The total Maximum Prize Value is up to $25,000.00 (AUD). Prize value is correct as at the date of printing. The Promoter accepts no responsibility for any change in prize value between now and the ultimate date on which the prize is taken. The Winner and their travelling companions must travel on the same flights to and from their destination. Transfers to and from the airport and travel insurance do not form part of this prize package. Any expenses incurred outside of those listed in Clause 4.2 become the responsibility of the Winner.
PRIZE CONDITIONS
5.1 Prize must be taken within twelve (12) months of the close date of the competition and is subject to booking and availability. The Promoter in agreement with the Winner will determine the exact date of travel but in the event that agreement cannot be reached, the Promoter reserves the right to determine the final dates for travel.
5.2 If for any reason the Winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
5.3 If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
5.4 The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
5.5 The Winner must be 18 years of age at time of entry and must provide valid identification to the Promoter to be a valid Winner. All travel companions under the age of 18 must travel with a parent and/or legal guardian.
5.6 In accepting the prize the Winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being filmed, interviewed and photographed, and the Winner grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use. The Promoter may share this editorial content with the sponsor for their own internal use including but not limited to digital and social media, for up to 30 days from the Grand Finale episode of House Rules.
5.7 The Winner agrees that they will not disclose any of their personal details, including any photographs, facts or circumstances, for a fee or otherwise, that relate to their winning of any prize in the Competition to any media or other organisation in Australia and as such may be required to provide the Promoter with a formal written undertaking.
5.8 The Winner and accompanying travel companions will be required to sign a prize acceptance form including liability and publicity waiver, and any other relevant forms or agreements or indemnities that the Promoter deems necessary in the form determined by the Promoter in its absolute discretion by 25 July 2016, to formally accept the prize before the prize booking can be made. If any of the travel companions are under the age of 18 the prize acceptance form will need to be signed by the parent and/or legal guardian that will be traveling with them.
5.9 The Winner and accompanying travel companions must complete all prize acceptance documentation by 25 July 2016.
5.10 The Winner must finalise the prize booking no later than 22 August 2016 and at least 60 days prior to the intended travel departure date. All travel must be completed within 12 months of the close date of the competition. Availability cannot be guaranteed during Christmas, School Holidays and Special Event Periods. Once the booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $150 including GST plus supplier charges which is payable by the Winner. No compensation or alternate travel arrangements will be made should the Winner and/or their travel companions fail to meet any of the travel requirements. Any associated costs will be the responsibility of the Winner and/or their travel companions.
5.11 Unless expressly stated in these Terms and Conditions, all other expenses related to the prize become the responsibility of the Winner and their nominated travel companions. Subject to the prize stipulated in Clause 4.2, the Winner and their travel companion/s are responsible for all expenses including but not limited to travel insurance and items of a personal nature, additional meals, laundry, telephone calls, additional nights or upgrades etc. additional transfers, room amenity charges, selected beverages, incidentals, mini-bar, in-room video, room service, telephone calls, activities, energy surcharges, services charges, and all other ancillary costs. A credit card imprint or cash deposit will be required from the Winner at accommodation check-in for all incidental charges.
5.12 All bookings and costs related to the Winner and their travelling companions travelling to and from their residences to the capital city of the Winner’s residing State/Territory, should such travel be necessary, are the responsibility of the prize Winner and their travelling companions.
5.13 The Winner and accompanying travel companions agree not to have parties, events or gatherings, and agree not to invite guests (other than those staying at the prize property and approved by the Prize Management Company, 33 Degrees Pty Ltd) to visit the prize property. Parties are not permitted under any circumstances and there is to be no disturbing noise between 10pm to 8am with no excessive noise at any other time. In the event that an unsolicited event and/or party ensues the Winner will be responsible to pay a AUD$5,000 event clause, loss of AUD$2,000 bond plus damages and any extra cleaning should it be necessary. Exact charges are subject to change depending on the chosen prize property.
5.14 The Winner and accompanying travel companions must agree that the prize property and furnishings will be returned in the exact same condition at the end of the stay as at the beginning and any damage and/or accidents, unintentional or otherwise are the responsibility of the Winner. By accepting this prize the Winner agrees to cover these costs should they be incurred.
5.15 The Winner must provide a valid credit card prior to arrival and sign a rental agreement. Costs associated with loss, damage or breakages will be charged to the winner's credit card after the departure inspection.
5.16 General cleaning is included but not extra-ordinary cleaning. If the home is left extra-ordinarily unclean or if excessive rubbish is left on-site additional charges will be incurred and charged to the Winner’s credit card number provided.
5.17 There is strictly no smoking inside the prize property and pets are not permitted.
5.18 The Winner must agree to abide by all the house rules communicated at the prize property.
5.19 A breach of any of the property rental condition will result in cancellation of the booking, refused access or immediate termination of the tenancy.
5.20 With reference to travel supplied as part of the prize package, travel suppliers shall be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency).
5.21 The prize must be taken as stated, is not transferable and cannot be exchanged for cash. No compensation will be payable if the Winner is unable to use the prize or any element of the prize.
6. HOW TO WIN
6.1 Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period will be entered into the major prize draw on Tuesday, 28 June 2016 at 09:00 AEST. This is a game of chance and skill plays no part in determining the Winner. The Prize draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 and their details published in the Public Notes section of The Australian newspaper on 30 June 2016.
6.2 Subject to state government legislation an unclaimed prize draw will take place at the same address as the original draw on 27 September 2016 at midday (AEST) and winner(s) will be notified by phone and email within 48 hours of the draw and their details published in the Public Notes section of The Australian newspaper on 4 October 2016.
6.3 The Winner will be notified within 2 days of the draw, by a phone call and a letter advising the Winner of their prize will also be express posted.
6.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
6.5 The Promoter may in its absolute discretion deem entries invalid subsequently to a Winner being notified or a Winner’s name being announced if it is discovered that the Winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw(s) will be conducted.
6.6 The Promoter may require the Winner to sign a waiver of liability and indemnity and any other relevant forms or agreements that the Promoter deems necessary in the form determined by the Promoter in its absolute discretion.
7. NO LIABILITY
7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
7.2 The Seven Network (Operations) Limited, McDonalds Australia Ltd, Yahoo!7 and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the entry process or the draw;
b) in the participation, acceptance or use of any element(s) of the prize;
c) as a consequence of late, lost or misdirected mail;
d) due to the broadcast of any program relating to the Competition or the publication of any material,
including any statements made by any compere, staff member, journalist, other entrants or any
other person;
e) in relation to failure of an online entry message received or sent by the Promoter on account of
technical problems or traffic congestion; or
f) arising from or related to any problem or technical malfunction of any mobile communications
network, computer on line systems, servers, or computer equipment, software or device related to
or resulting from participation in this promotion.
g) in relation to a McDonalds store not participating in this Promotion.
7.3 Seven Network (Operations) Limited, McDonalds Australia Ltd, Yahoo!7 and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
7.4 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
7.5 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the dinner event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a Winner or entrant; or (g) attendance at the prize event.
