Turkish Murkish is a new company with new ideas about an old product from an old tradition.

It is about Towels. Turkish towels. They are not so well known in Australia but that is changing, and here’s why…

Turkish Towels are made from hand-loomed, untreated Turkish cotton from the ancient town of Buldan in the valleys of the inner Aegean region of south western Turkey. Ottoman records from the 1600’s referred to the town’s pre-eminence in the textile trade. This expertise continues today and TurkishMurkish towels are the work of the descendants of these original artisans.

They are the perfect towel. They weigh about a third as much as a normal bath-towel. They don’t pick up and retain sand like a beach towel and they don’t take forever to dry. As a towel for the beach, bath or gym they are the best in class.

Terms & Conditions

1.   The following definitions apply to these Terms and Conditions:

a)   “Closing Date” means 11:59pm on 29/05/16.
b)   “Commencement Date” means 12:01am on 25/04/16.
c)   “Determination Date” means from 5.00pm (AEDT) on 30/05/16.
d)   “E-card” has the meaning set out in clause 25.
e)   “In-eligible Review” has the meaning set out in clause 37.
f)   “Participant” means a person who participates in the Program.
g)   “Product” means a product offered in the Program. “Products” means all of the products offered in the Program.
h)   “Promoter” means Foxtel Management Pty Ltd ABN 65 068 671 938, of 5 Thomas Holt Drive, North Ryde, NSW 2113.
i)   “Product Review” has the meaning set out in clause 29.
j)   “Program” means this Lifestyle.com.au Try It Rate It program.
k)   “Program Period” means the period between the Commencement Date and the Closing Date.
l)   “Relevant Parties” means the Promoter and the agencies and companies that are associated with the Promoter or the Program.
m)   “Reviewer” means a Participant who is selected to review a Product.
n)   “Supplier” means the supplier of a Product.
o)   “Website” means the Lifestyle.com.au Try It Rate It official website, located at http://www.lifestyle.com.au/win.

2.   All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.

PARTICIPATION

3.   The Program is administered by the Promoter.

4.   Entry to the Program constitutes acceptance of these Terms and Conditions. By entering the Program, Participants accept and acknowledge full responsibility for their decision to participate in the Program and to take a Product if they are selected to be a Reviewer.

5.   All entry instructions and product information published by the Promoter form part of these Terms and Conditions.

6.   This Program will be advertised on the Website.

7.   Entry into the Program is open to permanent residents of Australia who are not:

a)   employees of:
i.   the Promoter, Optus, or Telstra;
ii.   the Supplier;
iii.   any corporations or agencies related to the entities in paragraphs (i) and (ii) above; or
iv.   any of the Relevant Parties; or

b)   a spouse, de facto spouse, parent, child or sibling (whether natural or by marriage or adoption) of a person who is an employee of any of the entities listed in paragraph a) above. 

8.   Entry to the Program commences on the Commencement Date and closes on the Closing Date.

ENTRY

9.   To enter the Program, a Participant must, during the Program Period:

a)   go to the Website; and
b)   click on the Program link; and
c)   complete all of the mandatory details on the registration form, including (but not limited to) full name, date of birth, residential address (PO boxes will not be accepted), daytime phone number (including area code), mobile phone number and email address; and
d)   fulfil the age or other criteria specified for the Product.

10.   A Participant’s entry must not be:

a)   late;
b)   delayed;
c)   incomplete;
d)   incomprehensible;
e)   unlawful;
f)   obscene;
g)   defamatory;
h)   libellous;
i)   threatening;
j)   pornographic;
k)   harassing;
l)   hateful;
m)   racially or ethnically offensive;
n)   capable of encouraging conduct that would be considered a criminal offence;
o)   capable of violating any law; and/or
p)   capable of giving rise to civil liability.

11.   Participants may enter the Program multiple times over the Program Period.

12.   Each Participant can only be selected as a Reviewer once for this Program.

13.   Participants must ensure that their entries are received by the Promoter during the Program Period. All entries are deemed to be received at the time of receipt by the Promoter, not the time of transmission by the Participant. The Promoter takes no responsibility for late, lost or misdirected entries or for any delays or failures in any telecommunications services or equipment.

14.   Entry via the Website is free. However, any costs associated with accessing the Website are the responsibility of the person seeking access and are dependent on the internet service provider used. 

15.   Participants must make their Website entries manually using an internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.

16.   Should a Participant’s contact details change at any time between the date on which they enter the Program and the Determination Date, that Participant must notify the Promoter of their correct contact details immediately.

