or restricted by law.

    ELIGIBILITY: The Competition is open to legal residents of Australia who are over 18 years of age, as of the date of entry who are able to fulfil conditions relating to the prizes specified in these Official Rules, should they be awarded as a winner. Employees, and their immediate families and household members, of the Promoter, advertising and competition agencies, affiliates, subsidiaries, agents, contractors and other associated individuals are not eligible to enter or win this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

    Entrants must also have a pre-existing Facebook or Instagram account, prior to submitting an entry. Use and membership of Facebook and Instagram are subject to each platform’s terms of use.

    TIMING: The competition will commence on 06th April 2016 at 2:00PM and end on 3rd of May 2016 at 2:00PM (the “Competition Period”) Australian Eastern Standard Time (AEST). The Organiser’s computer will be the official time-keeping device for this

7.   HOW TO ENTER for the Grand Prize and Runner Up Prize component:

    The Organiser will provide one video to set the theme on the 01st of April 2016 and launch the #BrotherMakesMemories campaign. Based on that, the Organiser will work with selected influencers to create a series of sentimental projects with instructions, which will be made available on the Brother Facebook page, through an app. The influencer projects will be a handmade item gifted to the influencer by the influencer’s mum or made by the influencer for their kids. The influencer’s projects will fall into three categories: “toys”; “clothing/ fashion”; “stationery”. These influencer videos will also be hosted on the Brother website (projects page – marked with the video floral border) and ultimately on brother.com.au/brotherinspires microsite (once it goes live). These projects will have the campaign border to identify them as specific to this Mother’s Day campaign. During the Competition Period, entrants must create a project that has similarity to an original creation by an influencer OR a new unique project true to the theme (i.e. stuffed toy similar to a stuffed bunny). The entrant’s project should be handmade with the idea of creating memories with the Brother machine. Once created, entrants will then need to capture an image of their creation and upload it along with a caption on the Brother Australia Facebook, in accordance with the upload process specified in clause 7.2, with the hashtag #BrotherMakesMemories. The hashtag must be used in the caption when submitting the entry. The Organiser has full discretion to determine the eligibility of entries received.

        Entrants can upload their entry by:

        Visiting facebook.com/BrotherAustralia and then clicking on the #BrotherMakesMemories competition App on the page; and then

        Submitting the Entry, choosing the most appropriate drop down box (toy; stationery; fashion/clothing) and filling out the entry form

    ENTRY REQUIREMENTS: All entries must be submitted during the Competition Period and must satisfy the following:

    The entry must be an original creation by the entrant – either inspired by the influencer project (e.g. a stuffed toy inspired by a stuffed bunny) OR their take on the influencer’s project (a pink bunny instead of the influencer’s leather bunny);

    The entry cannot refer to or contain any brand names other than those of the Organiser and cannot be substantially identical or deceptively similar to any third party product names, brand names or trademarks;

    The entry must be submitted in .jpg, .gif or .png file The size of any file submitted must be within the maximum specified by the entry platform used to submit the Entry and in any event must not exceed 7MBs.

    The entry cannot contain material that violates or infringes any third party’s rights, including but not limited to privacy, publicity, or intellectual property rights, or that constitutes copyright infringement; and

    The entry cannot contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and

    The entry cannot contain material that is inappropriate, obscene, indecent, offensive, violent, hateful, or defamatory, or that disparages the Organiser or contains any other content otherwise prohibited by or contrary to the laws of the State or Territory in which the Entry is created; and

    Any entry that is determined by the Organiser in its sole discretion at any time during the Competition to violate the Entry Requirements or these Official Rules, or to otherwise be unsuitable, offensive or in poor taste may be rejected and

    Each entry must be viewable by the Organiser as of the date of judging. The Organiser reserves the right to remove or request that an entrant remove any entry which does not comply with these terms and conditions.

9.       ENTRY CONDITIONS:

    There are no restrictions on the number of unique entries submitted during the Competition Period per entrant, however any attempt by a person to use multiple names or email addresses to enter the Competition will result in immediate The Organiser reserves the right to request documentation from an entrant to confirm the validity of their entry and the entrant must provide such documentation within the time and in the format specified by the Organiser. Any attempted entry by means except as permitted in these Official Rules is prohibited and will void all submitted entries by that entrant. The Organiser reserves the right, in its sole discretion to disqualify any entrant that tampers with the entry process, or acts in a way that the Organiser considers not fair or equitable.

