Terms and Conditions: Win a 12 Month Story Box Library subscription for your public library

A. PROMOTION

1. These terms and conditions (the “Terms and Conditions”) govern entry into “WIN A 12 MONTH STORY BOX LIBRARY SUBSCRIPTION FOR YOUR PUBLIC LIBRARY” (the “Promotion”) as organised by Story Box Library Pty Ltd (ABN 56 165 506 507) (“the Promoter”).
2. The Promotion commences on Sunday 1st May 2016 at 9.00 AEDT and closes on Tuesday 31 May 2016 at 17.00 AEST (the “Promotion Period”).
3. Valid entry into the Promotion constitutes acceptance of these Terms and Conditions by the Entrant.
4. The Promoter may amend the Promotion Period in accordance with legislative rules.

B. CONDITIONS OF ENTRY

1. Entry to the Promotion is only open to Australian residents who are employed by or officially volunteer for an Australian Public Library (the “Entrant”, “You”, “Your”).
2. Entrants acknowledge that by entering the Promotion they are acting as the agent of the relevant Australian public library, and are fully authorised to enter the Promotion on behalf of that organisation.
3. Entrants who are under the age of 18 must have permission from a parent or guardian to submit a valid entry for the Promotion.
4. Directors, management and employees (and their immediate families) of the Promoter, or agencies, suppliers or companies associated with this Promotion, are ineligible to enter.
5. For a chance to win, eligible Entrants must:
a) Visit www.storyboxlibrary.com.au.
b) Click on the Pricing link.
c) Click on the Sign up for a free 30 day trial link in the Libraries column.
d) Complete the online form (with all information entered correctly).
e) Comply with the Judging Criteria (see below).
f) Consent to the collection, use and disclosure of your personal information in accordance with these Terms and Conditions.
g) Submit your entry by clicking on the “submit” button.
6. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by an Entrant, and once submitted, no changes to or withdrawal of an entry will be permitted.
7. Only one (1) entry per Entrant will be accepted.
8. Entries that are late, incomprehensible or incomplete will be deemed invalid and will not be included in the judging process.
9. It is the responsibility of the Entrant to notify the Promoter of any changes to their address or contact details during the Promotion Period.
10. The Entrant acknowledges and agrees that the Promoter will not return the entry.
11. An entry must not include any content that depicts another person without that person’s express consent, and if that person is a minor, the consent of that minor’s parent or guardian.
12. An entry must not include any content that contravenes any law, infringes the rights of any person or is potentially offensive, defamatory, discriminatory or otherwise objectionable.
13. By entering this Promotion, you represent and warrant that the entry content is your sole original work and/or that you have all relevant permissions from the rights holder to include their work in the entry and those permissions entitle the Promoter to reproduce and use the entry in accordance with these Terms and Conditions.
14. You acknowledge and agree that by submitting an entry, You assign all rights, including but not limited to copyright, in the Entry to the Promoter and consent to the Promoter using the entry at its discretion in any manner, including by editing, modifying, removing, adapting or publishing the Entry in whole or in part, by way of all media, without payment to the Entrant of royalties or other compensation.
15. You acknowledge and agree that by submitting an entry, each Entrant consents to any dealings with the Entry that may otherwise infringe their moral rights in the entry.

C. JUDGING

1. This Promotion is a game of skill and chance plays no part in determining the Entrant that is selected to receive the free twelve (12) month Story Box Library subscription for their public library (the “Prize”).
2. All valid entries received during the Promotion Period will be individually judged by a panel appointed by the Promoter at the Promoter’s usual place of business.
3. The panel of judges will have regard to the overall quality of the entry, including literary composition, creative merit, suitability and originality in the context of the Promotion (the “Judging Criteria”).
4. The panel of judges will use the Judging Criteria to select the best entry to receive the Prize.
5. The winning entry will be announced on Friday 3 June 2016 and the winning Entrant will be notified by email (the “Notification Date”).
6. The names of the winning Entrant and their public library (the “Prize Recipients”) will be published on http://blog.storyboxlibrary.com.au/.
7. The Promoter will provide the winning Entrant with information about how the Prize Recipients can exploit the Prize, and will use its best efforts to ensure that the Prize is available for use within 5 business days of the Notification Date.
8. The judges’ decision will be final and no correspondence will be entered into regarding the selection or judging of the winning entry, including in the event of a dispute.
9. The total Prize value is no less than $999.00, and the final total Prize value is dependent upon population served by the Prize Recipients. The value of the Prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date. The Promoter retains the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable).
10. The Prize is non-transferable and non-exchangeable and cannot be substituted for any other product or cash equivalent and cannot be redeemed by any other entity other than the Prize Recipients.
11. The Promoter reserves the right to validate the authenticity of entries and to request that the winning Entrant and/or Prize Recipients provide proof of the Entrant’s identity and verification that the Entrant entered the Promotion on behalf of a certified Australian public library, and in the event that satisfactory proof cannot be provided (determined at the discretion of the Promoter) the Prize will be forfeited in whole.
12. If the Prize is unclaimed for a period of three (3) months after the Notification Date, the Promoter may at their discretion, select another entry from the remaining entries, based on the Judging Criteria, to receive the Prize, in accordance with these Terms and Conditions.
13. The Promoter may, in its sole discretion, declare any or all entries invalid, and/or prohibit further participation by an Entrant in this Promotion or any other competition or promotion held by the Promoter if the Entrant:
a. Disrupts, abuses, threatens, harasses or attempts to do any of these things to the Promoter, another Entrant or potential Entrant or anyone else associated with the Promotion;
b. Engages in conduct that is misleading, deceptive, fraudulent or damaging to the Promoter’s goodwill or reputation;
c. Fails to comply with any reasonable requests or guidelines in relation to the Promotion; and/or
d. Fails to comply with these Terms and Conditions.