17.   All entries to the Program may be subject to verification by the Promoter. A Participant must, within seven (7) days of being asked, at the Promoter’s cost, allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter the Program, including but not limited to evidence of age, residence and/or identity.

18.   The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter the Program or to take a Product. In the event that a Participant cannot provide suitable proof of eligibility, that Participant will not be eligible to take a Product and no substitute or compensation will be offered.

19.   Any entry that is made on behalf of Participant by a third party, or otherwise by proxy, will be invalid.

20.   The Promoter may, at its absolute discretion, declare any or all entries made by a Participant to be invalid if the Participant:

a)   fails to establish their entitlement to take a Product to the Promoter’s satisfaction; or
b)   fails to produce items as required by clause 17 or produces items that appear to be illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
c)   appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process; or
d)   has submitted an entry that is not in accordance with these Terms and Conditions.

21.   It is a condition of entry that Participants sign a legal release form if requested by the Promoter at the time of taking a Product in a form determined by the Promoter in its absolute discretion.

REVIEWERS

22.   There will be 32 Reviewers determined from all entries received during the Program Period. Each Reviewer will receive one (1) Product.

23.   The Reviewers will be randomly selected on the Determination Date by the Promoter at 5 Thomas Holt Drive, North Ryde, NSW 2113.

24.   The Promoter’s decisions are final and no correspondence will be entered into. 

25.   Reviewers will be notified by an electronic card (“E-card”) sent to the Reviewer’s email address within two (2) business days of the Determination Date.

26.   Reviewers must confirm their acceptance of the Product via the link provided in the E-card within twenty-eight (28) days from the date that the E-card is sent to the Reviewer. In the event that for any reason whatsoever a Reviewer does not confirm their acceptance of a Product at the time stipulated by the Promoter, the Promoter reserves the right to offer that Product to another Participant in the Program.

27.   Selection of Reviewers is subject to availability of the Products and the Supplier’s terms and conditions. Where a Supplier is unable to deliver a Product to a Reviewer, the Promoter reserves the right to offer that Product to another Participant in the Program and no substitute Product or compensation will be offered to the Reviewer.

28.   Participants will not be eligible to be a Reviewer if they do not satisfy any age restrictions that may apply to a particular Product.



PRODUCT REVIEWS

29.   Each Reviewer will be required to complete a written review of the Product which complies with all review instructions and guidelines supplied by or on behalf of the Promoter (“Product Review”).

30.   Reviewers must submit a valid Product Review via the link provided in the E-card, or by following the links on the Website, before the date stipulated in the E-card. If no date is specified in the E-card, the Reviewer must submit their Product Review within twenty-one (21) days of receiving the Product. In the event that for any reason whatsoever a Reviewer does not submit a Product Review at the time stipulated by the Promoter, that Reviewer will not be eligible to review any future products. The Promoter is not responsible for any changes in dates, times or cancellations or other arrangements that may prevent a Reviewer from submitting a Product Review.

31.   A Reviewer’s Product Review must be the Reviewer’s original work and must not infringe the copyright, moral rights, trademark rights or any other rights of any third party. Each Reviewer warrants that their Product Review is their own original work and is not copied in any manner from any other work or works.

32.   All Product Reviews become the property of the Promoter. By submitting their Product Reviews, Reviewers hereby grant the Promoter an irrevocable, non-exclusive, worldwide, royalty free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of and display the Product Reviews for the purposes of conducting and promoting this Program or the Products, and advertising and marketing the Promoter, the Program or the Products on all media now known or later devised, in perpetuity. 

33.   By submitting a Product Review, Reviewers consent to any use of their Product Review by the Promoter which may otherwise infringe a Reviewer’s moral rights in their Product Review, including (without limitation);

a)   Exercising any of the rights in the Product Review without identifying the Reviewer; and
b)   Using the Product Review in any way that the Promoter sees fit, even if it results in derogatory treatment of the Product Review (as defined in the Copyright Act 1968 (Cth)).

34.   Each Reviewer warrants that:
a)   he/she has the full power and capacity to grant the rights, warranties and consents set out in these Terms and Conditions; and
b)   he/she will fully indemnify the Promoter against any loss or damage suffered by the Promoter:
i.   in the event any of the warranties given by the Reviewer are false; or
ii.   as a result of any breach of these Terms and Conditions by the Participant.