    An entrant cannot submit one project under multiple categories.

    The Organiser reserves the right to amend these Official Rules at any point, should such an amendment be required to ensure that the competition is conducted fairly or to clarify the rules governing this competition.

    All entries become the property of the Organiser. The Organiser’s decision, in relation to any aspect of this competition, is final and no correspondence shall be entered into. No responsibility is accepted for entries not received by the Organiser. Entries will be deemed invalid if stolen, forged, mutilated or tampered with in any way.

    Entrants agree, at the Organiser’s request, to participate in any competition or promotional activity and consent to the use of winning entries in future product branding, advertising, competition and other marketing materials including but not limited to facebook.com/BrotherAustralia,Brother Australia’s Instagram account and Brother Australia’s Pinterest account including, but not limited to, in connection with this competition or the winning of any prize. Entrants agree that they will not be further remunerated for such use. Some of the selected (on random basis) entries may also be featured along with instructions and images on the Brother Inspires microsite. The Brother team will be in touch with those selected to obtain a full copy of the instructions, images, and other associated project assets and the entrant will be acknowledged on the Brother microsite. Entrants consent to the Organiser and its associated agencies’ using their name and image in any media in perpetuity, without limitation and without further compensation to the entrant. The Organiser will include credit attribution using the entrant’s first name and last initial or username in connection with the display or reproduction of their Entry, entrants agree to waive all rights to review or approve the credit attribution format prior to publication. Due to the nature of social media platforms, the Entry may be stored on the social media platform after the close of the Competition Period and the Organiser is under no obligation to remove the Entry from a social media platform if posted in accordance with this section.

    All Entrants must provide a valid and functioning email address, which must remain valid and functioning for notification purposes, and their full accurate name at the time of In the event of a dispute about the identity or eligibility of a potential winner, the Organiser will deem the winning Entry to have been made by the “Authorised Account Holder” of the email address used at the time of entry and he/she must comply with these Official Rules. Authorised Account Holder is defined as the clearly identified natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organisation responsible for assigning email addresses for the domain associated with the submitted email address. Internet access is required and normal Internet access and usage charges imposed by online service providers will apply. Any costs associated with entering the competition and accessing the website or Apps are the responsibility of the entrant.

    WINNER SELECTION: Eligible entries will be judged by the corresponding influencer and there will be 3 selected for the 3 corresponding categories – the influencer that owns that category will judge the entries using the following equally weighted criteria: the skill and creativity shown in entry based on whether the Entry has similarity to the influencer’s original creation on Brother’s Facebook page/ microsite OR is a new unique project inspired by the influencer’s project. The selected judges (influencers) will select 1 prize winner per category based on the Judging Criteria to win the below.

11.    PRIZES:

There will be one (1) Grand Prize Winner picked from the top three submissions under the three categories, which will include:

Grand Prize

    Brother product: one product will be chosen according to the category the winner belongs to. Each valued at up to $699.

        Toy category winner – Brother computerised sewing machine NS55

        Clothing/ Fashion category winner – Brother computerised sewing machine NS55

    Up to $3,000 in sewing accessories/ crafting or sewing year’s supply of material via an Eftpos card

    A crafter-noon with the corresponding influencer (e.g. If the Grand Prize is won by the Toy category winner, then the Grand Prize would include a crafternoon with the toy category influencer- Hipster Mum) for up to 10 people in the winner’s home valued at up to $10,000. The ‘crafternoon’ will involve the influencer from the winning category hosting a 2 x hour crafting/ sewing session at the winner’s home. The winner can invite up to 10 of his/ her closest friends and family for this session. The winner must ensure that their house is an appropriate venue for such an event. The crafternoon value includes all associated influencer costs.

There will be (2) Runner-up Prize Winners from remaining categories, which will include:

12.       PRIZE RESTRICTIONS:

    The Grand Prize winner must host the crafternoon in a venue that is suitable for the prize activities and for the number of people likely to attend. The Grand Prize winner will be required to confirm in writing, on request, that the venue is suitable and that any risks to attendees will be managed solely by the Grand Prize Winner. For the avoidance of doubt, by this clause, the Organiser does not seek to limit any liability which cannot be excluded under law, including relating to product safety.