D. LIABILITY EXCLUSION AND DISCLAIMER

1. The Entrant acknowledges and agrees that the Promoter and its associated agencies or companies will not be responsible for:
a. Lost, late, stolen, illegible, damaged or misdirected entries or any other technical malfunction or problem preventing Entrants from successfully submitting an entry.
b. Any injury or damage to an Entrant’s (or any other person’s) computer related to or resulting from participation in the Promotion and/or providing the warranties hereunder.
c. The Prize or any portion of the Prize not being provided for any reason beyond their reasonable control.
d. Any damage to or delay in delivery of the Prize.
e. Any injury, loss or damage, of any nature whatsoever, whether direct, indirect, special or consequential, which is suffered or sustained as a result of or in connection with entering the Promotion, receiving the Prize or using the Prize, except for any liability which cannot be excluded by law, in which case liability is limited to the minimum amount allowable by law.
2. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the Prize and these Terms and Conditions or cancelling the Promotion. Entrants will be notified via email of any modifications to these Terms and Conditions.
3. The winner of the Prize will grant the Promoter a non-exclusive, irrevocable, perpetual copyright licence to reproduce the work for the purposes of the Promotion. The Promoter will attribute the winning Entrant as the author of the work wherever it is reasonably able to do so.
4. Any tax liability arising as a result of accepting any prize is the responsibility of the Prize Recipient/s.
5. These Conditions of Entry do not exclude, restrict or modify any rights of an Entrant/Prize Recipient under Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter, including but not limited to a statutory guarantee that any services provided by the Promoter will be rendered with due care and skill and that any goods will be of acceptable quality.
6. Notwithstanding the above, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, other than the Australian Consumer Law, regarding the quality and suitability of the Prize awarded under these Terms and Conditions and will not be responsible for breach of any such implied terms.
7. Without limiting any disclaimer provided above, the Entrant acknowledges that there may be inherent risks involved in entering this Promotion or taking the Prize and takes full responsibility for any such risks and for any content provided in or with their entry and for ensuring that their entry complies with the Terms and Conditions.

E. GENERAL

1. All decisions and actions of the Promoter in relation to the Promotion are at the absolute discretion of the Promoter and are final and the Promoter is not obliged to negotiate or discuss any decisions or actions taken with Entrants or any other persons.
2. The Promoter requires the Entrant’s personal information in order to conduct the Promotion. If the Entrant does not provide the mandatory personal information requested then the Entrant will not be able to take part in the Promotion.
3. By entering this Promotion, each Entrant is taken to consent, on behalf of the Prize Recipients, to the Promoter using the Entrant’s personal information to administer the Promotion, to announce the Prize Recipients, and to communicate with third parties as required by law (including authorities that regulate this Promotion).
4. By entering the Promotion, the Entrant consents, on behalf of the Prize Recipients, to receiving from the Promoter future communications by email including newsletters, special offers and promotions from the Promoter unless otherwise expressly advised by the Entrant. For more information about how the Promoter manages personal information please consult the Promoter’s privacy policy at www.storyboxlibrary.com.au.
5. Entrants consent, on behalf of the Prize Recipients, that they may not use or disclose any information that is confidential (on the notification of the Promoter or that would reasonably be deemed to be information not generally available to the public), including but not limited to information about the management of the Promotion.