35.   The Promoter, or the Promoter’s agent, will select the Product Reviews to be published on the Website or otherwise communicated by the Promoter to the public in any media.

36.   The Promoter reserves the right to select and publish Product Reviews in its sole discretion.

37.   Any Product Review which contains defamatory, offensive or pre-used material, or which infringes the intellectual property rights of any person, or which is otherwise deemed unsuitable for publication by the Promoter in its sole discretion will be ineligible for publication (“Ineligible Review”). Any Reviewer who submits an Ineligible Review will not be eligible to review any future products.

PRODUCTS

38.   There are 32 Products to be reviewed in total, consisting of the following:
a)   10 Outlook Australia Pram Liner & Sleep Eazy Cover Sets, valued at $89.90
b)   5 Young Living Thieves Packs, valued at $307.55
c)   1 James Treble for Rugspace Karenna Rug, valued at $799.00
d)   16 Turkish Murkish Super Soft Towels, valued at $49.95


39.   All Product values are the recommended retail values in Australian dollars as provided by the Supplier and are correct at the time of publication on the Website. The Promoter takes no responsibility for any variations in the Product values.

40.   If any Product (or any part of any Product, if applicable) is unavailable for any reason, no substitute Product or compensation will be offered. The Promoter accepts no liability or responsibility for any loss incurred by any Participant or any other party if any Product (or any part of any Product, if applicable) is unavailable for any reason.

41.   Products cannot be refunded, transferred or exchanged and, except as expressly permitted by these Terms and Conditions, cannot be taken as a monetary payment.

42.   Products must be taken as stated. The Promoter accepts no liability or responsibility if a Reviewer is unable to use a Product as stated.

43.   Once a Product has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Product.

44.   If the Determination Date is a public holiday, the determination will be conducted on the following business day.

45.   Products will be offered to the people named in the selected entries.

46.   Products will be offered to the selected Participants in the Promoter’s sole discretion.

47.   Unless expressly stated, all costs and expenses associated with taking a Product become the responsibility of the Reviewer.

48.   Participants who are under the age of 18 years are advised to check the description of the product on the Website for details of any age restrictions which may apply to a particular Product.


GENERAL

49.   The Promoter reserves the right to take any action necessary in its sole discretion at any time.

50.   To the full extent permitted by the law, the Relevant Parties will not be liable for any loss, damage, claim, cost, expense or personal injury suffered or sustained (including, but not limited to, that caused by any person’s negligence) by any Participant in connection with the Program or the Products, including:

a)   any indirect, economic or consequential loss or loss of profits;
b)   any loss arising from the negligence of a Relevant Party; and
c)   any liability for personal injury or death.

51.   If, for any reason, the Program is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter that corrupt or affect the administration, security, fairness or integrity, or proper conduct of the Program, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or take any other action, including to cancel, terminate, modify, or suspend the Program.

52.   Reviewers acknowledge that the Products may be subject to additional terms and conditions imposed by third parties. It is a condition of accepting a Product that a Reviewer must become acquainted and complies with any such additional terms and conditions. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Products, or for the breach of those conditions by any person.

53.   Except for any liability which cannot be excluded by law, the Promoter is not responsible for:

a)   any problems or technical malfunction with any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or any technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in the Program;

b)   any incorrect or inaccurate information, caused either by users, by any of the equipment or programming associated with or used in connection with the Program, or by any technical error that may occur in the course of the Program; or

c)   any error; omission; interruption; deletion; defect; delay in operation or transmission; communications line failure; theft; or destruction or unauthorised access to, or alteration of, entries or Participants’ details.

54.   Any attempt to cause damage to any website or the information on any website associated with this Program or to otherwise undermine the fair and legitimate operation of this Program may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages in the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.

55.   These Terms and Conditions are governed by the laws of New South Wales. The Promoter and all Participants irrevocably submit to the non-exclusive jurisdiction of New South Wales.

56.   These rules are Terms and Conditions and constitute the entire terms and conditions between the Participant and the Promoter with respect to the Program. The Promoter may alter, modify, or amend these Terms and Conditions in its sole discretion, and will only provide Participants with notice of substantial amendments.

57.   All entries become the property of the Promoter.


PRIVACY

58.   The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. Participants’ personal information will be collected, used and disclosed as set out in the Foxtel Privacy Notice for this Program (at https://www.foxtel.com.au/got/support/accounts-billing/legal/comp-privacy-notice.html) and the Foxtel Privacy Policy (at http://www.foxtel.com.au/about-foxtel/privacy/default.htm).