    Each winner assumes sole responsibility for all incidental costs and expenses associated with prize acceptance and use not explicitly stated herein as being provided, including without limitation, all Commonwealth, State, Territory and local taxes, including income taxes (if any), fees, and surcharges on the The Organiser will comply with all tax reporting requirements. Prizes are not redeemable for cash and prizes may not be transferred or substituted except that the Organiser may substitute a prize, or portion thereof, with a prize of comparable or greater value. Any portion of any prize not used by any winner is forfeit, and no cash substitute will be offered or permitted.

    These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable statutory guarantees as provided under the Competition and Consumer Act 2010 (Cth), and any other warranties (whether express or implied) under any state or federal legislation which cannot be excluded.

    Except for any liability that cannot by law be excluded, the Organiser (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

    The prize winner must accept the prize as described in these Official If the prize winner is not willing or able to accept the prize as described, the Organiser may, in its discretion, disqualify that winner and award the prize to an alternate winner in accordance with the disqualification provisions below.

    PRIZE DELIVERY: Each prize will be mailed or shipped to the winner in accordance with the information supplied to the Organiser by the winner, which must be supplied in the time frame and manner specified by the Organiser. The crafternoon will be provided to the grand prize winner in accordance with the information supplied to the Organiser by the winner. Allow up to 4 to 6 weeks after verification of eligibility for prize (refer to clause 15) and service delivery.

14.    WINNER NOTIFICATION, VERIFICATION AND DISQUALIFICATION:

    Notification of Potential Winner: Each potential winner will be notified via email on 6th May 2016 and must reply to the Organiser within the time period designated by the Organiser with information requested.

    Verification: Potential prize winner may be required to provide the Organiser with any or all of the following verification documents within 48 hours of initial contact of such requirements: validly executed Affidavit of Eligibility & Liability Release, a Publicity Release (where legal), acceptable identification (valid -photo ID), other proof of eligibility and other legal documents as determined by the Organiser.

    Disqualification: In the event that (a) any attempted notification or prize and service delivery to a potential winner is returned as undeliverable, (b) any prize is unclaimed within the required time period, or (c) any potential winner (i) does not reply to the initial notification within the time required, (ii) fails to satisfy any eligibility or verification requirement herein, (iii) declines to accept the prize or to accept the prize as described herein, (iv) or is otherwise determined to be ineligible or not in compliance with these Official Rules for any other reason, the Organiser in its discretion may disqualify that individual and award the prize to an alternate winner based on the next highest scoring An alternate winner is subject to all eligibility requirements and restrictions of these Official Rules.

15.    GENERAL CONDITIONS:

    The Organiser is not responsible for lost, late, incomplete, stolen, delayed, inaccurate, or illegible All entries become the property of the Organiser upon receipt and will not be acknowledged or returned.

    The Organiser reserves the right to cancel, terminate or suspend this Competition or any part of this Competition should any non-authorised intervention or other cause beyond the Organiser’s control corrupt or impair the security, administration, fairness or operation of this Competition as determined by the Organiser in its sole

    The Organiser reserves the right to prohibit any entrant from participating in the Competition if, at its sole discretion, the Organiser finds such entrant to be tampering with the entry process or the operation of the Competition, of if the entrant has repeatedly shown a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner that the Organiser determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or the Organiser; or (c) in any other disruptive Any person attempting to defraud or tamper with this Competition in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Any failure by the Organiser to enforce any of these Official Rules shall not constitute a waiver of these Official Rules.

    Caution: any attempt by any individual to deliberately undermine the legitimate operation of the competition may be a violation of criminal and civil laws and should such an attempt be made, the Organiser reserves the right to seek damages from any such individual to the fullest extent permitted by law.

    GOVERNING LAW: This Competition is governed by Australian law and is subject to all applicable federal, state and local laws and All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrants and the Organiser in connection with this Competition shall be governed by and construed in accordance with the laws of Australia, without giving effect to any choice of law or conflict of law rules (whether of Australia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Australia.
