TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, Participating Masters Home Improvement Stores (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 12/02/2016 and final entries close at 11:59pm AEST on 20/04/2016 (“Promotional Period”).
To be eligible to enter, individuals must purchase, at least 3.43 litres of any Sherwin-Williams branded paint product, in a single transaction, from a participating Masters Home Improvement Store in Australia during the Promotional Period. A Participating Masters Home Improvement Store is any Masters Home Improvement store in Australia that displays point of sale material featuring this promotion (“Participating Masters Home Improvement Store”).
To enter, individuals must then send an SMS containing their first and last name, mobile number, email address, suburb of their Participating Masters Home Improvement Store (as printed on the receipt) of purchase and their receipt number to 0429 078 685 so that it is received by 11:59pm AEST on 20/04/2016.
SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process, including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying transaction made. For clarity there is only one (1) entry permitted per transaction, regardless of the amount of Sherwin-Williams paint purchased in that transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Masters Home Improvement Store of purchase and that the purchase was made during the Promotional Period but prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Entries will be divided into groups based on the Participating Masters Home Improvement Store of purchase. There will be one (1) draw conducted for each Participating Masters Home Improvement Store. The draw for each Participating Masters Home Improvement Store will take place at Masters Home Improvement Head Office, 3 City View Road, Pennant Hills NSW 2120 on 30/04/2016 at 12:00pm (noon) AEST. The Promoter may draw additional reserve entries (for each Participating Masters Home Improvement Store) and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing by SMS (and potentially via telephone where deemed appropriate by the Promoter) within (2) business days of the draw and, if necessary, the Promoter will record their address details so that the prize may be awarded. Winners’ names will be published online at www.masters.com.au from 07/05/2016.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn from entries received in each Participating Masters Home Improvement Store will each win a painting renovation for their home valued at up to $3,700. Each painting renovation prize includes:
A two (2) hour consultation with a colour specialist, of the Promoter’s choosing, at the winner’s home to discuss colour options. In the event the Promoter cannot provide a colour consultation due to the winner’s place of residence, the Promoter will provide the winner with a $250 Masters Home Improvement Gift Card and a Sherwin-Williams colour fandeck pack;
Up to 50L of Sherwin-Williams Cashmere Interior Paint. Colour selection is of the winner’s choice subject to Masters Home Improvement stock availability; and
Services of a certified painter up to the value of $3,000 to prepare and paint the winner’s chosen internal walls and/or ceilings with the Sherwin-Williams Cashmere Interior Paint. Preparation and painting by the certified painter must be completed by 31 December 2016 Any additional costs associated with painting the winner’s chosen room/s (including additional paint and or labour from the certified painter) will be the responsibility of the winner. In the case a winner is not the home owner of their premises, the winner bears all responsibility for obtaining all approvals and permissions necessary for any painting to be carried out and the Promoter, may in its absolute discretion, request to see such written approval from the home owner. The room makeover may be applied to any room(s) of the winner’s choice in their house, townhouse or apartment. If the winner rents their house/townhouse/apartment, the winner must provide the Promoter with written consent from their landlord that the makeover can take place on their premises before the room makeover may commence.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize (or an element of the prize) within 3 months of the draw, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The number of Participating Masters Home Improvement Stores in each State and Territory are as follows: NSW 17, ACT 1, QLD 16, VIC 18, SA 2 and WA 9. The total prize pool available to be won in each State and Territory is as follows: NSW $62,900, ACT $3,700, QLD $59,200, VIC $66,600, SA $7,400 and WA $33,300. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
A draw for any prize from a particular Participating Masters Home Improvement Store, if unclaimed, may take place on 01/08/2016 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winners, if any, will be notified in writing by SMS (and potentially via telephone where deemed appropriate by the Promoter) within (2) business days of the draw and, if necessary, the Promoter will record their address details so that the prize may be awarded. Winners’ names will be published online at www.masters.com.au from 18/08/2016.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.sherwinwilliams.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
Masters Home Improvement Australia Pty Limited (“Masters”) and Salmat Digital Pty Ltd (“Salmat”) also collect PI in order to assist the Promoter with the conduct of the promotion and the draw, and may use and disclose PI to the Promoter for these purposes. Full details as to how PI is handled by Masters and Salmat is set out in their respective Privacy Policies, which can be viewed at https://www.masters.com.au/diy-projects-ideas/support-help/privacy-policy (Masters) and at http://cdn.salmat.com.au/media/salmat/media/pdf/companyinformation/privacypolicy/privacy-policy-external.pdf (Salmat).
